RE: Abundant Life Christian Center In Frederick County, Virginia
Dear Rebecca:
I enjoyed the opportunity to discuss your department's licensing requirements associated with
day-care services. As you know, the Abundant Life Christian Center is interested in continuing
to provide this service in our community. It is my understanding that your primary concerns
with this day-care service include the need for a Final Certificate of Occupancy Permit for the
facility, as well as the unidentified occupancy load that is permitted for the use.
The Abundant Life Christian Center was issued a Temporary Certificate of Occupancy Permit
on July 24, 1991. Frederick County issued that permit as a result of outstanding site work and
some minor structural modifications. Since that time, the structural work has been complete,
but some of the site work remains incomplete. The policy of Frederick County is to only issue
a Final Certificate of Occupancy Permit when all structural and site issues are resolved.
However, it is the responsibility of the Abundant Life Christian Center to ensure that their
Temporary Certificate of Occupancy Permit remains valid.
By copy of this letter, I am advising Pastor Malcolm Van de Riet of these concerns. Pastor Van
de Riet may contact the Frederick County Fire Marshal and Building Official to obtain the
necessary information required by your department.

When -the original site plan for this site was submitted the
area of the building required a fire lane to achieve an allowable
area increase. This was required per B.O.C.A. Table ##501.
The sanctuary was not built and the existing structure is
only 6650 square feet. This is within the allowable area so a
fire lane currently is not required.
At a future date, when the sanctuary is constructed an
increase in allowable area will be required. This can be
accomplished by fire lane access or installing an automatic. fire
sprinkler system throughout the addition.
As of this writing, there are no outstanding corrections to
be made to the site for fire and rescue.

Dear Pastor Van de Riet:
This letter regards the renewal of Irrevocable Letter of Credit #288 issued by Farmers and
Merchants National Bank. This Irrevocable Letter of Credit was renewed on January 18,
1992 and has an expiration date of January 18, 1993.
Mr. Evan A. Wyatt of our department conducted an inspection of this site on December 14,
1992. Mr. Wyatt's report indicates that the berm and screening required by the Frederick
County Planning Commission is ineffective. This item needs to be addressed as a condition
of site plan approval, and is required prior to the release of your Irrevocable Letter of
Credit. Included is a copy of Mr. Wyatt's inspection report. Please address any questions
you may have regarding this report to Mr. Wyatt.
Irrevocable Letter of Credit #288 must be renewed and presented to this department no
later than Thursday, January 14, 1993. You may contact me if you have any questions
regarding renewal procedures.

Mr Evan Wyatt of your office has inspected the Site of our
new Building on Aylor Road and has identified six items
listed below that must be finished before we receive a
final occupancy permit. It is our understanding that we
may receive a temporary occupancy permit if we provide the
County with an "Irrevocable Letter of Credit" covering the
cost of the remaining items. We have applied for such a
letter from Farmers and Merchants Bank and will provide it
to you as soon as we receive approval from them. This
letter of credit will be for $25,000.00, the amount
estimated to complete the items identified by Mr. Wyatt.
These Items are:
1) Pave Parking Lot as per Plan 2" of S-5 $18,000.00
2) Install Islands in parking lot. 1,500.00
3) Stripe and Sign parking lot 500.00
4) Landscape Site 'including Berm and Fire lane 5,000.00
5) Complete Fire Lane base to be upgraded Unknown
6) Site Stabilized Unknown
Items 5 and 6 are Unknown because the cost of which is
included in an Existing Contract with the Excavation
Contractor and is not separately identified. This will be
completed by the Contractor as soon as the ground dries up
this spring.
We ask that on the basis of this information and the
receipt of the Letter of Credit, Vou please issue the
Temporary Occupancy permit at the earliest possible time.

RE:_ Occupancy Permit For New Church Facility
Dear Pastor Van de Riet:
This letter "regards my site inspection of the Abundant Life
Christian Center property yesterday. The purpose of this
inspection was to determine all outstanding site work to be
completed in order to receive a Final Certificate of Occupancy
Permit for this project. I offer the following comments:
1)A two (2) inch S-5 surface needs to be applied to the parking lot
and entrance way for this project.
2)The parking spaces (regular and handicapped) need to be painted
with durable paint.
3)The parking lot islands need to be provided.
4)The berm that separates the parking lot from the existing houses
in Fredericktowne needs to be provided with solid landscaping
(shrubbery or hedge) to prevent headlights from shining onto those
properties.
5)The entrance to this site needs to be built to the Virginia
Department of Transportation standards.
6)The disturbed area surrounding the church needs to be properly
graded, stabilized and revegetated.
7)The fire lane serving this site needs to be provided with a
compacted 21-A all weather surface capable of supporting fire
equipment.
8)The all weather surface fire lane needs to be marked with
California Privet as shown on the approved site plan.
9)The Fire Marshal will require the fire hydrant to be surrounded
with bollards to protect it from vehicles.

This site work will have to be complete prior to the issuance of
a Final Certificate of Occupancy Permit; however, our department
will allow the issuance of a Temporary Certificate of Occupancy
Permit if these items are covered by a performance bond. Details
of this bonding agreement may be worked out between Mr. Wayne
Miller, the Frederick County Zoning Administrator and Mr. McGrew,
the treasurer of your church. Once an agreement has been reached,
and the bond is received by our department, we will provide you
with a Temporary Certificate of Occupancy Permit.
During my inspection, you asked if you'may stockpile shale and soil
for future construction on this site. Frederick County allows for
the stockpiling of materials during construction; however, any
material for future construction is not permitted to be stockpiled
until that phase of construction begins.
Please keep this letter with your files for future reference. If
I may answer any questions regarding this letter, or be of any
assistance, do not hesitate to contact me.

This is to confirm our meeting with you on Friday afternoon March 23 regarding the final approval of
the plans for the Abundant Life Christian Center and the necessity for the screening of the property
with trees.
As a result of our discussion we have a better understanding of the reasons for the requirement and
we believe you have a better appreciation for our position that screening the church would be
inappropriate. In any event, we are pleased with your cooperativeness and with the following
agreement:
a) Abundant Life will revise the plans to show the screen and resubmit them right
away for approval and the issuance of proper permits.
b) Abundant Life will submit a letter to you in the next few days proposing an
amendment to the ordinance which would allow the Planning Commission to
waive the requirement if the use being proposed would be a permitted use on
the adjoining property with the lesser zoning.
c) You will submit that proposal to the Ordinance Committee to be considered for
proposal to the Board of Supervisors for adoption.
If these actions are followed through to conclusion the Planning Commission could then waive the
screening requirement. If for some reason this does not happen we would still have the option of an
appeal to the Board of Zoning Appeals or ultimately to request rezoning. There would, however, be
no enforcement of the screening requirement while the pursuit of these remedies was still in process.
Again, We want to thank you for meeting with us and your cooperative spirit and attitude in helping
us arrive at a solution that is workable for the Church and Frederick County. If you have any
questions please let us know. OUr specific proposal for the Ordinance Committee will be forthcoming
in a few days.

Dear Sonny:
This is to acknowledge your request of May 9, 1990 to construct a temporary
construction entrance at the above referenced location. As requested you are
given permission to install ,the temporary entrance. This letter is to be
considered your permit to do so.
The following are to be a part of this permit agreement:
1. While working on the State's right-of-way it will be necessary to use
"Nlen Working" signs which must be erected prior to starting work and
removed daily.
2. Traffic control will be in strict accordance with the attached.
3. Positive drainage is to be maintained within the right-of-way at all
times.
4. All work on the right-of-way is to be confined to the temporary entrance
location only.
5. A minimum 8" of coarse aggregate by 30' in width will be required to be
placed from the edge of pavement and extended back onto private property-
far enough to prevent carrying of mud onto the roadway.
6. Any damages to the pavement structure of Route 647 adjacent to this
entrance will be corrected by your firm to the satisfaction of the
Virginia Department of Transportation.
7. It should be understood any disturbed turf on the State's right-of-way
will be topsoiled and reseeded.
8. This Department will not be held liable for suit should such result from
this operation.

9. This temporary construction entrance permit is being issued for 180 days.
10. A land use permit forthe proposed commercial entrance will be applied
for within sixty (60) days of the date of this letter. This permit will
require an inspection fee and surety bond coverage in the amount of
$5,000.00.
If these requirements are not followed this temporary construction entrance
permit will be revoked.

Upon review of the above referenced site plans dated September 7, 1989 please
find our recommendations on the attached plans marked in red and as follows:
1. Because of traffic and safety considerations, Standard CG-2 Concrete Curb
is required in lieu of the asphalt curb.
2. The proposed headwalls are to be deleted and the culverts extended to
prevent an erosion problem behind the curbing.
3. A 100' taper will be required on the eastern side of the entrance.
4. The existing double 15" C.M.P. under Route 647 is to be supplemented with
an additional 24"x18" C.M.P.A. Pipe.
5. A half typical section of the entrance is to be added to the plans as
noted.
6. The proposed sanitary crossing under Route 657 is to be by standard VDDT
push, jack or bore methods.
Please revise and resubmit four (4) copies for final approval. Should any
changes be deemed necessary, please design them to meet or exceed the above
recommendations.

Applicant must be aware that, as Winchester Regional Airport
Expands services and operations, noise associated with such
expansion may increase. Consideration should be given to
insulating new and existing structures located within, one half
(112)-mile of the -end of the airport runway and 1,000 feet either
side of the imaginary extended center, line of such runway.

or adding a second layer of glass; upgrading doors and seals;
acoustic baffling. of vents; adding insulation to walls and attic
spaces; adding„.another layer of wall material to existing walls,
in effect cresting a two -panel wall; eliminating windows and
filling the space to match exterior walls.

When the original site plan for this site was submitted the
area of the building required a fire lane to achieve an allowable
area increase. This was required per B.O.C.A. Table #501.
The sanctuary was not built and the existing structure is
only 6650 square feet. This is within the ,allowable area so a
fire lane currently is not required.
At a future date, when the sanctuary is constructed an
increase in allowable area will be required. This can be
accomplished by fire lane access or installing an automatic. fire
sprinkler system throughout the addition.
As of this writing, there are no outstanding corrections to
be made to the site for fire and rescue.

Dear Evan,
I have reviewed the above referenced site plan and
offer the following comments or suggestions.
GENERAL
1. It appears that the access to this site is
adequate and the entrance has been coordinated with
the intersection across Route 647.
2. Route 647 is currently getting a lot of traffic. I
project a 60 foot right-of-way will be required for
this road. Now is the time to incorporate this into
improvement plans for this site. I don't see any
problems with the parking lot, however, the pond
could present a problem and should be moved back
towards the Southwest.
The County should request the Church to dedicate 30
feet from the existing centerline to allow for a 60
foot right-of-way.
DRAINAGE
1. It appears that the pond water surface for the 2
year storm will come very close to overflowing into
the road. An overflow encroachment will very likely
occur during the 10 year storm which drainage
facilities should be designed to handle.

2. The stormwater management facility needs to be
designed to detain the excess runoff rate as a
result of this development. Therefore, the pre -
development and post development runoff rates need
to be established so that actual storage volumes
needed to maintain the pre -development runoff rates
can be determined.
3. The discharge invert for one of the extended
D� U ENGINEERS culverts under Route 647 is higher than the
ARCHITECTS discharge under the driveway. The proposed new
i culvert under Route 647 should be installed at an
- SCIENTISTS elevation compatible with the driveway culvert.
4. The culverts under Route 81 do not appear to
coincide with the contours of this project. This is
a point of interest and not a requirement of the
church, however, if a ponding problem exists, this
could be resolved with some modifications to the
drainage swales. There appears to only be 0.82
percent drop between the existing culverts under
Route 647 which would require fairly tight controls
on any ditchline through this property.
5. Drainage around the proposed building and parking
lot appears to be adequate.
EROSION AND SEDIMENTATION CONTROL
1. A construction entrance is provided.
2. Silt fencing and sediment traps are proposed around
the perimeters of the disturbed ground.
I feel the above items need to be addressed as
indicated prior to recommendation of plan for
approval.
