Lizer to operate a fruit stand on his property located on the north side of Route 50 West one mile west of Route 37 in the Gainesboro Magisterial District, said permit to'' be for a period of one year and shall cancel the previous permit for a bar-b-que restaurant on the premises. CUP 4012-78 - RONALD SMITH ET UX - GAINESBORO DISTRICT_- APPROVED Mr. Ronald Smith appeared before the Board in support of his request for conditional use permit for a dog kennel and stated that at the present time he has six dog runs and plans to construct approximately nine additional runs. He described the proposed expansion of the kennel building and spetic system. He advised that this would be a family business. The noise factor of such an operation was discussed and Mr. Smith stated that the dogs would be brought inside at night. Mr. Smith advised that his neighbors do not object to the proposed business. Addition to existing garage, 40' x 70'. Review Evaluation: Frederick -Winchester Health Department -- Satisfactory. Va. Dept. of Highways and Transportation -- Satisfactory -- existing entrances meet minimum standards. Zoning -- This application was made because the Omp's business (which is a lawful nonconforming use) cannot be expanded more than fifty percent (50%) unless they obtain a rezoning and become a conforming use. The proposed expansion will be greater than that allowed under the current zoning. Planning -- This is an existing business so there can be little impact, but more business may mean more inoperable cars and a more unsightly situation. Staff Recommendation: The staff recommends approval because this is an existing business and it is very similar to the County School Bus Shop which is nearby. It is further recommended that the rezoning be passed with the understanding that the site plan will require screening of inoperable vehicles. Purchaser assumes full responsiblity for furnishing seller (A) Adequate roadways to construction site, (B) Convenient and suitable area for storing of materials within 150 feet of construction site, and (C) If this proposal includes erection, free and unobstructed access within the building lines for efficient erection of steel. In default of Purchaser to so furnish the same, Seller may, in its discretion, do so and the expense thereof shall be added to and become a part of the total price of this contract. 13. Reasonable doubt on the part of Seller of Purchaser's financial responsibility shall entitle Seller to stop operations, decline shipment, or stop any material in transit, without liability, until Purchaser shall have paid for all material referred to in this proposal, or satisfied Seller of his financial responsibility. It is further agreed that Purchaser will pay all costs of collecting, or securing or attempting to collect or secure any indebtedness which may be due hereunder, including a reasonable attorney's fee, whether the same be collected or secured by suit or otherwise. Should Purchaser fail to make payment upon the terms designated by Seller, interest at the legal rate will be charged from maturity. 14. Purchaser warrants and represents that he owns the fee simple title to the premises where the building is to be constructed, and if Purchaser owns a lesser interest, Purchaser hereby agrees to (A) Advise Seller in writing as to the extent of his Interest in said premises and (B) Secure the approval, in writing, of the owner or other parties interested in said premises, for the improvements to be made under this proposal, all prior to the execution hereof. It is specifically understood and agreed that L&L BUILDERS shall have no liability whatever under any contract between Purchaser and other parties, unless L&L BUILDERS agrees thereto, in writing at the time of acceptance of proposal. 16. It is specifically agreed that claims for errors, shortages, imperections, deficiencies, etc., will not be entertained by Seller unless made within thirty days after receipt of goods, and Seller shall not in any event be liable for labor charges or consequential damages arising from the use of defective material.
