RE: Site Insnection Of Corrugated Container
Dear Mr. Higginbotham:
This letter regards my site inspection of your property on December
11, 1990. The purpose of this inspection was to guarantee the
completion of all required work on Site Plan #007-90. During my
inspection, I noted corrections that need to be complete prior to
the issuance of a Final Occupancy permit. They are as follows:
1) The parking spaces need to be marked (especially the
handicapped space) to insure that this area provides the
required amount of parking. This may be accomplished by
striping the sidewalk/curb area.
2) Rip -rap needs to be provided on the outside of the storm
detention pond along the 15" culvert pipe.
3) All graded areas need to be mulched to insure that the areas
remain stabilized until spring. The mulch will prevent
erosion by protecting the soil surface from raindrop impact,
reduce the velocity of overland water flow and foster the
growth of vegetation by increasing available moisture and
providing insulation against the cold.
Once these three (3) items are corrected, I will sign -off on your
Final Occupancy Permit. In the meantime, we will issue you a
Temporary Occupancy Permit which is good for thirty (30) days.
Please contact me within this time period for a final inspection.

System Improvements
Dear Mr. Higginbotham:
Review of our correspondence shows that my Department has not yet received
the final information required by the extension agreement for the City's
acceptance of the sewer and water system installed to serve Corrugated
Container Corporation.
The submittal required is the certification by your Engineer that the work
was constructed in substantial compliance with the approved plans and
specifications, one reproducible set of as-builts, a detailed statement of
the improvement quantities and value of cost and a copy of the recorded Deed
of Easement. The as -built plan shall be a reproducible copy of the approved
drawings with the as -built information in ink or red pencil. The statement
of cost should be the total of the installation with a listing of the lineal
footage of associated pipe sizes and type of material and the number of fire
hydrant assemblies. The Deed of Easement shall be submitted for review and
approval prior to your recording same.
Upon receipt of this information in complete form, the written notice of
acceptance will be executed. Please summit this information as soon as
possible so we may close out this project.

THIS AGREEMENT is made and entered into this 'L4 day of
�"["14NO 19-10, by and between the City of Winchester ("City"),and
_CORRUGATED_CONTAINER_CORPORATION .(the "Developer");
WHEREAS, the Developer owns certain land,more particularly
described in the plans N/A as approved and signed by the
Director of Planning and\or the City Engineer of the City of Winchester
on _MAY_2,_1990 and
WHEREAS, the Developer intends to construct on this land a
development to be known as _CORRUGATED_CONTAINER (the "Project")
and desires the City to provide to this Project:
(Check whichever is applicable)
A. Water Service -- projected average daily flow �do
gallons per day;
B. Wastewater Service -- projected average daily flow
0 gallons per day; and
WHEREAS, the City is willing to provide such services upon the
terms and conditions hereinafter set forth;
NOW, THEREFORE, in consideration of the premises and the mutual
covenants herein contained the Developer and the City hereby agree as
follows:
1. The Developer shall, at the sole cost and expense of the
Developer:
A. Construct or cause to be constructed such mains (both
water and sewer), sewer laterals, lift stations, force mains, fire
hydrants, water services and other facilities as portrayed on the
approved site and utility plans to enable the City to provide such
service to the Project. Sewer lateral and water services to serve each
lot or parcel within the Project shall be stubbed out past the right of
way or easement line and placed in accordance with the approved
utility plans.
B. Construct or cause to be constructed such other facilities
outside of the Property as are described in the approved site and
utility plans.
C. Shall pay all Project costs of any kind, including the cost
of any necessary relocation of existing utilities,and shall secure such
permits and easements as may be required.

2. The Developer shall pay to the City all prescribed connection
and availability fees as set by City ordinance, resolution, or other
regulation at the time of the execution of this agreement. All fees are
required to be paid in full prior to service being provided.
3. No utility construction shall be commenced until plans and
specifications have been submitted and approved in writing by the City
and other agencies or permitting authorities having jurisdiction and the
Developer has provided to the City, for approval, the name and
qualifications of the contractor proposed to undertake the utilities
installation on behalf of the Developer. The Developer shall be
responsible for all fees that may be required by any other agency or
authority.
4. Upon completion of the construction such facilities shall be
certified by the engineer for the Developer as complying to approved
plans and specifications and shall be subject to final inspection by the
City. Upon determination by the City that the facilities have been
constructed by the Developer in accordance with approved plans and
specifications and upon payment by the Developer of all applicable fees
and charges, the City shall accept the facilities and provide service to
the Project.
5. No individual service connection (water and/or sewer) shall be
connected or activated prior to the acceptance of such facility by the
City.
6. Before acceptance of the Project by the City, the facilities,
easements, warranties, engineering drawings, and other matters owned by
the Developer in connection therewith shall be delivered to and owned by
the City. The Developer shall execute such instruments of conveyance as
the City may require, and shall provide the City with:
A. One reproducible set of as -built drawings for the
utilities installed.
B. A detailed statement of improvement quantities and value
or cost.
C. All easement documents ready for recording and/or copy of
recorded plat. Developer shall be responsible for all cost of recording
any easements or plats.
7. The Developer hereby warrants the facilities to be free of
defects in materials, workmanship and design for one year after
acceptance thereof by the City. Any such defect appearing within one
year after acceptance shall be corrected by the Developer or, at the
option of the City, shall be corrected by the Department of Public
Utilities and the Developer shall reimburse the City for the cost of
such correction plus an administrative charge of 20% within 30 days
after receipt of a statement for same. Thereafter interest shall be
charged at 10 % per annum.
8. This agreement may not be amended except by a writing executed
by the Developer and the City.
9. Plans and specifications are valid for a period of one year
from the date of final approval of the site plan. If a site plan is not
utilized, date of approval of engineering plans by City Engineer shall
be the effective date. If construction is not in progress at the end of
this period, or if construction becomes inactive for a period of six
months, the City approval shall be void. Plans and specifications will
require resubmital to insure conformity with the most current standards
and specifications in effect.
10. All documents necessary for the implementation of this
Agreement, including all permits, engineering design and construction
contracts, plans and specifications for the facilities as and when
approved and filed with the City are a part of this Agreement and
incorporated herein by reference.

respective parties hereto, affixed upon duplicate copies hereof, on the
date first above mentioned.

I received the revised plans indicating the additional fire
hydrant. Since this would be privately owned and would not be
maintained by the City, I do not see a need for readdressing the
agreement because our agreement covers only the installation of the
8" water main to the property and the meter vault to be installed
within the easement. Outside of that, this would all be on the
property and would be up to the County to dictate the needs.

rapidly progressing construction pace of the development. Please remind the
developer materials used and methods of construction shall apply to current
observed VDOT Road and Bridge Specifications applicable during construction of
this development if the streets are to be eligible_ for acceptance Into the
State's System. In discussions with the contractor, Perry Engineering, there
appears to be some confusion over whether or not on site inspections are
necessary. Please be advised my office will need to inspect all Street "A"
and Street "B" sub -grade, base stone placement, asphalt placement and
placement of any culverts of 36" in diameter or greater.

and the extension of water and wastewater mains to provide service to
your development known as Corrugated Container Corporation.
The enclosed agreement should be signed and returned to this
office. After execution by the City, one original will be returned to
you for your file.
Please be advised that the plan submitted and approved by the City
on May 2, 1990, is a part of this agreement and no work may commence
until:

o the City has approved the contractor
o the contractor has provided qualifying license, a certificate
of insurance, and a performance and maintenance bond.

ARCHITECTS We have completed our review of the above
SCIEN"i ISTS referenced site plan and can recommend approval with
the following conditions:
1. The invert of the emergency spillway should be set
at approximately 745.4 so that the overflow can
begin after the pond capacity is reached.
2. The dam elevation must be set to provide a free-
board of one foot minimum above the 100 year water
surface elevation as if the entire storm were
discharging through the emergency spillway.
Calculations were not submitted for this, but I
estimate the following
Q = CLH 4 3/2
The head (H) behind the dam can be approximated
with the following being given or obtained
Q = 26.10 CFS
L = 18.00 FT
C = 2.60
then H = .68 Ft
Therefore, With the invert of the spillway being
745.4, the water surface would be 746.08 and the
top of the dam should be from 747.1 to 747.5.
With the above items incorporated on the plan we
can recommend approval.

5. Please provide the calculations for the culverts
on the project. Of particular importance is the SWM
discharge pipe.
6. It is not clear how this drainage discharge will
impact the Fairfax Lumber. site. It is important
that we demonstrate that the concentration flow off

has been enlarged somewhat by the channeling of
flow to the pond. This is OK and may be preferable,

EROSION AND SEDIMENTATION CONTZOL
1. A note on the plan indicates that E & S
protection measures need to be in place. However,
there is nothing that indicates what that is. For
example:
a) The construction en rance and size is not
shown.
b) Limits of clearing and earthwork have not
been indicated.
c) Perimeter protection such as silt fencing,
earth berms and sedimept traps have not been
included.
d) Inlet protection fort culverts are not
indicated.
e) Outlet protection has not been indicated
2. A drainage area map has not been incorporated in
the plan to establish the design parameters for
these protection devices.
