Dear Sirs:
The purpose of this letter is to confirm the zoning on a piece of property,
located at the Rest Church interchange on Interstate 81, which is identified
with property identification number 23000-A00-0000-0000-0017-0. This
property is currently zoned B-2 (Commercial General) under the Frederick
County Zoning Ordinance and that zoning district does allow for motor
vehicle sales with accessory service, which does include farm and industrial
equipment sales with accessory service. Enclosed is a page from the Frederick
County Zoning Ordinance which sets out the limitations under which motor
vehicle sales need to take place on this site. The telephone conversation
that I had with a representative of your company on April 4, 1985 seems to
indicate that the operations of your company would fit into this category. If
after reviewing this section of the Zoning Ordinance you do feel that you can
operate under the limitations of this use regulation, your use would be a
permitted use on this property in this zoning district.

BUSINESS, GENERAL DISTRICT B-2
11-1 STATEMENT OF INTENT
Generally, this district covers that portion of the community
intended for the conduct of general business to which the public
requires direct and frequent access, but which is not
characterized either by constant heavy trucking other than
stocking and delivery of light retail goods, or by any nuisance
factors other than occasioned by incidental light and noise of
congregation of people and passenger vehicles.
11-2 USE REGULATIONS
11-2-1 General retailing uses including, but not limited to, auctions,
appliance stores, bakeries, clothing stores, drug stores,
furniture stores, gift shops, automatic self-service laundries,
dry cleaning establishments, farm markets, and nurseries.
11-2-2 Travel -oriented businesses, such as hotels, motels and
restaurants.
11-2-3 Motor vehicles sales, with accessory service; including, but not
limited to, vehicle parts sales and car washing facilities. All
repair activity to take place within a completely enclosed
structure. All outside storage of disabled vehicles or vehicles
waiting for repairs, parts, or equipment must be fully screened
from adjacent residential zoning districts, areas within other
zoning districts which are predominantly residential in nature, or
any other areas which the Commission determines are in need of
such screening. The Commission shall determine the type and
amount of screening to be required.
11-2-3.1 Service Station
11-2-4 Office buildings, sales offices, financial institutions, and post
offices.
11-2-5 Commercial Indoor Recreation and Athletic Facilities
11-2-6 Institutional businesses such as hospitals, libraries, churches
and funeral homes.
11-2-7 Public utilities such as poles, lines distribution transformers,
pipes, meters, water and/or sewage treatment and distribution
facilities.

THIS SPACE SHOULD BE USED FOR REVIEW COMMENTS:
The proposed entrance appears to be within our minimum requirements with the
exception we would require a minimum of 15" culvert pipe and the pipe must be
extended even with the end of the radius of the concrete curbing, also
the curbing must be CG-3 . A permit must be applied for and approved before
doing any work on the State's right-of-way.

ADJACENT LAND USE AND ZONING: Church zoned A-2; vacant land zoned B-2
PROPOSED USE AND IMPROVEMENTS: Motor vehicle (heavy equipment) sales and
service.
REVIEW EVALUATIONS:
Inspections Department - Proposed structure must meet requirements of the
Virginia Uniform Statewide Building Code and other applicable standards for
the proposed use. Specific comments will be made upon submittal of building
permits.
Health Department - Comments will be provided.
Clearbrook Fire Company - Satisfactory.
VA. Dept. of Highways - The proposed entrance appears to be within our

Dear Mr. Stup:
This letter is to confirm the Frederick County Planning Commission's action at
their meeting of February 5, 1986:
Approval of Site Plan #001-86 of Vernon E. Stup Company to construct a motor
vehicle (heavy equipment) sales and service facility on Route 11 North, adjacent
to Rest United Methodist Church, in the Stonewall Magisterial District, with the
condition that the site plan be amended to show:
1. That screening will be provided between any equipment storage and either
Route 81 or the Rest Church property on the south side.
2. That the demonstration area for the equipment be designated.
The site plan must be amended to show these changes before final approval is
given. Please provide an amended plan or contact this office.
If you have any questions regarding your site plan, please do not hesitate to
call this office.
