Pursuant to our telephone conversation of September 26, 1990 Frederick Mall
Land Trust will in fact be able to use a letter of credit in lieu Qf a
performance bond for the required surety coverage of the above referenced
project's signalization agreement. We have enclosed a format which should be
used by the bank in preparing said letter.
Please keep in mind the letter of credit is to be dated as of May 19, 1990 and
remain in effect for a period of two (2) years or until May 19, 1992.
In order to expedite conpletion of this project's permit requirements please
return four (4) original copies of the letter of credit at your earliest
convenience.

Gentlemen:
We hereby open our Irrevocable Letter of Credit No. in your Department's favor
for the account of Frederick Plaza Land Trust for the sum not exceeding fifty thousand
dollars ($50,000.00) available by your sight drafts on the (bank name)
and accompanied by documents specified below:
A certified statement signed by the Permit Manager or his representative stating
Frederick Plaza Land Trust will be required to install a traffic signal pursuant to the
conditions of Land Use Permit #855-00689 issued to Frederick Plaza Land Trust bearing
the date of May 19, 1989.
A statement signed by the Permit Manager or his representative to the affect the drawing
is for the explicit purpose of providing for the design, materials and installation
costs to provide for a traffic signal at the main entrance to the Sunnyside Plaza
Shopping Center on Route 522 North in Frederick County, Virginia pursuant to the
attached signalization agreement.
All drafts must bear the clause "Drawn under the (bank name) Letter of
Credit No. dated 19 ".
We hereby engage the drawers, endorsers and bona fide holders that all drafts drawn in
compliance with the terms of this credit shall be duly honored upon presentation and
delivery of the documents. This Irrevocable Letter of Credit shall remain in full force
and effect for a period of two (2) years from the date of opening the shopping center:
from May 19, 1990 to May 19, 1992.
This credit shall be terminated upon the Permit Manager or his appointed representative
giving written release to Frederick Plaza Land Trust stating signalization at the main
entrance to the Sunnyside Plaza Shopping Center on Route 522 North in Frederick County,
Virginia as set forth in Land Use Permit #855-00689 and attached signalization agreement
will not be required.
Except as otherwise expressly stated herein, this credit is subject to uniform customs
and practice for documentary credits (1983 Revision), International Chamber of Commerce
Publication No. 400.

From traffic data furnished by you and traffic counts, it appears
signalization is warranted at the main entrance on Route 522. Cost for
signalization at the entrance will be 100% the developer's expense. It is our
recommendation a VDOT Engineer design and install the required signalization
and bill your company for associated costs. Data to support the need for
signalization is also attached.
Please revise and resubmit for review.

This is to advise of the improper replacement of a section of Standard CC-6
Curb & Gutter at the above referenced project by your contractor, Perry
Engineering Company, Inc. The section in question is the intersection radius
of Routes 522 and 739. If you recall we discussed this matter by telephone
several weeks ago and you have received copies of the enclosed letters dated
November 20, 1989 and March 16, 1990 which are self-explanatory.
Perry Engineering replaced the curb & gutter the week of April 23, 1990 and
listed below are improprieties which resulted:
The reason for replacing the curb & gutter in the first place was to
increase the intersection radius. However,,,..the new curb & gutter was
installed in the same exact location and the temporary section of curbing
as discussed in the letter of November 20, 1989 was left in place.
- While removing the old curbing Perry Engineering damaged the existing
electrical facilities which serve the traffic signals at this
intersection. Perry was advised both verbally and by letter (copy
attached) prior to construction they were to contact our area
electrician, Mr. Rich Teachout, so the lines could be located. VDOT was
not contacted prior to work commencing.
At this time I must inform you the curbing will need to be removed and
reinstalled in the proper location. Also, we will require reimbursement for
the damaged electrical facilities which will most probably be billed to you on
an accounts receivable basis.

As requested we have reviewed the above referenced plans. Our recommendations
may be found on the attached plans marked in red and as follows:
1. The median ditch from the outlet end of the proposed 83"x53" RCEP should
be graded to approximately 6' width bottom.
2. The new drop inlet proposed along the SBL turn lane of Route 522 should be
a D1-3B with 8' slot length and the converted manhole a standard
D1-1 inlet.
3. The 2 inlets Numbers CI-1 and CI-2 should be standard D1-3B curb inlets
with 10' slot lengths and tied into the existing storm sewer under
Route 522.
4. After drainage structures and grading are completed, a field review will
be necessary to determine guardrail needs.
5. Pavement design should consist of 1 1/2" S-5 and 6 1/2 B-3 asphalt
concrete.
6. Standard CD-1 underdrains will be required as noted on plans.
Please revise and resubmit for review. Before any construction is started on
the State's right-of-way my office will require 4 sets of the revised plans in
order to process a land use permit.

its nightly meeting of January 18, 1989, with the following provisions:

2. Virginia Department of Transportation comments of December 13, 1988 on
attached sheet.
3. Frederick County Planning Commission comments as follows:
a. Outlots should not have direct access onto Route 522, lots should only
have access from the mall entrance.
b. Install screening (pines) up on Tudor Square property, there is a need for
better screening.
Please send us three copies of the revised site plan with the above listed
corrections completed.

We have reviewed plans for the above development and have the following
comments:
1. The proposed drainage along Route 522 to be adjusted as noted on Plan
Sheet 1 of 1, showing increasing the outfall pipe to 60' of 53" x 83"
RCEP and mitering the outlet end on a 2:1 slope. Due to the high
velocity of flow, erosion control stone standard EC-1, type A and B to
be installed at the outlet end of the pipe as noted.
2. A manhole opening is to be provided in the box culvert junction for
access.••
3. The drainage on the proposed entrance road appears satisfactory.
We are returning the plan assembly, keeping one copy of storm water
improvements along Route 522 and site plan of grading and drainage.

Dear Ms. Baker:
This is to follow-up on a meeting between myself and Mr. Frank Combs of your company
on March 15, 1990 at the'above.referenced project. During the meeting we discussed a
section of existing curbing (in bad repair) at the intersection of Routes 522 and 739
which should be removed and replaced with Standard CG-6. This will he required to
provide for a smooth transition into the right turn lane on Route 522 as well as
increase the existing intersection radius. Mr. Combs advised this work was not
originally part of your firms contract price and approval of the change would he
required from the owner.
If I am not mistaken this matter has been discussed several times with Mr. Combs and
representatives of the owner. We have been under the impression throughout
construction of the development this intersection radius was to be replaced as soon as
the relocation of our traffic signal pole was completed. This is evident in a letter
to your firm dated November 20, 1989 (copy attached).
6%je hope this letter clarifies the matter and the curbing can be replaced so not to
delay completion of the project. Please be advised prior to excavating in the area,
you will need to contact Mr. Rich Teachout at our Winchester Area Headquarters
(703-662-8876) so existing electrical facilities at the intersection can be located.
