These soils will present some constru`=t_- problems due to a shrink -swell potential. Water This property is not in a flood hazard area and off -site draina_= =mould not be a problem. Public Facilities Highway Route 277 is congested in this area, while the Highway Depar= has approved this proposal, particular care needs to be taken in design of acc`_= :nays. Utilities Frederick County Sanitation Authority central water and se::`=. ZONING Yard Requirements may be met. Previous actions by Planning Commission and Board of Supervisors. Five parcels have been rezoned along Route 277 in the area of i-n-is application. MEDIUM DENSITY RESIDENTIAL LAND USE PLAN Staff Comment This tract is a logical addition to the commercial land that is -_ :=_e intersection of Route 277 and Route 1012. The drainage area and the water and sewer =_cements make a logical break between the commercial and residental areas. The development of this tract and the adjoining property is, ho:; of concern. Both Stimpson and Allen (see attached map) propose to use the fronta_ t- _ood old fashion strip development and leave the rear of both properties to be used i:, _- -:.::specified way. Stimpson Rt. 277 - Stephens Cit Dear Mr. Riley: With reference to your notice of request for re -zoning as noted above, we would like to state the following: In early 1973 we purchased the 4.4 acre tract of Commercial, B-2 land there on 277 from Robert K. Stickley with a letixr from Mr. Riley stating that it was zoned B-2. Evidently within the next year withour out knowledge and during the re -zoning of areas, this property of ours somehow was zoned down to multi- family. We had bought it as Commercial and paid accordingly. We discussed this matter with Mr. Berg and it seems it was zoned that way because it was rumored that we wanted to build town houses. This matter was brought before the commission and our land was then brought back to Commercial B-1 , which is my understanding less than B-2. Our letter from Mr. Berg of May 9, 1974 states it was re -zoned to B-1. My concern is if B-2 is more useful than B-1, then we sincerely feel we should be granted this also - which would prohibit spot zoning and bring our land back to it's original zoning when purchased. If everything around us is B-2 it would seem unfair. Also, could you please advise the zoning of the land adjacent to our land which is used for storage of junk cars. Is this not against the county ordnance- we have had persons lose interest in our land due to this. When our land was zoned B-1, we were told it was because the Board wanted to control what went in that area. Anything you can do to clarify this matter for us will be greatly appreciated. The location of the subject tract as the second off -ramp property in the Southeast quadrant of the I-81/Route 277 Interchange at Stephens City creates a natural demand for B-2 uses on this property. It should be noted that applicant is the owner of the land abutting the subject property on the East and South, a large portion of which is the subject of a current application for approval of subdivision plan ("Ridge Field" Subdivision) so that the fixing of the zoning in its proper classification at this time would seem appropriate before development and sale of lots from that parcel commences. By the same analysis, applicant feels that his other land adjacent Route 81 now zoned B-1 as well as the tract adjoining the subject property on the West should likewise be rezoned B-2. It is believed that the so-called Allen tract and applicant's other property adjacent thereto on the South now zoned B-1 were originally zoned for business use at a time when the Frederick County Zoning Ordinance contained no sub -classification dividing business use into B-1 and B-2 districts. At the time of the creation of those districts, it is believed no overall attempt was made to make a careful division of properties into the appropriate new districts.
