#002-91 OF FORREST L. BROWN
WHEREAS, Rezoning application #002-91 of Forrest L. Brown to
rezone 3.626 acres from B-1 (Neighborhood Business) to B-2
(Business General) located on the south side of Route 50, two miles
west of the Route 37 Bypass, in the Back Creek District and
designated by GPIN 52000A00000000000092B was referred to the
Planning Commission on February 6, 1991; and
WHEREAS, the Planning Commission held a public hearing on this
application on February 6, 1991; and
WHEREAS, the Board of supervisors held a public hearing on
this application on March 13, 1991; and
WHEREAS, the Frederick Cout rest of nty Boarthe public health, of Supervisors finds
safetys
rezoning to be in the best in
welfare, convenience and good zoning practice;
NOW, THEREFORE, BE IT ORDAINED by the Frederick
County Board of Supervisors as follows:
That Chapter 21 of the Frederick County Code, Zoning Ordinance, is
amended to revise the Zoning District Map to change 3.626 acres
from B-1 (Neighborhood Business) to B-2 (Business General) located
on the south side of Route 50, two miles west of the Route 37
Bypass in the Back Creek District and designated by GPIN
52000A00000000000092B as described by the application and plat
submitted.
This ordinance shall be in effect upon its passage.

PROPERTY ZONING & PRESENT USE: Business use zoned B1 (Neighborhood
Business)
ADJOINING PROPERTY ZONING & PRESENT USE: Business use zoned B2
(Business General) and vacant and residential areas zoned RA (Rural
Areas).
PROPOSED USE: General merchandise stores and miscellaneous retail.
REVIEW EVALUATIONS:
Virginia Dept. of Transportation: No objection to rezoning
of this property. Existing entrance is adequate. However,
should the use ever expand in the future, the entrance may
need to be upgraded.
Fire Marshal: Fire Marshal will address on site plan or
construction drawing. Fire Chief Robert Whitacre, Co. 15, has
signed the comment sheet for Fire and Rescue Squad with no
comments. This rezoning will allow retail sale of merchandise
and as a result, there will be more "public" access to
existing or proposed buildings. Since there is no municipal
water service to this area, strict adherence to all applicable
building codes will be necessary to ensure the greatest level
of public safety.
Health Department: There is one approved drainfield located
on this site, designed to handle 200 gallons per day
wastewater. The Health Dept. has no objection to the rezoning
request as long as maximum eight (8) employees (total) work
in the buildings.
Inspections Department: This request for rezoning approval
shall comply to Use Group "M" Mercantile, Section 308.0 of the
BOCA National Building Code 111987".
Planning & Zoning: The following issues should be considered:
Location - The site is located in the Round Hill Rural
Community Center. Commercial uses are currently located along
Route 50. Previous planning for this community center
suggests that additional commercial development of a type and
scale similar to existing uses would be apppropriate.
Existing B-2 zoning is located along Route 50 and on an
adjoining property.
Site Suitability - The site has frontage on the east bound
lane. The site is relatively level. One approved drainfield
is located on the site.
Potential Impacts - Substantial commercial expansion and
increased traffic impacts could occur under the existing B-
1 zoning. Two to three times more square footage could be
allowed under B-2 than B-1 zoning with increased potential
impacts. However, the site is located on an improved four
lane divided highway with substantial remaining capacity.
Concern should expressed that appropriate means for ingress
and egress be provided.
Buffers and screening would be required in relation to
adjoining residential property.
Conclusions - Some potential traffic impacts could be
expected. However, the proposed rezoning is in conformance
with the Comprehensive Plan and existing patterns of use and
zoning.
STAFF RECOMMENDATIONS FOR 2/6/91 P/C MEETING: Approval
PLANNING COMMISSION RECOMMENDATIONS FOR 2/6/91: Unanimous Approval.
IMPACT ANALYSIS STATEMENT
1. Suitability of the Site:
The entire 3.62 acres have been cleared and are presently in
maintained grass. None of the area is considered in a 100
year flood plain, and there are no mature woodlands or steep
slopes. There are no apparent soil or bedrock conditions
which would create construction difficulties or hazards.
Site appearance will be enhanced by additional landscaping.
2. Surrounding Properties:
The adjoining property on the east side of subject property is
already zoned B-2. Other adjoining properties have a church
and two residences on the properties. However, the structures
are more than 300 feet from existing structures on the proposed
rezoned property. Therefore, there should be negligible impact
on surrounding properties associated with noise, glare, fumes,
smells, or other nuisance factors.
3. Traffic:
There should be little additional impact from the existing traffic
flow of 12,000 vehicles per day that pass on Route 50 West.
Ingress and egress from existing business to propsosed rezoned
business is estimated to be around 50 vehicles per day between
the hours of 9:00 a.m. and 5:00 p.m., which is consistent with
the adjoining properties.
4. Sewage Conveyance and Treatment:
The existing drainfield and water supply are adequate for the
proposed rezoning with negligible impact to the adjoining
properties. Any future increase in usage would be with prior
approval of the Frederick County -Winchester Health Department.
The present usage is rated at less than 200 gallons/day.
5. Drainage:
The existing drainage patterns will not be affected. At present,
there is a natural watershed running the length of the rear
property line. There are no apparent problems with drainage or
flooding and none are anticipated.
6. Emergency Services:
Emergency services of Round Hill Volunteer Fire & Rescue are
within 1/2 mile of property and existing structures. A strong
working relationship is expected with no additional cost to the
services.

7. Environment:
No significant environmental feature changes from the present use,
except to add additional landscaping. Now, the property is mostly
cleared area with no apparent unique wildlife habitats or unique
natural areas or features. Expect no additional threats to
groundwater, surface water, or air quality.
8. Fiscal:
We foresee no additional costs of providing county facilities for
the proposed rezoning, only anticipate increased revenue through
local and state taxes.

credit. The term "obligations" is used in its broadest sense to include, but not be limited to, extensions of crcdil, interest, charges, costs,
duties of performance and indebtedness of any kind or source.
b. If the writing which evidences an extension of credit (1) is executed after the date of this Deed of Trust and (2) specifically states
that the extension of credit is unsecured or that there is no collateral, that extension of credit and the obligations related thereto shall not
he secured by the Property under this Deed of Trust.
c. Any consumer credit obligation, as defined under the federal Truth in Lending Act and applicable implementing regulations, of a
Granor or other person named above, will be secured by the Property order this Deed of Trust only if (i) this Deed of Trust or the Property
is stMcrfically mentioned in a writing which evidences the obligation or in a disclosure statement, commitment letter or other agreement

ueneral Warranties and Covenants. Except as specifically modified clsewhcre under the terms of this Deed of Trust, the Grantor
ovenants, and this Diced of Trust shall be construed to impose and confer upon tl;c parties hereto and the beneficiaries hereunder, all
warranties. duties, rights and obligations prescribed in Sections 55.59 and 55-70 through 55-74 inclusive of the Code of Virginia of 1950,
as amended. Grantor further covenants that the Grantor and any lessee of the Property will comply with all laws and ordinances.
G-artor and the Bank covenant and agree as follows:
1. Obligations Secured. This Deed of Trust is intended to secure existing obligations or obligations which arise and are repaid from
time to time on differing dates and for differing amounts and for differing purposes, provided the obligation meets the descriptive re-
quirement, for a secured obligation as set forth above. No identification by signature of any Trustee shall be required beyond that which
is set fort above, if any. The secured obligations shall be performed and repaid in accordance with the terms, charges and rates of interest
stated in the rotes, instruments or other agreements underlying each such obligation, including any loan agreement or commitment related
therel".
J. AppLI=Uon of Payment and Proceeds, The Bank shall not be required to in any way apportion among the obligations secured
hereunder any funds or monies received from, any source, including those received from the disposition of the Property. Funds received
from or with respect to any Pelson obligated to the Bank may be applied to pay any obligation of such person (whether secured hereunder
or rot) in such amount, mani,er and sequence as the Bank may determine to be in its own best interest. Proceeds of the disposition of
any property which secures an obligation also secured under this Deed of Trust may be applied by the Bank in whole or in part to the
payment of any obligation secured by such property. Any monies received from any Grantor may, but need not, be first applied to meet
any escrow requirement as provk" under section 5 below and/or to the payment of any amount which it result in alien which would
have priority over the Bank's interest in the Property.
If any obligation secured. hereunder is contingent, or not liquidated, or not matured, or not declared in default at the time of receipt
of any monies as proceeds or in settlement of (a) any policy of insurance on the Property or (b) disposition or rental of the Property after
default or (c) condemnation or taking of the Property, at the Bank's discretion after paying any rttatured obligations, costs, charges, fees
or other expenses, the Bank or the Trustee shall be entitled to hold in escrow so much of the balance of such monies as the Bank in good
faith believes necessary to fully secure the repayment of the maximum potential amount of such obligations as estimated from time to
time by the Bank in good faith. If the Grantor is not personally liable for the repayment of such obligation, the Bank will pa interest
on such escrow amount at a rate not to exceed that currently being paid uy the Bank on regular statement savings accounts for which
no maturity or notice period is required.
Except as otherwise agreed by the Bank in writing, payment in excess of the amount scheduled under the terms of any agreement which
underlies an obligation shall not alter, extend or postpone the amount or due date of any scheduled payment.
3. Haurd Insurance. Grantor shall keep the improvements now existing or hereafter erected on the Property and any marketabl;
timber or crops growing on the Property insured against loss of fire, hazards included within the term "extended coverage," and such
other risks as Bank may require. The insurance coverage shall be in such amounts and for such periods as he Bank may require, and
shall, in any event, be in an amount sufficient to prevent Grantor from becoming a co-insurer as to such insurance.
All insurance policies and renewals must: (a) contain a standard mortgage clause in favor of the Bank; (b) provide for at least 30 days
prior notice of cancellation to the Bank; (c) be with a company acceptable to the Bank; and (d) be in a form and contain terms satisfactory
to the Bank. Grantor shall promptly provide to the Bank the original of any policy or renewal or re iacemer• i)olicy (which will be held
by the Bank) and shall provide Bank with other evidence of insurance upon request. If Grantor fails to maintain such insurance or fails
to provide evidence of wch insurance in a timely fashion, Bank may, but need not, obtain such insurance protecting either (a) the interest
of both the Bank and the Grantor or (b) the interest of the Bank only. The Bank may obtain the insurance in any form and amount and
with any insurance carrier the Bank chooses. The Grantor shall reimburse the Bank for the actual cost of the insurance immediately upon
demand.
In the event of loss. Grantor shall give prompt notice to the insurance carrier and Bank. Bank may make proof of loss if not made
promptly by Grantor. The proceeds of any insurance paid for any reason whatever shall, to the extent of the obligations secured by the
Property then remaining unpaid, inciuding contingent obligations and outstanding commitments by the Bank to extend credit which could
or would be secure( under this Deed of Trust and which are not conditioned upon loss or damage to the Property, be paid to the Bank.
Unless Bank otherwise agrees, the proceeds of any insurance will be applied to the obligations secured hereunder in accordance with the
directions of the Bank and as provided in section 2.
If the Properly is abandoned by Grantor, or if Grantor fails to respond to Bank within 20 days from the date notice is mailed by Bank
w Granor that the insurance caner offers to settle a :)aim for insurance benefits, Bank is authorized to settle the claim on behalf of Grantor
on such terms as the Bank determines to be in its own best inteiest and to collect and apply the insurance proceeds at Bank's option either
to restore or repair the property or to pay any secured obligation.
In the event of force nsare under this Deed of Trust, all right, title and interest of the Grantor in and to any insurance policies then
in force, or any prom_ of insurance policies resulting from damage to the Property prior to foreclosure, or any refund or unearned
premium, &tahail pass to Bank who may receive on Grantor's behalf the cancellation value or proceeds and may apply the same to the
extintuisent of the debt.

pos+Licias attributable to lbe property which may attain priority, over this Deed of Trust, (all of which are hereinafter referred to as "taxes"),
