PROPOSED USE: Single family detached homes. REVIEW EVALUATIONS: Virginia Dept. of Transportation: No objection to the rezoning of this property. Before development, this office will require a complete set of construction plans detailing entrance designs, drainage features, and traffic flow data from the I.T.E. Trip Generation Manual, Forth Edition for review. Any work performed on the State's right-of-way must be covered under a land use permit. This permit is issued by this office and requires an inspection fee and surety bond coverage. Fire Marshal: Stephens City Fire and Rescue Co, has commented on this application. Based on 1992 statistics, fire and rescue responses to this subdivision will average 1 response 0 0 Page 2 Woodside Rezoning per 10 households annually. Further related issues will be addressed on site plans. Stephens City Fire & Rescue Co.: S.C. F & R Co., acknowledges the proffer offer. Sanitation Authority: Water and sewer capacity are available to serve this site.. County Engineer: Stormwater management has been planned for the proposed development. We recommend that runoff coefficients, "C" valves at 0.35 and 0.5 be adopted for the pre and post development respectively. Also, the planned development should include improving the drainage ditches along Double Church Road (Route 64)1 to accommodate the on - site runoff Parks & Recreation: See attached note from James Doran dated 8/12/93. Town of Stephens City: Traffic impacts on Fairfax Pike (Route 277) and I-81 intersection will increase with the development of acreage already zoned RP Planning The parcel proposed to be rezoned is located within the Urban Development Area and has access to sewer and water and there is sufficient capacity to serve the proposed development. The application states that 84 single family dwellings would be constructed on lots of between ten and twelve thousand square feet. The Institute of Traffic Engineers, Trip Generation Manual, projects ten vehicle trips per day for single family dwellings, or 844 trips. This would be an increase of nearly fifty percent over the current 1,793 vehicle trips per day on Double Church Road (Route 641). There is no information provided on the resulting level of service at the intersection of Routes 641 and 277. An analysis of the impacts to the intersection should be preformed by a qualified traffic engineer. Though the application states that there would be 84 lots developed, the proffer statement says that a total of 66 lots would be created. This discrepancy needs to be addressed. The applicant has also proffered $2, 500. 00 per lot for schools to be paid "...at the time that each lot is sold and shall be payable out of the settlement proceeds concerning said lot." Staff feels this would be difficult to enforce. It is customary for such payments to come due at the issuance of 0 0 Page 3 Woodside Rezoning building permits. The impact model indicates that the per unit costs to the county would be $3,974.00 which is $1,474.00 over the amount proffered. The model also indicates a per unit impact on fire and rescue of $20.00 which is far exceeded by the $200.00 per unit proffered. (These numbers are based on 84 units being constructed, the costs per unit if 66 units are constructed is $3,850.00 and $23.00 respectively.) Location - The parcel adjoins the Meadows subdivision to the rear, and is roughly 500 feet to the south of the Jamesway Plaza. The property to the south and east is zoned RA and is relatively open with scattered residential uses. Site Suitability - The site is quite level, there appears to be no steep slopes. The existing pond is shown on the general development plan as being in the center of the open space. STAFF RECOMMENDATIONS FOR 10/06/93 PC MEETING: Given the Impact Model indicates a negative financial impact to the County for schools which is not offset by the proffers, the staff recommends denial of the request. NOTE. Subsequent to the staff evaluation of the proposed rezoning, the applicant revised their proffers. The new proffer statement is enclosed. The monetary contributions were increased to match the impacts projected by the County's impact model. The proffers were presented to the Commission at their 1016 meeting. PLANNING COMMISSION SUMMARY: The Commissioners were divided in their opinions about the rezoning of this property. Some of the points made in favor of the rezoning were: The property was located in the UDA of the Comprehensive Plan; it was adjacent to commercial and residential areas; public facilities were in place to handle the development; and the property was being assessed by Frederick County as developable property. Some of the Commissioners felt that rezoning was not appropriate at this time because it would set a precedent for the rezoning of several large adjacent tracts also located in the UDA; the traffic was already congested on Route 277 and various intersections in the area; and the citizens in the area did not want to see more rural land rezoned. There was a debate among the Commissioners about whether the timing was right for rezoning this parcel. PLANNING COMMISSION RECOMMENDATIONS OF 10106193: By majority vote the Planning Commission recommended denial of the application. Second, there are a number of problems with the format of the statement. * The statement references an attached, Addendum "A" - Street Layout for Woodside Estates; there is no such attachment. The diagram enclosed is not labeled as an addendum and is titled Generalized Development Plan. * The monetary amount proffered needs to be broken down into specific dollar amounts for the various departments or agencies. * Also the amount proffered toward the Fire and Rescue Company needs to come to the County rather than directly to the Company. These items in and of themselves would probably not warrant returning the application, however, there are a number of other shortcomings. As you know, the County rezoning process calls for a preapplication discussion to be held between the applicant and the planning staff. Your cover letter to Mr. Watkins indicates that the "project" has been discussed with him and his staff, as well as the Planning Commission. Neither I nor Bob recall the specifics of any conversation(s) let alone whether specifics of a rezoning were covered. In reviewing Planning Commission agendas, I found that the discussion you reference took place in December of 1992, three years ago! Since that time, there have been numerous developments in the area of this proposed rezoning, not to mention turnover among the Commission members themselves. The intent of these preapplication discussions with staff and the Commission is to cover current issues, discuss concerns and potential impacts. This can be of direct benefit to the applicant in preparing the application and any potential proffers. Most, if not all, of the benefit of the past discussions is lost after such an extended period of time. Finally, the traffic impact component of the application is inadequate. Cumulative impacts of recent developments on the intersection of Routes 277 and 641 have raised concerns over traffic in this area dramatically. The traffic analysis should evaluate the current conditions and level of service at this intersection and forecast the impacts of the proposed development. Before we will accept a rezoning application for this parcel, the proffer statement should be corrected and a comment obtained from the County Attorney, and a detailed traffic impact statement should be produced. I would also strongly advise that a discussion with the Planning " Commission be held prior to submitting an application. I will, however, leave this up to you and the applicant to decide. This impact will be felt most at the intersection of VA Route 641 and VA Route 277. Using available documentation and a limited field traffic count, we were able to predict the short range impact of the Woodside Estates project on the 641/277 intersection. In 1989 the Prism Group had a study done evaluating the effect of their proposed retail development on the 641/277 intersection. This study developed a 1994 flow volume through the intersection with the following assumptions: 1. 7.5% area traffic growth; 2. development of the proposed site. The study predicted a level of service A at the 641/277 intersection in 1994 with the Prism development. Gilbert W. Clifford & Associates conducted a limited traffic count at 641/277. The weekday P.M. peak volumes were counted for only those movements to be impacted by Woodside. The predicted generated trips by Woodside were then added to the counted volumes at 641/277. These totals were compared with the 1994 volumes predicted by the Prism study. There was general agreement, though some variation did exist. The Prism intersection totals were augmented by the Woodside development impact totals to determine the intersection evaluation volumes. Clifford & Associates, Inc. has been commissioned to evaluate the above referenced project in light of several major planning issues, as outlined and required by Frederick County. This document is prepared in support of and in preparation to rezone 28 acres from present RA to RP as described in Attachment "A" Generalized Development Plan. In summary the land is affected as follows: This site would yield approximately 84 lots for single family detached housing types. 1) Traffic Impacts Assuming 84 lots can be developed on this site, the resulting trips per day generated would be 841. The access point would be from VA Route 641. The current loading on Route 641 is 1793 trips per day. A detailed trip study will be necessary at the master planning stage to determine required improvements to the entrance at VA Route 641. 2. Sewage Conveyance and Treatment Impacts. Sewage service to this site is provided by Frederick County Sanitation Authority. Flows generated from the total development are estimated by the State Health Department at 33,600 (400 gpd/home) gallons per day with an instantaneous peak flow of 58.3 gallons per minute. The actual flows from writer's experience will be about one half or 17,000 GPD. The sewage would flow by gravity to a proposed pump station then be pumped to an existing 8" sewer line at VA Route 277, then again by gravity to the existing Frederick County Sanitation Authority treatment facility at Stephens Run. All sewage conveyance systems involved have capacity to carry this additional flow as does the plant have the capability of treating and discharging this flow in satisfactory manner. Currently plans to take the Stephens Run facility off line and install a regional pump station are in progress. Sewage from this development, and all areas currently served by the Frederick County Sanitation Authority Stephens Run plant will be treated at the Parkins Mills facility. 3. Wate_r Supply mpacts: This project would connect to the Frederick County Sanitation Authority water system. A 10" watermain exists on the east side of VA Route 641. The water service should also be extended to connect with the water system in the Meadows subdivision to the north. The estimated water use is the same as sewage flow. 4. Education Cost: Using County averages, this project will generate .335 school. age children per single family detached dwelling. The County would have to provide facilities for approximately 28 children. 5. Parks and Recreation Cost: This project would result in an impact on Parks and Recreation. Sherando Park and the new Sherando High School are within one mile. These facilities will provide ample recreational facilities to serve this proposed development. 6. Drainage Facility Impacts: The development of single family in lieu of the existing non-use will increase run off in over that which exists now. The proposed zoning increases the amount of residential area and therefore the runoff coefficients and times of concentration. Storm water management ponds should be included in the final design to mitigate any affect on adjoining properties due to increased runoff. 7. Emer envy Services Cost: Sheriff protection will be required by this facility. Routine patrols of the area should suffice for the majority of time . Special patrols and activities may include a total of 2 hours per week. Special coverage at $50.00 per hour would involve approximately $5200.00 per year. There should be no other impacts on emergency services. This represents essentially no increase in service over what would have been required if development occurred under the existing zoning. 8. Solid Waste Cost: Costs to the County would be normal for this type of development. No special waste removal needs are planned. Waste removal by house to house collection is available by private contractor. Disposal to be at the County Landfill. 9. Environmental Impacts: There will be certain minor negative impacts due to the construction activity including run off, sediment, noise and traffic movements. These are to be minimized by proper compliance with local and state laws for environmental protection. A minor increase in run off quantity and a decrease in quality is probable from this development. The effects on the downstream areas should be minimal and in accordance with local and state regulations. There is no known loss of irretrievable resources involved with this project. There are no known endangered species of fauna, flora or wildlife which will be effected by this project. Ground water and air quality should be unaffected. A minor impact of a negative nature is associated with increased traffic, as mentioned. 10. Other Fiscal Impacts: No other impacts were noted. 11. Historic Impacts: This project will be evaluated for sites of historic significance and such sites cataloged and shown on the Preliminary Master Development Plan.
