This letter is to confirm the action taken by the Frederick County Planning
Commission on June 17, 1987.
Approval of Site Plan #030-87 of Amoco Foam Products, Inc. for 190,000 square
foot covered storage (warehouse) area with access drives, fire hydrants, and site
improvements. This property is located on Route 11 North at the southeast corner
of the I-81 and Route 11 North intersection in the Stonewall Magisterial
District.
Before any construction, a building permit must be obtained.

PROPOSED USE AND IMPROVEMENTS: 190,000 square foot covered storage (warehouse)
area with access drives, fire hydrants and site improvements
REVIEW EVALUATIONS:
Highway Department - No objection to the site plan and the proposal. There
is an existing approved entrance from the State's right-of-way at this
location.
Sanitation Authority - No objection.
Clearbrook Fire Company - No objection.
Planning and Zoning - No objection. This is an expansion of an existing
manufacturing use. Warehousing is a permitted use. All site planning and
zoning requirements have been met. Employee parking is adequate. Site and
fire access is adequate.
STAFF RECOMMENDATIONS: Approval. The applicant is proposing to use the frontage
road that currently serves the Pent Land Industrial Park area (Power Tech, Miller
Tool, and Robinson Contracting/Painting), as a secondary access to the site. The
applicant is currently working closely with the staff and VDT to resolve highway
needs at this location. Planning for this intersection area is currently being
undertaken by VDT officials. Industrial access funds may be available to assist
with improving the frontage road connection.

It was good to meet with you and the project manager from Eskridge, Long, and
Associates. I believe our meeting was productive and look forward to our meeting
scheduled with Mr. William Bushman, Resident Engineer for VDH&T, on June 8, 1987 at
1:00 p.m. at your offices.
The following are the highlights of our recent meeting:
— Land disturbance may be started at your site by Perry Engineering, Inc.
immediately. A land disturbance permit will be issued upon receipt of your
revised site plan.
— Mr. John Trenary, plumbing inspector, will contact you regarding underground tank
requirements.
— Mr. Kenneth Coffelt, Building Official, will call you about fire
separation/sprinkling requirements for your proposed 190,000 square foot covered
storage area.
— "No Parking" signs for the area in front of your plant along Route 11 have been
again requested.
— Your current plan will be presented to our Planning Commission informally on
Wednesday, June 3, 1987. Your attendance is not required.
— Once a revised plan is received from Eskridge, Long, and Associates, the plan
will be revised and presented formally to the Frederick County Planning
Commission, possibly June 16, 1987.
— Attached for your review are the landscaping/screening requirements of Frederick
County for your site.

ARTICLE XV
INDUSTRIAL GENERAL DISTRICT M-2
15-1 STATEMENT OF INTENT
This district is designed to provide for a variety of industrial
uses which would not usually be compatible with nearby commercial
or residential uses. Performance controls are measured at the
district boundary as opposed to individual lot boundaries in order
to allow maximum flexibility for permitted uses. Where an M-2
District does abut a residential or agricultural District, yard
requirements are greater than for M-1 Districts. Screening
provisions are included in order to protect adjacent properties.
Safe access to the site shall be considered in the establishment
of an M-2 District, and access over minor roads (as shown in the
current VDH & T Functional Classification Map for Frederick
County) shall be avoided.
15-2 PERMITTED USES
In an M-2 General Industrial District, any structure to be erected
or land to be used shall be for one or more of the following

uses:
15-2-1 All uses permitted in an M-1 Light Industrial District with the
exception of restaurants and general office buildings. These uses
shall comply with all M-1 regulations except that the M-2
performance standards shall apply.
15-2-2 The following types of uses when located at least one hundred
(100) feet from a Residential District or areas within other
Districts which are predominantly Residential in nature.
15-2-2.1 Fish, poultry and meat processing (excluding slaughterhouse,
stockyard, or rendering of fats).
15-2-2.2 Concrete, gypsum, cement or clay products manufacturing.
15-2-2.3 Distilling or brewing of alcoholic beverages.
15-2-2.4 Vinegar, yeast, sauerkraut and pickling operations.
15-2-2.5 Automobile graveyard or.junkyards.
15-2-2.6 Recycling of paper, metal, plastics, or similar products.
15-2-3 The following types of uses when located at least three (300)
hundred feet from a Residential District or areas within other
Districts which are predominantly Residential in nature.

Slaughter houses.

Smelting works.
15-2-3.17 Steam power plants, excluding accessory plants.
15-2-3.18 Sugar refining.
15-2-3.19 Tar or asphalt roofing manufacturing and tar distillation.
15-2-3.20 Tanning
15-2-3.21 Wood preserving operations
15-2-4 Public utility generating, booster or relay stations, transformer
substations, transmission lines and towers, and other facilities
for the provision and maintenance of public utilities, including
railroads and sewer facilities, and water and sewer line;
excluding general office buildings.
15-2-5 Accessory uses as defined and business signs.

15-2-6 For uses not specifically listed above, the Administrator shall
determine which sub -section of the regulations shall apply, if any
and may refer the matter to the Planning Commission of their
interpretation.
15-3 USES PERMITTED WITH A CONDITIONAL USE PERMIT
Uses listed below under item (15-3-1) through (15-3-9) shall be
located at least six hundred (600) feet from a Residential
District or areas within other Districts which are predominantly
Residential in nature.
15-3-1 Explosives, including ammunition and fireworks, manufacturing or,
storage thereof.
15-3-2 Gas manufacturing (natural gas or from coal or petroleum) or
storage thereof.
15-3-3 Hydrogen or oxygen processing and storage.
15-3-4 Petroleum refining and manufacturing or storage of flammable
petroleum products.
15-3-5 Insecticide, herbicide, or poison manufacturing or storage
thereof.
15-3-6 Acetylene generation or storage thereof.

15-3-7 Asbestos processing.
15-3-8 Match manufacturing.
15-3-9 Oil paints, shellac, turpentine, varnish or enamel manufacturing
or storage.
15-4 REQUIREMENTS FOR PERMITTED USES
15-4-1 Before a building permit shall be issued or construction commenced
on any permitted use in this district or a permit issued for a new
use, the plans, in sufficient detail to show the operations and
processes to be undertaken, shall be submitted to the Zoning
Administrator for study. The Administrator may refer these plans
to the Planning Commission for recommendation. Modifications of
these plans, in order to bring them into compliance with this
ordinance, may be required by the Administrator or the Planning
Commission.
15-4-2 Permitted uses shall be -conducted wholly within a completely
enclosed building or in an area shown on the site plan. Within
any required yards there may be required adequate landscaping
and/or screening to protect surrounding property from adverse
affects. The extent of such required landscaping and/or screening
shall be determined by the administrator who may refer the matter

to the Planning Commission.
C15-4-3 Any part of a lot not used for buildings or other structures or
off-street parking, loading and maneuvering areas, drives and
pedestrian walks, shall be planted with appropriate planted ground
cover (trees, flowers, shrubs, or grass lawns) all of which shall
be properly maintained in healthy condition at all times.
15-4-4 All uses within an M-2 District shall conform to all applicable
performance standards as specified in Article I.
15-4-5 A site plan as provided for in Article XIX shall be submitted ,to
the Administrator.
15-5 HEIGHT, AREA AND BULK REGULATIONS
15-5-1 AREA REGULATIONS - For permitted uses utilizing
individual sewage disposal systems, the required area of any such
use shall be approved by the health official.
15-5-2 YARD REGULATIONS - All structures shall be set back from the
right-of-way line of all highways, roads or streets, a minimum of
seventy-five (75) feet. No off-street parking or loading shall be
within twenty-five (25) feet of any such right-of-way line.
Except as provided for in Section 15-2, no portion of any
structure shall be erected less than twenty-five (25) feet from
any district or property line. No minimum yard is required on a
Cyard which abuts a railroad right-of-way. No off-street parking
shall be less than fifty (50) feet from a residential district or
areas within other districts which are predominantly residential
in nature; twenty-five (25) feet from any other district property
line. Off-street parking shall be required in accordance with
Article 2, Section 2-5, of this chapter.
15-5-3 HEIGHT REGULATIONS - Maximum building height shall be forty-five
(45) feet. Any exceptions to this regulation are contained in
Article I of this ordinance.
15-5-4 MAXIMUM LOT COVERAGE - No more than fifty (50) percent of a lot
shall be covered with structures or paved with an impervious
surface (i.e. asphalt, concrete, double seal).

On November 26, 1990 this regional office completed the
engineering evaluation of a revised permit application from the
Amoco Foam Products Company to continue its plant operation in
Winchester, Frederick County. I am writing to notify you of this
matter and solicit any comments you may wish make. Currently, the
company, which has been in operation in Winchester since 1980, is
operating under a Consent Agreement and Order with our Department.
A public hearing will be held to receive comments on this
application. Notice of time and location of the hearing will
appear in the Winchester Star newspaper. It is anticipated the 30-
day public comment period and public hearing announcement will be
published in mid -January 1991.
