INGRESS/EGRESS EASEMENT AND UTILITIES
AND PARKING EASEMENT
THIS DEED OF EASEMENT made and dated this day of
UI , 1990 by and between ARCTIC FREEZERS, INC. party
of he first part, hereinafter called the Grantors, and the RYDER
TRUCK RENTAL, INC., party of the second part, hereinafter called
the Grantee.
WHEREAS, RYDER TRUCK RENTAL, INC. is the owner of a certain
parcel, known and designated as Parcel 60A, Tax Map No: 54 ((A)),
in Frederick County, Virginia recorded in the Office of the Clerk
of the Circuit Court for Frederick County in Deed Book 583 at
Page 165 dated August 30, 1984 and ARCTIC FREEZERS, INC. is the
owner of a certain parcel, known and designated as Parcel 60, Tax
Map No: 54 ((A)), recorded in Deed Book 565, Page 168, dated Oc-
tober 4, 1984.
WHEREAS, the Grantee has requested and the Grantor has
agreed to grant a certain easement for a utilities and parking
easement over and across the property of the Grantor, as shown on
the attached plat by this reference made a part hereof as if set
out in full. In return, the grantee has granted to the grantor a
30' Ingress/Egress easement over and across the property of the
grantee as shown on the attached plat by this reference made a
part of as if set out in full.
NOW, THEREFORE WITNESSETH: That for and in consideration of
the sum of TEN DOLLARS ($10.00) cash in hand paid, and other
valuable consideration, the receipt and sufficiency of which is
hereby acknowledged, the Grantor does hereby grant and convey,
with general warranty of title unto the Grantee, a permanent
easement over, across and through said aforementioned parcels in
the locations and widths as shown on the aforementioned plat.
Said easement is granted for the purpose of the construction,
operation, inspection, maintenance, repair and replacement of
parking and utilities on and across the property of the Grantor.
The Grantee shall have the right to construct necessary improve-
ments within said easement. All improvements shall remain the
property of the Grantee, its successors and assigns.
In return, the Grantee does hereby grant and convey, with
general warranty of title unto the Grantor, a permanent easement
over, across and through said aforementioned parcels in the
locations and widths as shown on the aforementioned plat, for the
purpose of ingress/egress to Parcel 60.
The Grantor and Grantee, and their successors in title to
the land over which the said easements are granted, shall have
the right at all times to cross over and upon said easements,
provided such use does not interfere with the construction and
maintenance of the easements hereby conveyed.
The Grantee and Grantor, its officers, agents, servants and
employees, shall have\ the right to go on, over and upon said
property for the purpose of constructing, inspecting, maintain-
ing, repairing, and replacing said easements, including any im-
provements to be located therein.
The Grantee Joins in this Deed of Easement to express its
acceptance of said easement.

This letter is to allow S.W. Rogers to begin setting up all
required erosion and sediment control measures, woodland protection
measures, and stock pile all gravel/fill dirt on the Ryder Truck
property located at the corner of Route 783 and North Kent Street.
All work will be contained to this site, and will be inspected
periodically by Frederick County Inspectors. The site plan for
this project must be approved before any other construction will
be allowed to occur on this site.

Dear Tom:
This is to acknowledge receipt of your revised site plans dated August 2, 1989
to the above referenced project. If you recall our earlier recommendations
were to construct the entrances with standard CG-6 curb & guttering with a
minimum 20' radii and 10' offsets with 30' tapers. However, upon further
review on site there appears to be standard 03-6 curb & gutter along the
property frontage with Route 783. It is very difficult for us to tell what
condition the curbing is in because of the heavy accumulation of silt which
has washed over it from above and out of the Ryder site.
I have discussed this matter with our Area Superintendent and he has scheduled
to uncover the curbing the week of June 25, 1990. After this is accomplished
we will then be able to determine what kind of, if any, entrance improvements
will be needed. I will contact you to let you know of our findings.

Dear Mr. Davis:
Upon review of the above referenced site plans dated April 28, 1989, please find
our recommendations on the attached plans marked in red and as follows:
1. The entrances are to be constructed with Standard CG-6 curb and guttering
with a minimum of 20' radii and 10' offset with 30' tapers.
2. The proposed 120' 6" PVC should be increased to 12" in diameter as
noted.
Please revise and resubmit for final approval.
Should any changes be deemed necessary please design them to meet or exceed the
above recommendations. My office will require four (4) copies of the revised
plans in order to process a land use permit. The permit will be issued by my
office and will require an inspection fee and surety bond coverage.

We have completed our review of the above site plan. There
are several minor comments that we have which need to be
considered. The silt fencing needs to be added prior to land
disturbances, however, we do not see any reason that early site
grading cannot be granted provided that the proper erosion and
sedimentation controls are installed.
The issue of the 611 discharge pipe needs to be resolved with
VDOT prior to final approval. I would like to point out that the
pipe is not within the right-of-way and is a designed release for
the stormwater detention basin. I therefore, do not feel that
this comment should be applicable in this case. This is not a
standard culvert.
The letters of permission for off -site grading as referenced
on the plan should be submitted to the County prior to granting
the final grading permit.
Assuming these issues can be resolved, I see no reason why
this plan can not be approved.

No objection to site plan. Present entrances are adequate for proposed on
site improvements. However, we recommend a bituminous asphalt overlay between
the existing curb and gutter and the travelled portion of the Route /83 roadway
which fronts the property., A land use permit will not be required for this work
on the right -of way since it is considered — maintenance ot the existing commercial
entrances. However, while working on the right-of-way it will be necessary to

GENERAL
1. Incorporate the comments from VDOT into plans.
2. Indicate whether the fuel tank and the gas station are
existing or proposed. Indicate whether the fuel tank is
above ground or underground.
DETENTION FACILITY
1. It is suggested that the engineer provide adequate
protection measures along the northern and southern sides of
the detention pond to keep vehicle wheels from tracking off
the pavement into the pond. This can be achieved by means
of providing 4" concrete filled ballards along the edge of
pavement. Curbing can also be used to help with this.
However, truck wheels can jump curbing if that is all that
is used.
2. Though the design of detention facility or the volume of
storage does not substantially change, we would like to
mention that for outflow characteristics, it is a normal
practice to consider the weir flow up to the top of the pipe
and orifice flow beyond that. If the VDOT comment requiring
the use of 12" pipe is considered, the engineer can use the
standard inlet control charts for computing the headwater
and pipe discharge. We do not totally agree with VDOT on
this comment. The pipe is a discharge for the SWM facility
and not simply a culvert under the driveway.
3. Since the County's requirement is to detain a 2 year storm,
it is recommended to consider a emergency weir on the
northern side of the detention facility rather than over-
topping the pond for 10 year and 100 year flows.
EROSION & SEDIMENT CONTROL MEASURES
1. Silt fence is required along the northern and eastern sides
of the properties. It is not clear from the plans whether
silt fence was provided along these tow sides.

SCIENTISTS
Dear Evan,
I have reviewed the proposed revisions to this site
plan. Generally it appears that they have increased
the size of the parking areas and added additional
parking, eliminated the original stormwater management
pond and revised some of the overlot grading.
My comments are as follows:
A. ACCESS ISSUES
1. The proposed parking spaces along the northwest
property are set within an off -site easement. There
is an access easement to the adjacent property
(Artie Freezer) on which the existing chain link
fence and two parking stalls on the southwest
boundary will block.
2. The 30 foot access easement should be shown on the
plans. Also, the parking and utility easement
should be shown.
3. I do not see any additional impact to the entrance
to this property.
B. DRAINAGE AND GRADING ISSUES
1. The stormwater management facility is incorporating
a portion of the parking spaces along the northwest
line. If vehicles are to be stored there on a
regular basis, the height of ponding should be
verified and an emergency overflow provided at an
elevation that will limit ponding to a tolerable
depth. This should be checked.

2. The storage/head table for the SWM pond is
reasonable, however, the discharge or bottom
elevation is 34-13 according to the invert
ENGINEERS elevation on the outfall pipe.
ARCHITECTS
SCIENTISTS 3. The discharge/head table was not provided for the
-- existing 8 inch PVC pipe, however, discharge rates
look reasonable.
4. A trench drain 1 foot wide is indicated on the
plan. A detail is not provided as a note suggests.
It is also not clear how this trench drain works.
How water flows to it, how water flows in it, and
where it goes. Its capacity is also not indicated.
5. The grading in the area to the south of the "Gas
Station" appears to be very flat. It looks like it
will pocket water.
6. The grading around the eastern side of the building
toward the SWM pond is also very flat. Also, if the
spot elevation of 35.5 at the end of the curb and
gutter at the entrance is a top of curb elevation,
there will be a pocket at this location.
C. EROSION AND SEDIMENTATION CONTROLS
1. A construction entrance is provided.
2. The narrative as provided has not been modified to
reflect the new SWM pond location. The narrative
should also reflect the frequency for inspection
and removal of collected silt during the
construction period. It should also indicate final
stabilization.
In general, the site grading and details for how the
trench drain is to be installed and will drain are the
most critical. It was a bit difficult to determine
what is existing and what is proposed on the plan. The

° n ° ENGINEERS building is clearly marked as is the existing Route
ARCHITECTS 783. However, I could not distinguish if any of the
SCIENTISTS site was previously paved. Although the same is true
for the first plan, I feel the first plan is cleaner,
easier to read and the grading and drainage appears
better.
The above listed items must be addressed before I can
recommend final approval.
