We have completed our review of the revised grading and drainage plan for a portion
of the Stephens Ridge subdivision and offer the following comments:
1. Provide a legible copy of the existing contours (pre -construction condition)
adjacent to the proposed construction. Include all areas impacted by the
proposed channel realignment and associated 100-year storm elevations.
2. Evaluate the impact of the proposed fill construction on the 100-year storm
elevations adjacent to and immediately upstream.
3. Complete the channel improvements between the outfall of C5 and the three
concrete culverts under Greenwich Drive.
4. Add a note to insure that the three culverts under Greenwich Drive are cleaned
to remove accumulated silt. It appears that the channel downstream of the three
culverts has not been graded properly and is causing the accumulation of silt in
the pipes. This condition could_ be a continual maintenance problem which
should not be delegated to the homeowners. We recommend that the channel
improvements be extended to Stephens Run which would require an easement
across property owned by the Town of Stephens City.

5. Provide grouted rip -rap at the outfall of all drainage pipes. It appears that the
actual field construction has not achieved a smooth transition to the main
channel.
6. Provide a legible plan delineating the drainage areas including the area
associated with the existing 24 inch RCP.

We have received your revised site plan dated 06/04/01 (received 06/18/01)
for the referenced project. It appears all of our earlier review comments
have been satisfactorily addressed. Please advise the owner of our
approval. Also please provide six (6) sets of approved construction plans
with signed seal for VDOT distribution.
The appropriate land use permit may now be applied for to cover work within
the Route 1065 right-of-way. The permit is issued by this office and will
require a minimum processing fee, surety bond coverage, and the salary &
expenses of a State assigned Inspector. A copy of any/all recorded plats of
dedication for drainage easements or additional right-of-way required for
implementation of this proposed project should be provided to VDOT prior to
issuance of any land use permits. Dedication should be made to the
Commonwealth of Virginia.
Once satisfactory application has been made, a permit will normally take
approximately thirty days to process and issue. Should you have any
questions, do not hesitate to call.

llth, 1994. I note for your purposes that Top of Virginia has

Stephens Ridge Townhouse Development.
I attach a copy of a letter which I have written to Mr.
Holliday encouraging Top of Virginia to complete the amenities
which is in the original Site Plan.

Re: Revocation of Class T Membership for Failure to Complete
Conditional Improvements by August 31, 1994.
Dear Mr. Holliday:
As you are aware, our firm represents Stephens Ridge
Homeowner's Association, and I am writing this letter on their
behalf. According to a By -Law Amendment Agreement dated May 25th,
1994 between M. Theresa Seitz, in her capacity as President of the
Stephens Ridge Homeowner's Association and David B. Holliday,
President of Top of Virginia Development. Top of Virginia was
granted a Class T membership in the Stephens Ridge Homeowner's
Association. This new classification allowed Top of Virginia to
pay $ 600.00 per quarter instead of the $ 1200.00 per quarter fee
which is required of Class A owners. This period of Class T
membership was to run for no less than six (6) months but not more
than one (1) year. Top of Virginia was granted this status, and
the following clause was a condition of the agreement, "Class T
membership will immediately terminate and revert to Class A
membership should any of the conditional improvements listed on
Attachment A, remain incomplete after August 31, 1994. The
following improvements remain incomplete according to the
Homeowner's Association on September 1, 1994.
1. Additional pine trees behind Units 1-12.
2. Provide additional rip -rap for RCP between Units 20 and 21.
3. Provide pine trees on NE side of Unit 12.
4. Install required 1/2 basketball court.
5. Provide pine tress on the berm located on the South side of
Greenwich Drive across from the tot lot.
6. Stabilize graded areas on both sides os Greenwich Drive
between Units 47 and 48.
7. Provide pine trees on NE side of Unit 91.

Mr. Holliday, as I communicated in my letter dated July 11th,
1994, if these conditions were not completed by August 31, 1994,
your membership status would revert by the terms of your agreement
to a Class A membership. This letter is to inform you of the
reversion of your Class T membership to Class A membership, and to
inform you that your fees for the period beginning September 1,
1994 will be at Class A membership rates. It is my understanding
from M. Theresa Seitz that you wish to renegotiate the amounts of
your dues in the near future. I would suggest to you that good
faith completion of the improvements required by Frederick County
in the Site Plan and agreed to by you in the By -Law Amendment
Agreement is a pre -requisite to any further negotiations along
these lines. Stephens Ridge has acted in good faith in this
matter, and extended the period of time for compliance on numerous
occasions. In the Homeowners Association's judgement, it is time
for you to complete these improvements, and then and only then will
they be wiling to negotiate concerning concessions on dues. I have
written a letter to the Department of Planning and Development,
keeping them abreast of your continued non-compliance with the Site
Plan.

Per our recent conversation, I have attached a copy of a plan
developed by Gilbert W. Clifford and Associates, Inc., for
improvements to the existing triple concrete culverts. This plan was
developed by Chuck Maddox to address our concerns related to the
stability of the upstream and downstream slopes.
Based on my recent site inspection, it appears that Jerry King
has not completed the stabilization as indicated on the improvement
plan. In fact, a portion of the stabilization rip -rap that was
placed adjacent to the upstream inlet has failed and blocked the
inlet of the eastern most pipe. The adjacent banks are continuing to
erode and currently represent a potential safety problem for adjacent
residents.
As a consequence of Jerry King's failure to comply with the
total scope of the improvements recommended by G. W. Clifford and
Associates, Inc., I recommend that safety barricades be installed
immediately to prevent a potential accident. Furthermore, the
obstructions should be immediately removed from the inlet end of the
pipes.
To avoid further degradation of the slopes, I recommend that the
banks be either regraded to achieve a stable slope or that wire
baskets/mattresses be installed to stabilize the rip -rap. This
action coupled with the installation of rip -rap in accordance with
the G. W. Clifford and Associates, Inc. plan shall be completed on or
before October 1, 1994. I suggest that a site meeting be scheduled
prior to the commencement of these remedial improvements to ensure
that all parties understand the intent and scope of the work to be
performed.

Based on our recent site inspection, we conclude that you have
addressed all of our site development concerns except the
stabilization of the upstream slopes adjacent to the triple
concrete culverts. This problem was highlighted in our letter
dated August 24, 1994.
I understand that intense storm flows in June 1995 caused a
failure of the loose rip -rap that had been placed on the upstream
slopes. I further understand that you propose to install a grouted
rip -rap to insure long-term stability. The grouted rip -rap should,
not only, be placed on the slopes above and adjacent to the pipes,
but also, in front of the pipes to serve as an entrance apron.
Please let us know when this work will be accomplished so that
we can schedule a final inspection.

Re: Agreement to Continue Class T Membership in Exchange for
Certain Repairs.
Dear Mr. Holliday,
As you are aware, our firm represents Stephens Ridge
Homeowner's Association, and I am writing this letter on their
behalf. As you remember, according to a By -Law Amendment Agreement
dated September 30, 1994 between M. Theresa Seitz, in her capacity
as President of the Stephens Ridge Homeowners Association, and
David B. Holliday, President of Top of Virginia Development,
Stephens Ridge, agreed to accept $ 744.00 per quarter instead of
the $ 1,200.00 per quarter which a Class A membership requires you
to pay for the lots which you own in the development. This
agreement ends on September 30, 1995, and you revert back to Class
A membership status requiring the $ 1,200.00 fees. The Association
is willing to offer to continue your reduced fees for another 1
year period beginning October 1, 1995, if you complete the
following necessary repairs in the Development by September 30th,
1995:
1. Because of the erosion created when you completed the
basketball court, the adjacent landowners are concerned about
diminution of the lateral support of their side yard adjacent to
the court. We propose that you build a retaining wall along this
boundary and back fill and landscape this area to prevent further
erosion. Because of a concern about child safety, the Homeowner's
Association also wants a 4 foot fence built along this retaining
wall. Specifications and arrangements for this repair should be
handled through Theresa Seitz.
2. Because of the erosion problems impacting upon the roadway
entering Section 2 of Stephens Ridge, the Homeowner's Association
would require that wire baskets (Gabions) filled with rocks and
covered with wrap be placed along the slopes adjacent to the
upstream end of the creek bed near the roadway. Specifications and
arrangements to be made with Theresa Seitz.
If these repairs are not made by this date, in order to make
these repairs, the Homeowner's Association will need the additional

monies that a Class A membership provides, as well as a probable
special assessment as provided in the covenants which you prepared
for this subdivision.
This proposal creates a win —win situation for both you and the
Homeowner's Association, however, these required repairs need to be
completed before September 30th to comply with this proposal.
Please contact Ms. Seitz in order to facilitate completion of
the repairs, or be prepared to relinquish your Class T membership
on October 1, 1995.

On our March 20, 1995 site visit the following deficiencies were observed.
The playground equipment at the Tot Lot between units #1 and #2 needs to be
corrected. The protective areas for the equipment still overlap or protrude into
adjoining structures. This equipment needs to be re -installed so that protective
areas for the equipment can be established as called for by the manufacturer. It
also appears that there is a lack of sufficient space to correctly install the
equipment in this area unless the drainage to the west of the 4 seat swing is
filled and leveled.
In addition to the deficiencies at the Tot Lot, the picnic shelter has been
constructed to a dimension of 10' x 20'. The developer had agreed to construct
the shelter to a 16' x 20' dimension.
