Clifford and Associates. Basically, this plan was revised to reflect the addition of two (2) retaining wall sections adjacent to condos 7 and 8. This plan also indicated the required grading revisions. In addition to the revised site plan, we reviewed the wall sections designed by Ruckman Engineering. Based on this review and the revised grading, we recommend that the six foot wall section be adopted for the entire project to avoid confusion. The purpose of that inspection was to determine all remaining site improvements required by Frederick County. The outstanding items regard the need to complete the recreational facilities as specified by Mr. Hott, the installation of rolled asphalt at the turnaround area by unit #10, and the stabilization of all graded areas. It is my understanding that the rolled asphalt was removed to allow for drainage. This needs to be reinstalled unless the County Engineer determines that the removal of the rolled asphalt is appropriate for positive drainage. It is my understanding that you need a final Certificate of Occupancy Permit for unit #10 to allow tenants to secure FHA financing. Frederick County is willing to provide you with this permit provided that all required site work is completed within thirty days for the date of this letter. Frederick County will utilize the bond to complete any outstanding work after that time. Please provide written correspondence to my attention that states you understand the requirements specified in this letter. The purpose of this meeting was to address required site improvements based on previous site inspections by this office. The following items were discussed during our meeting: �p 1) The parking area in front of Unit #1 needs to be paved and striped. You have asked for an opportunity to talk with the homeowners across the street to see if they would be interested in paving their area as well. Our department will allow you adequate time to work out these details. If the homeowners across the street do not wish to participate, you will be required to pave the parking area from the road to the curb and gutter in front of Unit #1, and stripe all parking spaces. This mprovement._..must_..be complete by the middle of November. 2) Street signs need to be installed throughout the entire project area. Mr. H.E. Strawsnyder, County Engineer, suggested that you obtain street sign specifications from the aL Virginia Department of Transportation (VDOT). I spoke with ! VDOT personnel in Edinburg this afternoon. It was suggested that you contact Mr. William H. Bushman, Resident Engineer, to obtain these specifications. Mr. Bushman can be contacted at (703) 984-4133. 3) The drainage area around the RCP between Unit #3 and Unit #4 is not functioning properly. This is due to erosion of the banks into the drainage channel. The entire drainage facility needs to be cleaned out from the RCP to the perimeter of the site, and rip -rap needs to be installed on both sides of the bank to prevent further erosion. 4) The sod behind Unit #6 has died. All dead sod needs to be removed from this area and replaced. Any stabilization or landscaping on site needs to be maintained in a healthy fashion before it is dedicated to the property owners association. 9 North Loudoun Street P.O. The purpose of this inspection was to determine all remaining site improvement work required for this development. My last inspection of this site was June 23, 1993. Following that inspection, I provided you with a letter which specified the required site improvements for apartment units 1-6. The majority of these improvements have not been completed to date. Frederick County issued building permits for each unit per your request. Frederick County also provided you with temporary and final Certificate of Occupancy permits for apartment units 1-6. Frederick County_ has issued occupancy permits with the understanding that outstanding site improvement issues would be resolved; however, this has not occurred. Therefore, our department will require all outstanding site improvements to be bonded prior to the issuance of additional occupancy permits. In order to provide bonding for the remaining site improvements, you must provide Mr. W. Wayne Miller, Zoning Administrator, with a contractor's estimate that specifies the cost of all improvements. Mr. Miller will verify these figures and provide you with a copy of the Frederick County Letter of Credit form. It is then your responsibility to provide Mr. Miller with an acceptable Letter of Credit which complies with the requirements of Frederick County. The following site improvements need to be bonded under a Letter of Credit for the Lakeside Condominium development: 1) The parking lot and parking spaces in front of Unit #1 need to be paved and all parking spaces need to be striped. The approved site plan calls for 2 inches of S-5 bituminous concrete to be applied in an area that is 32.5 feet wide by 230 feet in length. This area also requires 16 regular parking spaces that need to be striped once the S-5 bituminous concrete has been applied. 9 North Loudoun Street P.O. Currently, two signs have been installed that designate Timberlake Terrace. A sign needs to be installed on each of these that designates Chinkapin Drive. Also, another sign needs to be placed at the entrance to Unit #1 that designates these roads. I do not believe the signs that have been installed meet design specifications. Please contact Mr. H.E. Strawsnyder, County Engineer, to obtain these specifications. Also, signage has not been installed to designate the eight disabled parking spaces. 3) None of the required recreational amenities have been completed to date. These include two tot lots, a 1/2 basketball court, and a nature trail with four park benches and two picnic tables. The tot lots do not meet equipment specifications or safety installation requirements. The 1/2 basketball court does not have concrete wheel stops that are permanently fastened across the parking lot area, the nature trail is not finished and the park benches and picnic tables have not been installed. Mr. Matthew Hott, Superintendent of Parks, will need to verify that these facilities have been installed correctly. 4) The approved site plan calls for parking lot landscaping to be complete in accordance with sections 3-3-2.11, 3-3-2.11.1 and 3-3-2.11.2 of the Frederick County Zoning Ordinance. This requires a minimum of one shade tree for every forty feet of perimeter parking lot area and one shade tree for each raised island. These shade trees need to be at least four feet in height at time of planting. There is 2,485 linear feet around the perimeter of the parking lot and 14 raised islands. Therefore, there are 77 shade trees that have not be planted. Also, two of the pine trees that are being used for the road efficiency buffer have died and need to be replaced. 5) The turn around area in the parking lot area between Unit #8 and Unit #10 has not been installed. Also, the sidewalk in front of Unit #10 has cracked and broken away in this area as well. 6) All areas that have been graded need to be stabilized. This includes an area between Unit #5 and Unit #6, the areas along the nature trail, and all areas around Units #7410. These areas require erosion and sedimentation controls as well. This includes silt fencing, rip -rap, and straw bales. These measures should have been installed and maintained when these areas were disturbed; therefore, I am recommending that these be bonded as well. This improvement must be complete by the middle of November. 2) Street signs need to be installed throughout the entire project area. Mr. H.E. Strawsnyder, County Engineer, suggested that you obtain street sign specifications from the Virginia Department of Transportation (VDOT). I spoke with c, VDOT personnel in Edinburg this afternoon. It was suggested that you contact Mr. William H. Bushman, Resident Engineer, to obtain these specifications. This is due to erosion of the banks into the drainage channel. All dead sod needs to be removed from this area and replaced. Residents have unhappily discovered a number of areas in which the developer has not lived up to his obligations to us, but I am writing about one situation, in particular, which perhaps violates both the spirit and letter of the law, and which presents a safety hazard in its present state. In November, I purchased a condominium at Lakeside Condominiums, Building 5, Unit 3. The building and grounds were unfinished. On the plans we were shown at that time, we noted a "Tot Lot" to be constructed in an area roughly centered on Buildings 5, 6, and 7 (still under construction), specifically off the northwest corner of the unit I was considering buying. We asked to see exactly where the "Tot Lot" was to be located and were shown, in a tour of the unit by Silva Satian, an area off that corner and slightly downhill from the building. I was told that, if I bought the unit, I would be able to see the "Tot Lot" out of my master bedroon window. When we asked what equipment would be installed, we were directed to the "Tot Lot" in a completed section of the project. It consisted of a large wooden swing set with a platform at one end. About two weeks ago, several pieces of playground equipment, all except the swing set, metal and multi -colored, were installed directly off my living room patio door/windows. I was out of town, and neighbors tried in vain to tell the builders that it was being put in the wrong place. My daughter has called Mr. Sarkis Satian to discuss this with him, but he has failed to date to call. My concern is two -fold: The playground equipment is installed directly outside my home, not in a central common area, and out of line with the plans which we were shown and had personally delineated by an agent of the developer. Every good faith effort was made by me and my family to be certain that the "Tot Lot" would not be placed intrusively. As a retired citizen on a fixed income, I did not buy hastily or without careful consideration of what appeared to be a quality development; The poorly graded area on which the playground equipment is installed is inappropriate for a playground. The equipment, including a metal geodesic climber, a merry-go-round, and a large sliding board, are constructed on a slant, creating a hazard for any small children playing there. The only appropriately terraced portion of that cannon area is below the swingset, itself perched precariously above the terrace. My five -year -old grandson visits frequently from Middletown, and I do not feel it is safe for him or any other young child to play on the equipment. As a county resident, I have placed my confidence in the effectiveness of regulations and regulators intended to make Frederick County a desirable place to live. We have been actively working on the stormwater management study for the County and it has been brought to our attention that drainage problems exist in the Lakeside area. Therefore, it is critical for the County and the Design Engineer to be sensitive to drainage and stormwater management issues. This plan submission is just one of many phases within a fairly dense development. Stormwater management was originally proposed to be built with the second phase of the Lakeside Apartments Plan. I still feel that it is warranted, even if the immediate receiving swales can carry the added runoff. 2. The calculations comparing the Pre and Post development runoff rates do not demonstrate the runoff increase that this project will have on the receiving streams. The indicated post developed runoff coefficients appear to be low. In addition to this, I can be sold on a pre -development time of concentration (Tc) of 15 minutes but a post developed for the areas shown for this project would be a maximum of 5 minutes. Therefore, a 2- year rainfall intensity of 5.7 for the post developed condition would be much more realistic. 3. The resulting flow rates will be within the capacities of the immediate receiving channels, however, the flow rates will be more than doubled. These, in accumulation with the other portions of this total Development, will have an impact on downstream properties. Date: 2/23/90 Project Description ion - This project involved is being developed by S.E.I. of McLean, VA. The type of construction is 10, 12 unit apartment buildings. The project will also involve installation of sanitary and storm sewer, water and utilities. The total developed area is 8.72 acres. Existing Site Conditions - Prior to construction, the site was characterized by rolling terrain, lightly wooded with some undergrowth, all typical of undeveloped areas in the upper Shenandoah Valley. The site is in the Wiekert-Berks-Blairton Soil Association. This area is characterized by gently sloping, shallow to moderately deep, poorly drained soils that have a medium to fine textured subsoil; formed in material weathered from shale. Adjacent Areas - Most of the areas surrounding the development are residential in nature. The remainder is vacant or of agricultural use. This site is a part of the Lakeside development and is designed in accordance with an approved master development plan. it - For purposes of design runoff conditions, antecedent moisture condition II (normal consideration for the mid -Atlantic region) is assumed. The soil is considered to have a moderate rate of water transmission, therefore, SCS Soil Class "B" is adopted. Soils are for the most part of the Clearbrook (913) Series. There are small portions of Weikert (41 E) also. Due to large amount of construction in and around the area the soils are most predominantly Clearbrook. A copy of the respective soil map is enclosed. Permanent Stabilization - Seeding for permanent stabilization is specified in the V.E.S.C. Handbook. Any area denuded in which work is not proceeding for a period of 30 days or more will be stabilized by a temporary seeding in accordance with State guidelines and procedures. All areas to be seeded will receive seed application by hydroseed methods immediately upon obtaining grades. Storm Water Management Consideration - A copy of the site plan has been attached. Drainage from about one-half of the site is carried by storm sewer to the back of the site and Opequon Creek. Drainage from the remainder of the site will either sheet flow off or be carried away by roadside ditches. Almost all of the street and parking area drainage is carried to VDOT approved conveyance channels. A post development C factor ranging from .65 to .9 was used for the post development storm calculations. Maintenance - AII soil erosion control structures shall be checked weekly by the contractor during this construction period and after construction is completed until grass cover is established. Sediment retained by these structures shall be continuously removed and placed in an area of the site specified, damage to soil erosion control structures shall immediately be repaired when identified by the contractor. The contractor shall cooperate with all agents of the County, the Engineer and others who may identify needed facilities or work in order to protect the environment within the subject of this report.
