The land use permit issued to you to cover the work on the right-of-way expires April 8, 1991. As you have already been advised there are various locations along the right-of-way, particularly in front of the Frederick County School Board property, which will need attention prior to the permit being marked complete. Specifically these areas need to be regraded, seeded and mulched. As I am sure you are aware this permit was originally issued in August, 1989 and has been continually extended since that time. This office feels you have had ample tine to complete this work and will consider no additional time extensions. Therefore, please take whatever action is necessary to have this work completed by the expiration date or we will be forced to take appropriate action. Co., Inc. #855-00800 82 West Queen Street The Church of Jesus Christ of Latter Day Saints Chambersburg, PA 17201 Route 739 Frederick County Dear Mr. Shipp: This is to follow-up on our meeting of April 12, 1990 at the above referenced project wherein we discussed this Department's concern over the construction practices of your subcontractor on the State's right-of-way. I realize the winter months may have slowed his progress, however, he has demonstrated a total disregard for maintenance of the right-of-way during this time. A prime example of this is when we allowed you to open cut the entrance to the Apple Pie Ridge Elementary School for the installation of utilities. Although against VDOT policy, we agreed to this because of the bad repair of the entrance. After the cut was made it took over thirty (30) days for him to patch the entrance. This was after I had to notify the engineer on the project. Please let this letter serve as notice if immediate steps are not taken to restore the right-of-way, i.e. seed & mulch and the school entrance repaired to its original condition, then this Department will have to take appropriate action. Need owner's/developer's name, address, and phone number 2. Tie sewer line into line, not manhole. 3. 10 foot separation between water and sewer lines. 4. Core drill existing MH for new line. 5. Add gate valve and 2 joints of pipe at end of water line. The above recommendations are from John G. Whitacre.
