Dear Steve:
Frederick County approved the referenced development plan on October 3, 1990 to permit the
construction of a storage facility that was to be used in conjunction with the Fertig Cabinet
Company operation. It was determined that the storage facility could be constructed within the
B-2, Business General, District as an accessory use to the Fertig Cabinet Company operation.
The sale or lease of this storage facility to be utilized for a warehousing and distribution operation
would require a change in zoning to B-3, Industrial Transition, District or M-1, Light Industrial,
District. This change in zoning can only be granted by the Frederick County Board of Supervisors
following the requirements of the rezoning application process.

RE: Site Inspection of New Warehouse Facility.
Dear Mr. Fries:
This letter regards my inspection of the Fertig Cabinet site on
September 6, 1991. Listed below are the items that need to be
addressed prior to the issuance of a final certificate of occupancy
permit:
1) The maneuvering area that serves the warehouse needs to be
built up at a minimum. This area is already experiencing
problems with ruts and standing water. I would recommend that
this area be provided with a prime and seal surface to avoid
maintenance costs in the future.
2) The disturbed area along the northeast property line needs to
be stabilized.
3) I received notice from the Fire Marshal that they can use the
parking area on the Eagles Club site as a means for their
third access. Therefore, the proposed fire lane indicated on
the site plan is not required.
As we discussed, I will sign off on a temporary occupancy permit to
allow Fertig use of the new warehouse. Once your company has
completed items one (1) and two (2), you need to contact me for a
final site inspection. Please contact me if you have any questions
regarding this letter.

Project Description -
This project involved is being developed by The Fertig Cabinet Company, Inc. The
type of construction is a warehouse facility. The project will also involve extension of
sewer, water and utilities to the warehouse site. The total developed area is approximately
one acre.
Existing Site Conditions -
Prior to construction, the site was characterized by shale fill, with very light
vegitation. The site is in the Frederick-Poplimento-Oaklet Soil Association. Though this
area is generally characterized by gently sloping, very deep, well drained soils that have a
fine textured subsoil; formed in material weathered from limestone, the site was previously
used to extinct clay material, and has been filled with material weathered from shale. The
soils are actually poorly draining and shallow.
Adjacent Areas -
Most of the areas surrounding the development are industrial in nature. The
remainder is of vacant use. The entire area to the north of the site has been used for clay
extraction and are similar to the Fertig property.
Soils -
For purposes of design runoff conditions, antecedent moisture condition II
(normal consideration for the mid -Atlantic region) is assumed. The soil is considered to
have a moderate rate of water transmission, therefore, SCS Soil Class "B" is adopted. Soils
are difficult to classify due to the nature of the fill. A copy of the respective soil may is
enclosed. The area is designated series as Pits (36), for which no data is given.

Drainage from the site sheet flows to the east. The site is part of a 400 ± Ac
drainage area which flow through culverts under Interstate 81. The conveyance channels to
81 are shale lined and capable of higher velocities. As this site is less than one percent of
the drainage area, the effect of this development is minimal. Additionally, the existing site
conditions have a high runoff coefficient. Though the runoff from the site is increased, that
increase is negligible.
Maintenance -
AII soil erosion control structures shall be checked weekly by the contractor
during his construction period and after construction is completed until grass cover is
established. Sediment retained by these structures shall be continuously removed and placed
in an area of the site specified, damage to soil erosion control structures shall immediately
be repaired when identified by the contractor. The contractor shall cooperate with all agents
of the County, the Engineer and others who may identify needed facilities or work in order to
protect the environment within the subject of this report.

This soil is in capability subclass Ills.
36—Pits, quarries, and dumps. This map unit
consists of open excavations from which limestone,
shale, and sand have been mined and of piles of spoil
from quarries. Pits, quarries, make up about 70 percent
of this map unit, and Dumps make up 30 percent. The
soil material has been removed during excavation or
covered with waste material. Areas of this map unit are
mainly devoid of vegetation, and in some pits, pools of
water are common.
Limestone quarries are in the eastern part of the
county. They range mainly from 5 to 100 acres. Most of
the limestone is used in road construction. Some is used
as agricultural lime or in making cement.
The shale quarries are scattered throughout the
county. They are as much as 10 acres.
One of the larger sand pits is near Virginia Route 704
in Gore. Smaller sand pits are in the area of Star
Tannery. The pits range mainly from 1 acre to 50 acres.
They are a source of sand for use in building and in
making glass and other commercial products.
Areas of pits, quarries, and dumps are poorly suited to
cultivated crops, hay and pasture, and to use as
woodland and as habitat for wildlife. Very little soil
material, depth to bedrock, and droughtiness are the
main limitations.
Areas of this map unit are fairly suited to poorly suited
to urban and recreation use. Onsite investigation is
needed to determine the suitability of each site for a
specific use. Some of the larger pits that contain water
can be used for fish ponds.
This map unit has not been assigned to a capability
subclass.
37D—Schaffenaker very stony loamy sand, 7 to 25
percent slopes. This soil is moderately deep, strongly
sloping and moderately steep, and well drained. It is on
ridgetops, side slopes, and foot slopes. Areas of this soil
commonly are narrow to broad, long and winding, and
irregularly shaped. They are about 800 to 5,500 feet
long. They range from 5 to more than 50 acres.
Sandstone fragments more than 10 inches in diameter
cover 3 to 15 percent of the surface.
Typically, the surface layer is covered by a layer of
leaves, twigs, and pine needles and black organic matter
about 4 inches thick. The surface layer is dark grayish
brown loamy sand about 2 inches thick. The subsoil, to a
depth of 23 inches, is brown, yellowish bron, and
strong brown loamy sand. The substratum, two a depth of
about 32 inches, is strong brown very gravelly loamy
sand. Sandstone bedrock is at a depth of about 32
inches.
Included with this soil in mapping are small
intermingled areas of Dekalb soils. Also included are a
few areas of soils where stones cover less than 3

percent of the surface. The included soils make up 10
percent of this map unit.
Permeability in this Schaffenaker soil is rapid, and the
available water capacity is very low. Surface runoff is
slow. The erosion hazard is slight. The surface layer is
loose or very friable, but tillage is impractical because of
stones on the surface. The shrink -swell potential is low.
The root zone extends to a depth of about 32 inches,
but is somewhat restricted by sandstone fragments.
Natural fertility and organic matter content are very low.
The soil is extremely acid or very strongly acid
throughout.
Nearly all areas of this soil are used as woodland.
This soil is not suited to cultivated crops, hay, or
pasture. Tillage is impractical because of the very stony
surface. The soil is droughty.
Potential productivity for trees on this soil is moderate.
Slope and stones on the surface are moderate
limitations to use of logging equipment. The rate of
seedling mortality is moderate. Plant competition for
conifers is moderate.
The rapid permeability and slope are the main
limitations to use of this soil for community development.
If the soil is used as a site for septic tank absorption
fields, in places the effluent can seep to the surface
downslope. Ground water contamination is a hazard
because in some places the soil does not adequately
filter the effluent.
This soil is in capability subclass Vlls.
37E—Schaffenaker very stony loamy sand, 25 to
65 percent slopes. This soil is moderately deep, steep
and very steep, and well drained. It is on ridgetops and
side slopes. Areas of this soil commonly are narrow to
broad, long and winding, and irregularly shaped. They
are about 800 to 11,500 feet long. They range from 5 to
more than 300 acres. Sandstone boulders and stones
cover 3 to 15 percent of the surface.
Typically, the surface layer is dark grayish brown
loamy sand about 2 inches thick. The subsoil, to a depth
of about 23 inches, is brown, yellowish brown, and
strong brown loamy sand. The substratum, to a depth of
about 32 inches, is strong brown or very gravelly loamy
sand. Bedrock is at a depth of about 32 inches.
Included with this soil in mapping are small areas of
Dekalb soils. Also included are a few areas of soils
where stones cover less than 3 percent of the surface.
The included soils make up about 10 percent of this map
unit.
Permeability in this Schaffenaker soil is rapid, and the
available water capacity is very low. Surface runoff is
medium. The erosion hazard is moderate. The surface
layer is loose or very friable, but tillage is impractical
because of stones on the surface. The shrink -swell
potential is low. The root zone extends to a depth of
about 32 inches, but is somewhat restricted by

grading and construction and to provide for conformity with
the Virginia Erosion and Sediment Control Law, Title 21,
Chapter 1, Article 6.1 of the Code of Virginia and local code
laws.

Dear Doug:
I have finished my review for the Fertig Cabinet Company. I met
with Mr. Fertig on Monday, and issued him a land disturbance permit
for this project. The comments I have made need to be addressed
prior to the approval of this site plan.
1) The proposed metal warehouse indicates customer pickup. With
this in mind, loading spaces need to be included on the site
plan.
2) The plan shows a sewer connection to the proposed metal
warehouse. If the sewer line is for toilets, BOCA requires
a sink and water drinking fountain. If this is the case, you
need to extend the water line to this structure.
3) I have concerns with the parking on the north side of the
parking lot. The plan shows existing parking, as well as
proposed parking to be located on grass. Also, the parking
appears to be located on the 20' water line easement.
4) The existing handicapped space is not 12' in width. Is the
elevation of the parking lot the same as the building? If
not, a handicapped ramp needs to be provided.
Once these comments have been addressed, I feel that our department
may administratively approve this site plan. If you have any
concerns or questions regarding this letter, please do not hesitate
to contact me.

Dear Evan:
Following are the Utility Department comments with regards to
the subject planned development:
1. A Utility Service Agreement will need to be
executed for the extension of the water main.
2. All valves to be used shall be resilient seat.
3. It will be critical that the loll water main
remain in service at all times during
construction and upgrade of existing water
mains. Some consideration should be given as
to how this will be achieved.
4. Plans of utilities along with profiles of
water mains shall be submitted to the City
Engineer for approval.
For your information and for the developer's I have attached
a copy of our general Utility Service Agreement. In order for this
to be executed, the Utility Committee of the City of Winchester
will need to approve this undertaking. This could be accomplished
in the July meeting.

Utility Service Agreement
Water and/or Wastewater Service

THIS AGREEMENT is made and entered into this day of
19 , by and between the City of Winchester ("City"),and
.(the "Developer");
WHEREAS, the Developer owns certain land,more particularly
described in the plans as approved and signed by the
Director of Planning and\or the City Engineer of the City of
Winchester on and
WHEREAS, the Developer intends to construct on this land a
development to be known as
(the "Project") and desires
the City to provide to this Project:
(Check whichever is applicable)
A. Water Service -- projected average daily flow
gallons per day;
B. Wastewater Service -- projected average daily flow
gallons per day; and
WHEREAS, the City is willing to provide such services upon the
terms and conditions hereinafter set forth;
NOW, THEREFORE, in consideration of the premises and the mutual
covenants herein contained the Developer and the City hereby agree as
follows:
1. The Developer shall, at the sole cost and expense of the
Developer:
A. Construct or cause to be constructed such mains (both
water and sewer), sewer laterals, lift stations, force mains, fire
hydrants, water services and other facilities as portrayed on the
approved site and utility plans to enable the City to provide such
service to the Project. Sewer lateral and water services to serve each
lot or parcel within the Project shall be stubbed out past the right of
way or easement line and placed in accordance with the approved
utility plans.
B. Construct or cause to be constructed such other facilities
outside of the Property as are described in the approved site and
utility plans.
C. Shall pay all Project costs of any kind, including the cost
of any necessary relocation of existing utilities,and shall secure such
permits and easements as may be required.
2. The Developer shall pay to the City all prescribed connection
and availability fees as set by City ordinance, resolution, or other
regulation at the time of the execution of this agreement. All fees are
required to be paid in full prior to service being provided.
3. No utility construction shall be commenced until plans and
specifications have been submitted and approved in writing by the City
and other agencies or permitting authorities having jurisdiction and the
Developer has provided to the City, for approval, the name and
qualifications of the contractor proposed to undertake the utilities
installation on behalf of the Developer. The Developer shall be
responsible for all fees that may be required by any other agency or
authority.
4. Upon completion of the construction such facilities shall be
certified by the engineer for the Developer as complying to approved
plans and specifications and shall be subject to final inspection by the
City. Upon determination by the City that the facilities have been
constructed by the Developer in accordance with approved plans and
specifications and upon payment by the Developer of all applicable fees
and charges, the City shall accept the facilities and provide service to
the Project.
5. No individual service connection (water and/or sewer) shall be
connected or activated prior to the acceptance of such facility by the
City.
6. Before acceptance of the Project by the City, the facilities,
easements, warranties, engineering drawings, and other matters owned by
the Developer in connection therewith shall be delivered to and owned by
the City. The Developer shall execute such instruments of conveyance as
the City may require, and shall provide the City with:
A. One reproducible set of as -built drawings for the
utilities installed.
B. A detailed statement of improvement quantities and value
or cost.
C. All easement documents ready for recording and/or copy of
recorded plat. Developer shall be responsible for all cost of recording
any easements or plats.
7. The Developer hereby warrants the facilities to be free of
defects in materials, workmanship and design for one year after
acceptance thereof by the City. Any such defect appearing within one
year after acceptance shall be corrected by the Developer or, at the
option of the City, shall be corrected by the Department of Public
Utilities and the Developer shall reimburse the City for the cost of
such correction plus an administrative charge of 20% within 30 days
after receipt of a statement for same. Thereafter interest shall be
charged at 10 % per annum.
8. This agreement may not be amended except by a writing executed
by the Developer and the City.

9. Plans and specifications are valid for a period of one year
from the date of final approval of the site plan. If a site plan is not
utilized, date of approval of engineering plans by City Engineer shall
be the effective date. If construction is not in progress at the end of
this period, or if construction becomes inactive for a period of six
months, the City approval shall be void. Plans and specifications will
require resubmital to insure conformity with the most current standards
and specifications in effect.
10. All documents necessary for the implementation of this
Agreement, including all permits, engineering design and construction
contracts, plans and specifications for the facilities as and when
approved and filed with the City are a part of this Agreement and
incorporated herein by reference.
IN WITNESS WHEREOF, the following duly authorized signatures of the
respective parties hereto, affixed upon duplicate copies hereof, on the
date first above mentioned.

County airport Zoning District (AP-1) and the following Codes of
Virginia:
Title 15.1 Code of Virginia, Section 489 (Purpose of. Zoning

Engineers, architects, contractors and developers must be aware
that as Winchester Regional Airport Expands services and
operations, noise associated with such expansion may increase.
Although zoning may soon be suggested to Consideration should
be given to insulating new and existing structures located within
orie half (1/2) mile of the end of the airport runway and 1,000
feet either side of an imaginary extended center line of they
airport runway.

New Construction

holes -and all joints should be well sealed.
Existing Construction
For rehabilitation of existing buildings, soundproofing
modifications include: replacement of existing windows with
windows of greater -sound transmission coefficient (STC) rating,
or adding a second layer of glass; upgrading doors and seals;
acousti6 baffling of vents; adding insulation to walls and attic
spaces,•, adding another layer of wall material to existing walls,
in effect creating a two -parcel wall; eliminating windows and
filling the space to match exterior walls.

We Have reviewed the above referenced site plan as
submitted and offer the following comments:
ACCESS ISSUES
1. Please provide projected additional and total
traffic counts (VPD) at the entrance to Route 1200.
2. Doorways and buildings should be indicated on the
plans with spot elevations.
3. It is not clear on the plans how access or parking
will be accomplished between the existing and
proposed building. Parking provisions will need to
be indicated on the plan. It does not appear that
there is adequate clearance for the travelway
between the buildings.
4. Since this is an existing site, it is assumed that
adequate horizontal and vertical sight distance
exists.
DRAINAGE
1. Storm water management and suitable off -site
drainage relief requirements will need to be
addressed.
2. It is not c1par how drainage is to work between the
buildings.
