Adequate access and safety requirements appear to be satisfied for Frederick County's site planning standards. It is my understanding that all site planning standards. will be fulfilled upon completion of the entire site. January 26, 1988 Mr. Donald Garber Garber Ice Cream Company Front Royal Road Winchester, Virginia 22601 Re: Windy Hill Subdivision Road Maintenance Dear Donald: 4 I met with Steve Gyurisin of the Frederick County Planning Commission in response to letters he has forwarded to you concerning the roads in Windy Hill Subdivision. You may recall that the roads in this subdivision were approved by the necessary County and State officials in 1979. Unfortunately, these roads were never completed to state standards as required by the then existing subdivision ordinance. I informed Mr. Gyurisin that in my opinion the roads became the property of Frederick County and perhaps the State when the subdivision plat was recorded. However, we agreed that in order to possibly avoid any court proceedings in this matter we would make every effort to have the various property owners abutting the roadway in this subdivision contribute to the construction of this road. I would appreciate your contacting the abutting owners in an effort to ascertain if they will contribute to the construction of a State approved - highway in the Windy Hill Subdivision. I understand there has been some efforts made to get contributions from the owners, but so far this has not been successful. Please advise me promptly what success you may have in seeking such contribution and what assistance I can give you in this matter. Looking forward to hearing from you, I remain Sincerely, J. Baker TCB/bw Enclosure s SITE PLAN #019-87 Windy Hill Business Park 4.308 acres, Zoned B-3 (Industrial Transition) LOCATION: Lot 1, Windy Hill Subdivision, off Route 522 South MAGISTERIAL DISTRICT: Shawnee ADJACENT LAND USE AND ZONING: Industrial, vacant Commercial and Residential land uses and B-2 (Business General) zoning PROPOSED USE AND IMPROVEMENTS: Warehouse complex consisting of 4 (four) structures with access, parking, and site improvements REVIEW EVALUATIONS: Highway Department - No objection. This street is not now in the state system. However, to ensure that it will qualify for future addition, the entrance plans will be reviewed by VDH&T. Sanitation Authority - Authority does not provide service to this property. City of Winchester - Generally, the site plan is acceptable. A water main extension is required and thus City Council must approve. The matter is scheduled for consideration in May. Service can be provided subject to approval by Frederick County, particularly for the water main extension. Greenwood Fire Company - Due to the wide variety of materials which could be stored in these buildings from time to time, access to all buildings should be provided which would allow fire apparatus to operate from any side of the building at any time of a fire situation. This area should be marked as fire lane and meet the requirements as such. Fire hydrants should be placed where they will be within 300' of all portions of all buildings. Inspections Department - All structures must be built in conformance with the Virginia Uniform Building Code. Planning and Zoning - No objection. The proposed use and plans meet all applicable zoning and site plan requirements. All VDH&T requirements appear to be met. Once the Windy Hill Subdivision Street is accepted by VDH&T, a permit will be required to work on the state's right-of-way. Acceptance of this road is based on the number of businesses and final road construction inspection. The staff has been working with all owners to have this road accepted now that additional businesses are proposed along the street. All fire codes have been met for fire hydrant and access. Approval of a main extension is needed by the City and County to accomodate the required line for fire hydrants. STAFF RECOMMENDATIONS: Approval. This was forwarded to our District Office and listed below are our comments: 1. The drainage outfall onto Route 81 right-of-way appears satisfactory. 2. Traffic & Safety reviewed the entrance design. Their comments are as follows: a. Extend curb on the turn lane back to where the taper ends. b. Shorten flare taper on the west side of entrance. C. The edge of parking lot should be curb or otherwise delineated to prevent vehicles from crossing onto street roadway. d.
