#009-91 of ALSON H. & MARGARETTE SMITH
WHEREAS, Rezoning application #009-91 of Alson & Margarette Smith
to rezone 0.965 from B-2 (Business General) to RP (Residential
Performance) located on the north side of Fox Drive, adjacent to
Fox Ridge Subdivision, in the Gainesboro District and designated as
GPIN 420000A000195A.
WHEREAS, the Planning Commission held a public hearing on this
application on December 4, 1991; and
WHEREAS, the Board of Supervisors held a public hearing on this
application on December 11, 1991; and
WHEREAS, the Frederick County Board of Supervisors finds this
rezoning to.be in the best interest of the public health, safety,
welfare, convenience and good zoning practice;
NOW, THEREFORE, BE IT ORDAINED by the Frederick County Board of
Supervisors as follows:
That Chapter 21 of the Frederick County Code, Zoning Ordinance, is
amended to revise the Zoning District Map to change 0.965 acres
from B-2 (Business General) to RP (Residential Performance) located
on the north side of Fox Drive, adjacent to Fox Ridge Subdivision,
in the Gainesboro District and designated as GPIN 420000A000195A.

PROPOSED USE: One single family dwelling.
REVIEW EVALUATIONS:
Sanitation Authority: Sewer and water is available
directly to the parcel proposed for rezoning.
Planning & Zoning:
Location - The site is located in the Urban Development
Area and in the vicinity of the Route 37-522 North
Interchange. Land zoned RP is located to the south.
Site Suitability - Much of the site is relatively steep
and not well suited for commercial development. The only
existing access is on an easement from Fox Drive and
there is no direct access to a state maintained road.
Sewer and water service is available adjacent to the
site.
Potential Impacts - This is a rezoning from Business to
0
Residential so potential traffic will be reduced by the
rezoning. Because of the limitations of the site and
lack of direct access to a state road, intensive
residential development of the site will be difficult.
Because of this and the small size of the site, potential
impacts will be negligible.
Conclusions - This rezoning only involves a very minor
adjustment between existing R-P and B-2 areas. No
negative impacts would be projected.
