RE: Existing Business Sign.
Dear Dr. Stiebel:
This letter regards our conversation this morning. The purpose of that conversation was to
discuss proposed improvements to the existing business sign on your property.
The existing business sign was part the original site plan that was approved by Frederick
County on April 21, 1986. Since that time, Frederick County has amended the Zoning
Ordinance regarding sign requirements. These amendments apply to all signs that have
been proposed since 1990. Due to this fact, your business sign is considered to be legally
nonconforming. Your proposal to set the existing business sign on a brick foundation is
acceptable provided the location does not change.

MAGISTERIAL DISTRICT: Opequon
ADJACENT LAND USE AND ZONING: Residential and Vacant Business Land Use and B-1
(Business Limited) and RP (Residential Performance) Zoning.
PROPOSED USE AND IMPROVEMENTS: Professional Office, Dentistry
REVIEW EVALUATIONS:
Inspections Department - Proposed building to be built in compliance with the
Virginia Uniform Statewide Building Code, ANSI 117.1 Handicap Requirements
and applicable referenced standards for the proposed use.
Sanitation Authority - Sewer and water service is available. Recommend that
fire hydrant(s) be placed in accordance with Chapter 10, Fire Protection, of
the Frederick County Code.
Stephens City Fire Company - No comment.
VA. Dept. of Highways - Basically, the proposal appears satisfactory.
However, we would require standard CG-6 concrete curbing to conform to the
existing curb on either side of this entrance. We would want the concrete
curbing extended along the property line and connected to conform with our
policy. Also, we would require a minimum of 8" of crushed stone in the
entrance way plus a minimum of 2" S-5 plant mix in the entrance way. A
permit must be applied for and approved before doing any work on the State's
right-of-way.
Planning and Zoning - The use and size of the structure are appropriate for
the B-1 Business Limited) District.
Screening is required along the rear of this lot between the B-1 use and the
adjoining RP Residential Use of Plymn Owens Estates. The staff would suggest
a natural screen, such as a double row of 6'-10' high white pines or
comparable screen.

A fire hydrant is required within 300' of all portions of the proposed
structure. The location of the hydrant needs to be shown to determine if the
Fire Code is being addressed. Sewer and water lines need to be shown on this
plan.
Separation between this lot and the adjoining developed lot (Sunrise Play
School) needs to be addressed and labeled on this plan. Car stops and a
handicap access ramp need to be added and moved to accomodate the existing
parking lot design.
STAFF RECOMMENDATIONS: Approval, with the changes noted under Planning and Zoning
and VDH&T evaluations.
PLANNING COMMISSION RECOMMENDATIONS: Tabled on April 2, 1986, in order for the
applicant to supply more information on the site plan.
Note: The utilities, hydrant, screening, and separation of parking areas have
been noted on the site plan.
