Dear Dr. Ellis:
This letter is to confirm action taken by the Frederick County Board of Zoning Appeals at their
meeting on May 15, 2001.
The Board of Zoning Appeals (BZA) approved your appeal of the determination made by the office
of the Zoning Administrator in the administration of the Zoning Ordinance, pursuant to Section 165-
82D, concerning the operation of a Head Start Program in an Ml (Light Industrial) Zoning District.
In approving the appeal, the BZA determined that the Head Start Program is a vocational school,
identified by Standard Industrial Code (SIC) 824. This approval allows you to use the property at 444
Shady Elm Road (which formerly housed the Tri-County Virginia Opportunities Industrialization
Centers, Inc.) for the Apple Country Head Start program.

who has met all requirements of the Frederick County Erosion and
Sedimentation Control Ordinance as certified by the Frederick
County Department of Planning and Development.
AGREEMENT
This agreement, made this 1st day of May ,
19 91, by and between
Albert Grady/ Grade A Pavement ,
party(s) of the first part, and the County of Frederick, Virginia,
party of the second part.
Whereas, in consideration of the approval by the party of the
second part of this Virginia land disturbance plan and permit for
Tri-county O.I.C.
and the party of the second part requiring the following work to
be completed during the land disturbance construction and before
final occupancy, the party(s) of the first part or his heirs/
assigns agree to do the following work:
1. Provide for the adequate control of erosion and sedimentation
by temporary and permanent control practices and measures
which will be implemented during all phases of clearing,
grading and construction and to provide for conformity with
the Virginia Erosion and Sediment Control Law, Title 21,
Chapter 1, Article 6.1 of the Code of Virginia and local code
laws.
2. To provide Erosion and Sediment Control as per the Erosion and
Sedimentation Control Plan.
The party(s) of the first part does further agree that an agent of
Frederick County shall be permitted entry to the site of the land
disturbing activity to inspect the control measures shown in the
approved plan.
In testimony whereof, the party of the first part has hereunto
caused its corporate names and seals to be hereunto affixed, for
and in its behalf, by Albert Grady
and caused this agreement to be acknowledged and delivered for and
in its behalf.

Approval of Site Plan #024-87 of Tri-County Virginia O.I.C., Inc. for industrial
training facilities and warehouse (10,608 square feet - one story structure),
parking, access, and site improvements. This property is located south of Route
37, west of Virginia Route 651, at their intersection in the Back Creek
Magisterial District.
Before any construction, a building permit must be obtained.

REVIEW EVALUATIONS:
Highway Department - The proposed entrance does not meet our minimum
commercial entrance standards. It will be necessary to resubmit in
accordance with our minimum commercial entrance standards. We will need four
copies of the proposed site plan when the permit is applied for.
Sanitation Authority - Sewer and water service is provided by the City of
Winchester. Fire protection plan meets County regulations.
City of Winchester - Reference the subject site plan, please be advised that
the City can provide water and sewer service to this lot in accord with
existing policy. It is noted that the entire IDC acreage (85+ acres) is
limited to a sewer capacity of 700 gallons per minute. This TIC parcel
consumes some of this capacity. It is required that the anticipated water
use be submitted to the City. Please note that the water and sewer main
shown along the south property line must be installed as the other mains are
installed; it makes no sense to delete these short sections during the
initial construction. It is also necessary that a meter location detail be
submitted.
Stephens City Fire Company - Before a valid comment can be made, I would like
to know what will be stored in the warehouse. All County fire codes need to
be met.
Inspections Department - No objection. Must be built in accordance with the
VUSBC.
Planning and Zoning - No objection. The proposed use for industrial training
facilities is a permitted use in the M-1 zone. The plan meets all applicable
site plan, zoning and fire code requirements. All VDT and utility comments
have been incorporated in the plan.
STAFF RECOMMENDATIONS: Approval.
