of the existing Lowe's Home Improvement Center. This property is located on
the east side of Route 522 South, south of the Route 50 intersection, in the
Shawnee Magisterial District.

LOCATION: East side of Route 522 South, south of the Route 50 intersection.
MAGISTERIAL DISTRICT: Shawnee
ADJACENT LAND USE AND ZONING: Vacant land and plumbing supply business, zoned
B-2, Business General.
PROPOSED USE AND IMPROVEMENTS: Expansion of the existing Lowe's Home Improvement
Center and Building Supply retail store with required parking and site
improvements.
REVIEW EVALUATIONS:
Highway Department - No objections. Before any work is done on our right-
of-way, a permit will have to be applied for and approved. (See attached
letter for plan corrections and recommendations.)
Sanitation Authority - No objection. 1) Water line tap and valve sprinkler
system under City control; 2) Size of fire line to holding area? 3) Fire
hydrant at Accessory Building 2 needs G.V.; 4) Fire hydrant at Accessory
Building 2 too close to building; 5) Need by pass on valve system.
Health Department - No objection; served by central sewer service.
City of Winchester - In accordance with City policy, fire lines and hydrants
served from City mains shall become part of the City's water system. This
requires Council approval for a main extension and the earliest that this
could be accomplished would be February. Also requires approval of the
Frederick County Sanitation Authority and County Board.
Greenwood Fire Company - No objection; fire hydrants and access need to be
placed on this site as per Chapter 10 of the Fire Code.
Inspections Department - This site plan request shall comply to Use Group M,
Section 308.0, of the BOCA Basic Building Code, 1984.

Planning and Zoning - No objection. All applicable zoning and site planning
standards have been met. VDOT and Sanitation Authority details will be added
as recommended. Prior to any utility extension, all City and County
approvals are required.

Dear Mr. Watkins:
We have reviewed the above referenced entrance redesign and offer our comments
and recommendations as follows.
1. The new proposed entrance width should be minimum of 40' with 25' radii in
lieu of 30' as shown on the plans. our office strongly recommends a
minimum of 50' width as this would be used for egress and ingress truck
traffic.
2. The existing CG Curb should be removed and a right turn lane should extend
across the property. It should begin and end with 36' taper sections.
3. The southernmost entrance should use 25' radii.
4. Curbing should extend along the property line fronting Route 522 to
prevent parking on the right-of-way.
5. Standard CG-6 Curb and Gutter should be used throughout. I am attaching a
copy for the developer's use.
Our recommendations are shown on the attached site plans which were previously
submitted to my office.
Before any work is done on our right-of-way in reference to the proposed
entrance redesign or the proposed shrubbery planting, a permit will have to be
applied for and approved.

STATEMENT OF INTENT
This district is intended for those commercial activities that may
be operated in conjunction with production and marketing
facilities. The uses in this district will be large, some will
have open-air display; and there will be a mixture of automobile
and truck traffic. It is intended that the uses in this district
shall not be sources of noise, dust or smoke; and the —lots -will —be
landscaping in front as well as to the sides and rear.

SETBACK REGULATIONS
No structure, except signs, shall be located between the setback

12-4-2 The setback line shall be located thirty-five (35') or more from

line of any street with a right-of-way less than fifty feet (50')
in width and parallel or concentric to the center line.
12-5 YARD REGULATIONS
12-5-1 For permitted uses the minimum side and rear adjoining or adjacent
to a residential or agricultural district shall be twenty-five
feet (25').
12-5-2 Buildings and signs may be erected up to thirty-five feet (35') in
height from grade.
12-5-3 No accessory structure which is within twenty-five feet (25') of
any party lot line shall be more than one story high. All
accessory structures shall be less than the main structure in
height.

(1) Shipper agrees that the goods herein described are accepted in apparent good order (ex-
cept as noted) and in tendering this shipment agrees to the terms and conditions of this
contract which is also set forth in Purolator's Worldwide Directory or, if applicable, its tariff.
(2) LIMITATION OF LIABILITY - Purolator's liability is limited as specified in its Worldwide
Directory, or applicable tariff. PUROLATOR'S LIABILITY FOR THE LOSS, DAMAGE OR
NON -DELIVERY OF A SHIPMENT SHALL BE LIMITED TO THE ACTUAL VALUE OF THE
SHIPMENT OR THE DECLARED VALUE OF THE SHIPMENT, whichever is less. Unless a higher
value is declared on the bill of lading or other applicable shipping document, each
shipment will be deemed to have a maximum declared value of $250.00. If a value greater
than $250.00 is declared, an excess declared value charge will be assessed at the rate of
$.50 per $100.00 of excess declared value.
Except as stated below (see Articles of Extraordinary Value), Purolator will not accept for
shipment any shipment having an actual or declared value of over $25,000.00.
NOTWITHSTANDING THE FOREGOING, PUROLATOR IN NO EVENT SHALL BE LIABLE FOR
ANY CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES WHICH MAY ARISE FROM
LOSS, DAMAGE, NON -DELIVERY OR DELAY OF ANY SHIPMENT. THIS LIMITATION SHALL
APPLY TO AND INCLUDE, BUT NOT BE LIMITED TO DAMAGES FOR LOSS OF PROFIT, LOSS
OF INCOME OR A LOSS OF BARGAIN.
Shipments containing any article of extraordinary value, as set forth below, are limited to
a maximum declared value of $500.00 per shipment.
Articles of extraordinary value include: (i) works of art or antiques, including but not
limited to paintings, prints, drawings, sculptures, porcelain; (ii) jewelry, precious stones
or furs, including but not limited to watches, rings, precious or semi-precious stones (cut
or uncut) including diamonds (industrial or synthetic); (iii) money, coins, currency or
stamps; (iv) precious metals, including but not limited to gold or silver bullion, ingot
or coins; (v) negotiable securities and negotiable instruments (other than "cash letters"),
including stocks and non -restrictively endorsed checks, drafts and money orders.
(3) Purolator ,maintains cargo liability insurance to the full extent of the liability offered to
shipper.
(4) Purolator's liability for delay in delivery of any shipment shall be limited to the value ofthe
transportation charges for such shipment. Due to the nature of the business, Purolator
will not be liable, except as provided herein, for failure to deliver by a stipulated time or
date.
(5) Written Notice of Claim for loss, damage and nondelivery must be reported
to Purolator by Shipper within 45 days after tendering the shipment for carriage.
Claims for concealed damage must be reported to Purolator within 4$ hours of delivery.
Claims for loss, damage and/or nondelivery must be filed by shipper in writing with
Purolator within 30 days after noticepf Claim.
(No claim for loss or damage to a shipment will be entertained until all transportation
charges thereon have been paid. The amount of claim may not be deducted from
transportation charges).
(6) In the event of international carriage by Purolator of a shipment hereunder the rules
relating to liability established by the convention for the Unification of Certain Rules
Relating to International Carriage by Air signed at Warsaw, Poland on October 12, 1929,
shall apply to'the carriage insofar as the same is governed thereby.
(7) Receipt by the Consignee of the shipment without written notification of damage under
remarks on the Route Manifest shall be prima facie evidence that the shipment has been
delivered in good condition.
