Dear Mr. Kerns:
I am again writing you concerning the drainage problem which is the result of
the development of your property at the above referenced location. This
matter was previously called to your attention by letter from this office
(copy attached) dated March 14, 1990.
In discussions with our Area Maintenance Superintendent, Mr. D. O. Wilkins, he
advises you did contact him concerning the matter. However, to date you have
done nothing to correct the problem. Therefore, please let this letter serve
as notification if positive drainage is not obtained on the Route 831
right-of-way fronting your property by the installation of a drainage culvert
within ten (10) days of your receipt of this letter, we will be forced to take
appropriate action; up to and including the cutting of a ditch line across
your entrance.
We feel we have been more than patient in this matter by allowing you ample
time to complete the work. We will appreciate your immediate attention in
addressing the matter within the allotted time.

AGREEMENT
This agreement, made this 18t1i day of April
19 90 , by and between Diamond Homes, Inc.
party(s) of the first part, and the County of Frederick, Virginia,
party of the second part.
Whereas, in consideration of the approval by the party of the
second part of this Virginia land disturbance plan and permit for
Valley Mill Village (Site Plan #054-87)
and the party of the second part requiring the following work to
be completed during the land disturbance construction and before
final occupancy, the party(s) of the first part or his heirs/
assigns agree to do the following work:
1. Provide for -the adequate control of erosion and sedimentation
by temporary and permanent control practices and measures
which will be implemented during all phases of clearing,
grading and construction and to .provide for conformity with
the Virginia Erosion and Sediment Control Law, Title 21,
Chapter 1, Article 6.1 of the Code of Virginia and local code
laws.
2. To provide Erosion and Sediment Control as per the Erosion and
Sedimentation Control Plan.
The party(s) of the first part does further agree that an agent of
Frederick County shall be permitted entry to the site of the land
disturbing activity to inspect the control measures shown in the
approved plan.
In testimony whereof, the party of the first part has hereunto
caused its corporate names and seals to be hereunto affixed, for
and in its behalf, by Randy Perry
and caused this agreement to be acknowledged and delivered for and
in its behalf.

ADJACENT LAND USE AND ZONING: Residential and vacant land uses, and zoned RP
(Residential Performance
PROPOSED USE AND IMPROVEMENTS: Multi -family (townhouse) residences
REVIEW EVALUATIONS:
Transportation Department - No objection to the preliminary master
development plan. A commercial entrance permit would have to be applied for
and approved before doing any work on the State's right-of-way.
Sanitation Authority - 1) Relocate fire hydrant; 2) Show San. sewer lat. to
property line; 3) Show water tap on existing water line; 4) Blow off needed.
Greenwood Fire Company - The Greenwood Volunteer Fire Company has no problem
with this plan.
Inspections Department - This request for multi -family townhouses shall
comply to Use Group R - Residential, Section 309.0, of the BOCA Basic
National Building Code 1984.
Planning and Zoning - The site plan is drawn in accord with the approved
final master development plan and subdivision plats. The site plan proposes
a single townhouse structure containing 8 two -bedroom dwellings. This use is
allowed. There are no environmental areas on the site requiring protection.
37% of the site is shown as open space (18,407 square feet). Recreational
facilities are not required. Dimensional requirements have been met and
bonus provisions are not requested. A full 200 foot buffer is shown between
the units and the single-family dwelling located to the west. Buffers are
not required between the proposed townhouses and the townhouses to the north
and east. In general, the proposal appears to be compatible with surrounding
uses and all site plan requirements have been met. Fire protection and
utility changes have been made as per Sanitation Authority.
STAFF RECOMMENDATIONS: Approval.
