RE: Georgetown Court Townhouse Project.
Dear Dr. McAllister:
This letter is in response to your correspondence of October 12,
1991. Your correspondence stated that Mr. Donnie Bowers of Perry
Engineering would begin paving the parking area of Georgetown Court
on October 16, 1991. You went on to state that the approved Master
Development Plan for Georgetown Court does not indicate a berm
between the Georgetown Court property and the Athey property, and
that Mr. Scot Marsh of G.W. Clifford and Associates was in error
for stating so.
The Frederick County Planning Department has copies of the Master
.Development Plan for Georgetown Court which received approval on
March 15, 1990. The approved Master Development Plan provides for
proposed earth berms along the entire Athey property. The earth
berms are indicated in the plan legend, shown by location and by a
typical earth berm buffer detail. The Site Development Plan was
administratively approved by this department on July 9, 1990, and
also provides for berms with full landscaped screening as provided
for in section 3-12-2.2 of the Frederick County Zoning Ordinance.
The earth berm buffer with full landscaped screening is a
requirement and has to be completed to bring this project into
compliance with the approved plans. This berm must be installed no
later than the middle of November to insure that the full
landscaping is planted prior to winter.
The County continues to receive complaints from Georgetown Court
residents resulting from the lack of screening on this project. Our
department would be glad to discuss any plan requirements with you
or your representatives no later than October 31, 1991. If by
October 31, 1991, you or your representatives have not provided
this department with satisfactory evidence showing that the
installation of the required amenities will be completed in
November 1991, Frederick County will "call" your letter of credit.

RE: Georgetown Court Townhouse Development Improvements
Dear Dr. McAllister:
This letter regards the need for installation of required
improvements to the above referenced development. These
improvements are indicated on the Georgetown Court site plan which
was approved by the Frederick County Planning Department on July 9,
1990.
our latest inspection indicates that the 1 1/2" layer of bituminous
concrete (S-5) and the full landscaped screen buffer between the
Georgetown Court property and Athey Trucking Company have not been
started to date.
Mr. Wayne Miller, Zoning Administrator, was told by Mr. Jim
Longerbeam that the layer of bituminous concrete was to be applied
in August. This was in response to a dust problem associated with
the entrance street. This problem still exists today and many
complaints about the dust have been received. I was told by Mr.
Scot Marsh of G.W. Clifford and Associates that you planned on
contracting Perry Engineering to complete the necessary six (6)
foot high berm along the Athey property so the landscaping could
begin in the fall. This is another source of complaints from the
residents in your subdivision. our department has received many
calls asking when the screening will be installed to minimize the
visual impacts from Athey Trucking.
The County is concerned about the completion of all required
improvements; however, the application of the bituminous concrete
and the installation of the berm with all landscaped screening are
our primary_ �oncerns at this time. The asphalt plant generally
closes in mi November, and the planting of trees is difficult in
the winter. The County needs to know how you propose to resolve
these issues as soon as possible. If the required amenities are
not installed in a reasonable time, the County may consider using
the available bond to do the required work.

RE: October 25, 1991 Meeting On Georgetowne Court.
Dear Dr. McAllister:
This letter regards the meeting held in our office on October 25,
1991. The purpose of that meeting was to discuss the buffer and
screening requirements for the Georgetowne Court townhouse project.
The approved site plan for this project requires a full screen. A
full screen consists of a totally landscaped easement at least 10
feet in depth, with a density of three plants per 10 linear feet,
of which 2/3 of the trees are evergreen and 1/3 are deciduous, as
well as a six-foot high, opaque hedge, fence, wall, mound or berm.
The approved site plan calls for a six-foot high berm; however, the
county will allow any of the amenities listed above provided that
they conform with section 3-12-2.2 of the Frederick County Zoning
Ordinance.
During our meeting, you `"suggested that a thick hedge row within a
totally landscaped easement be installed prior to winter. That is
an acceptable alternative from the six-foot high berm shown on the
approved site plan. At a minimum, this full screen must extend
along the Athey property from townhouse lots 1-32. A similar full
screen needs to be installed between townhouse lots 52-72 along the
Jefferson Village property. You also suggested that the tot lot
and volleyball court between lots 72 and 73 be relocated to the
large common area in the middle of this project. I would support
this idea, as it makes the recreational units readily accessible to
all residents in this development. I will discuss your idea with
Mr. Jim Doran, Director of Parks and Recreation, to obtain his
approval.
Mr. Jim Longerbeam asked specific questions about the Athey
rezoning during our meeting. In particular, Mr. Longerbeam asked
about screening requirements for the Athey property. This property
was rezoned prior to 1989. Frederick County did not have
conditional zoning (proffers) prior to 1989; therefore, it is
unlikely that the county required Mr. Athey to provide screening.
I have not come across any requirements based on the Athey rezoning
to date; however, I will continue to research this rezoning and

convey my findings to you. If Mr. Athey plans to develop this lot
in the future, the county will require him to provide the screening
necessary to meet the intent of the Zoning Ordinance.

calls from the Georgetowne Court Homeowners Association will
subside once the full screen is installed.

RE: Landscaping Plan For Georgetowne Court
Dear Dr. McAllister:
I had the opportunity to discuss landscaping requirements with Mr.
John McAllister of Reading Landscapes Inc. on October 30, 1991.
Mr. McAllister provided our department with a sketch plan that
included the layout and type of vegetation that he proposed for the
Georgetowne Court townhouse project.
The landscaping included evergreens placed throughout a variety of
hedge rows that are designed to reach an average height of eight to
ten feet at maturity. Mr. McAllister proposed that five to six
foot tall evergreens be planted in order to compensate for the
hedge rows that will only be two to three feet tall at the time of
planting. Mr. McAllister stated that the hedge rows would reach
the desired six foot height after a couple of growing seasons.
The landscaping sketch plan proposed by Mr. McAllister will meet
the intent of the Zoning Ordinance once all species reach maturity.
I believe that the compromise to plant larger evergreens to
compensate for the smaller hedge rows is appropriate provided that
all landscaping is maintained. A maintenance agreement should be
resolved to insure that all species survive in the event that we
experience additional droughts over the next few years. The County
would like to obtain a copy of the maintenance agreement to place
in the Georgetowne Court site plan file.

That the recreational facilities at Georgetowne Court
be amended as follows:
a. That the 2 court basketball court be moved from
its present location to a site generally east of
the "tot lot" shown in the common area in the center
of the project.
b. That the volleyball court be relocated from it present
location to a site generally east of the revised
location of the 2 basketball court.
These changes are being requested by Members of the Georgetowne
Court Homeowners Association for their convenience. The Developers,
Dr. and Mrs. John E. McAllister pose no objections to these changes
however, they do desire that your decision be timely and that it
involve no additional expense to them eg, revising site plan, etc.

Dear Mr. Hardman:
This letter regards the completion of required site work for the
Georgetown Court townhouse project. The Frederick County Planning
Department will monitor ,the site improvements throughout the
development phase. Hopefully, this letter will assist you in
coordinating the completion of these improvements while
simultaneously obtaining your Certificate of Occupancy permits.
At a minimum, each townhouse unit should be provided with a
sidewalk, landscaping (grass, shrubbery, trees) and house number.
You should contact our department at least one week prior to
closings to insure that an inspection will occur. The completion
of the remaining improvements (recreational facilities, parking
lot, stormwater management ponds, and buffer/screening) is
required before all occupancy permits are received; however,
flexibility will be allowed for these improvements.
Section 5-7-1.2 of the Frederick County zoning Ordinance specifies
that all required recreational facilities be started at fifty (50)
percent occupancy, and be completed by sixty (60) percent
occupancy. The parking lot still requires the final surfacing,
striping and handicapped spaces. Due to the closing of the asphalt
plant, we will allow for your receipt of occupancy permits until
the plant is open in the spring provided that an all weather
surface is continuously maintained for emergency purposes. If this
date affects the closings on the final units, a bond agreement may
be worked out through our department. The stormwater management
ponds need to be graded properly and stabilized to insure adequate
stormwater management. This improvement should be finished as soon
as possible. The buffer/screening requirement calls for a full
landscape screened ten (10) foot easement planted on top of a berm.
The evergreen and deciduous trees can wait until spring for
planting; however, the berms can be graded, compacted and
stabilized in the meantime. During periods of inclement weather,
lots and common areas need to be mulched to prevent impacts to the
grading until a permanent vegetative cover can be applied.

As previously stated, our department will issue Certificate of
Occupancy permits for this project. In return, we expect
sufficient site improvement work to occur. Please use this letter
as a guide to plan your improvement phasing for this project.

The evergreen and deciduous trees can wait until spring for
planting; however, the berms can be graded, compacted and
stabilized in the meantime. During periods of inclement weather,
lots and common areas need to be mulched to prevent impacts to the
grading until a permanent vegetative cover can be applied.
As previously stated, our department will issue Certificate of
Occupancy permits for this project. In return, we expect
sufficient site improvement work to occur. Please use this letter
as a guide to plan your improvement phasing for this project.

Dear Doug:
This is to follow up on our discussion today regarding the
accessory structures (storage sheds) at the Georgetown Court
townhouse development near Stephens City. The development has 83
individual lots, and it is proposed that adjoining lots would share
a dual storage shed, with the shed's partition placed on the lot
line.
I would like to get your written opinion as to whether each lot on
which a storage shed is proposed to be placed less than the
required five feet from the lot line should have a separate
variance or, in the alternative, if one variance for the whole
development would be sufficient. If one variance would be
sufficient, please advise as to how each lot should have its
variance recorded (e.g., with notations to the deeds of each
parcel, or with copies of the variance to each parcel owner).
I plan to mention this at tomorrow's BZA meeting to make the
members aware of the situation and get their input on how to handle
it.

As requested we have reviewed the above referenced site plans dated January, 1990.
Our recommendations may be found on the attached plans marked in red and as follows:
1. The entrance is to be constructed with a-12' offset from the edge of pavement to
the face of gutter pan with a 36' taper. A minimum 30' entrance width will be
required from face to face of gutter at the right-of-way line.
2. A standard VDOT stop sign will be required at the intersection of Georgetowne
Court and Route 277.
3. A 20' drainage easement and swale will be required from the outfall of the
existing 18" C.M.P. under Route 277 to the proposed 20' storm sewer easement on
site as noted.
4. The existing Frederick County Sanitation Authority watermain encasement under
Route 277 will need to be extended from under the pavement structure to the
right-of-way line as noted. _.
Please revise and resubmit four (4) copies for final approval. Should any changes
be deemed necessary please design them to meet or exceed the above recommendations.
Please remind the developer before any work is performed on the State's
right-of-way, the appropriate land use permits must be applied for. These permits
are issued by my office and require a fee and surety bond coverage.

spaces,; adding another layer of wall material to existing walls,

Project Description
This project involved is being developed by Dr. John McAllister. The
type of construction is 52 single family detached residences, and 84 townhouses.
The project will also involve installation of sewer, water and utilities. The total
developed area is 31.5 acres.
Existing Site Conditions
Prior to construction, the site was characterized by rolling terrain,
predominately open with some undergrowth, all typical of undeveloped areas in
the Upper Shenandoah Valley. The site is in the Wiekert-Berks-Blairton Soil
Association. This area is characterized by gently sloping, moderately deep,
somewhat poorly draining soils that have medium to fine textured subsoil;
formed in material weathered from shale.
Adjacent Areas
Most of the areas surrounding the development are residential in
nature. Wright's Run forms the northern border of Jefferson Village. There are
existing detention ponds at Nottoway Village west of Georgetowne Court.
Soils
For purposes of design run off conditions, antecedent moisture
condition II (normal consideration for the mid -Atlantic region) is assumed. The
soil is considered to have a moderate rate of water transmission, therefore, CSC
Soil Class "B" is adopted. Soils are of the Series, for the most part of the Blairton
(3B) or Clearbrook (9B) Series. A copy of the respective soil map is enclosed.
Permanent Stabilization
Seeding . for- permanent stabilization is specified in the . V.E.$-C.
Handbook. Any area denuded in which work is not proceeding for a period of 30
days or more will be stabilized by a temporary seeding in accordance with State
guidelines and procedures: All areas to be seeded will receive seed application by
hydroseed methods immediately upon obtaining grades.
Storm Water Management Consideration
Site Plans have been attached.
Jefferson, Village covers the northern 12.5 acres of the property. Curb
and gutter streets are used throughout. All drainage is carried by storm sewer or
conveyance channel to Wright's Run. Wright's Run has been determined to be
an adequate channel. These plans have been approved by VDOT-. -
Georgetowne Court is a townhouse project on 13 acres between
Jefferson Village and Va. Rte. 277. Curb and gutter streets are used throughout.
Two detention ponds are utilized to ensure that drainage from the site during
the two year- storm does- not exceed the pre -development -condition. A pre -
development C factor of .3 was used. The post development C factor is .6.
Maintenance
All soil erosion control structures shall be checked weekly by the
contractor during this construction period and after construction is completed
until grass cover is established. Sediment retained by these structures shall be
continuously removed and placed in an area of the site specified, damage to soil
erosion control structures shall immediately be repaired when identified by the
contractor. The contractor shall cooperate with all agents of the County, the
Engineer and others who may identify needed facilities or work in order to
protect the environment within the subject of this report.

Dear George,
Enclosed you will find a key map of the Georgetowne Court site. I have
marked the setback and buffer lines which effect construction of decks and utility
sheds. I have discussed this matter with Wayne Miller of the Frederick County
Planning office and he has assisted me in determining the following
requirements:
1. 50' Perimeter Boundary Setback Line - (Masked in red on key
map.) Attached sheds or decks may extend up to 3' into this setback,
provided the attachment does not exceed 1 /3 the length of the
building. A detached shed may be within 5' of the property line.
2. 100' Buffer From Main Property Line - (Marked in green - This
only affects units 52 thru 72.) The 100' buffer consists of 75' inactive
space (yellow) and 25' active space (area between the yellow and
green lines). Attached sheds or decks may not extend into any part
of the 100' buffer line. Detached sheds may be placed in the 25'
active buffer area and within 5' of a property line. Detached sheds
may not be located within the 75' inactive buffer space.

Dear Kris,
We have completed our review of the above
referenced project and offer the following comments
and/or recommendations.
A. GENERAL
1. (Suggestion) Additional spot elevations at
building entrances, corners of buildings and in
critical areas where contour lines do not exist,
would be helpful in the review process and
during construction of the site to ensure proper
drainage.
2. (Suggestion) supporting calculations such as
time of concentration determination, headwater
calculations and nomography would also be
helpful in reviewing the drainage calculations
and tables provided on the plans.
B . ACCESS ISSUES
1. Sight Distance. It appears that horizontal sight
distance should not be a problem on this
project. It is not clear if vertical sight
distance is appropriate. This should be verified
by a sight distance profile. It appears that

SCIENTISTS VDOT did not consider this an issue in their
review, however, I suggest that the Engineer
verify this to make sure he will not run into a
problem later with VDOT accepting the entrance.
Tn the future, sight distance provisions should
be noted on the drawings.
2. This project accesses Route 277 which is planned
to be widened. I strongly recommend that the
County request the Developer to set aside an
additional fifteen► (15) foot reservation strip
for future dedication when the improvements are
made. This will not adversely affect the plan as
submitted, but will make the additional land
available for future right--of-way widening.
C. DRATNAGE ISSUES
1. The assumed time of concentration of 15 minutes
for some of the small on site drainage areas is
not very realistic. My guess is that the time of
concentration should be 5 minutes (10 minutes
maximum).
After review of the design capacities of the
proposed drainage system and the drainage
flowing to them, it is my opinion that the pipe
sizes will handle the increased run off rates as
a result of the reduced time of concentrations.
T therefore do not have a problem with the
drainage design as proposed but suggest that
either more realistic time of concentrations be
used in the future or supporting documentation
for longer time of concentrations be submitted.
