LIMITED (M-1). THIS PROPERTY IS DESIGNATED AS PROPERTY IDENTIFICATION

CONDITIONAL USE PERMITS:

Mr. Berg presented the conditional use permit request of Charles Lizer
stating that the Planning Commission.recommends approval of a one year permit
with the stipulation that the previous permit for a bar-b-que restaurant on the
premises be cancelled.
There was no opposition.
Upon motion made by Dr. Raymond L. Fish and seconded by Will L. Owings,
BE IT RESOLVED, That the Board.of Supervisors of the County of Frederick,
Virginia does herein approve CUP #010-7B of Charles W. Lizer to operate a
fruit stand on his property located on the north side of Route 50 West one
mile west of Route 37 in the Gainesboro Magisterial District, said permit to''
be for a period of one year and shall cancel the previous permit for a bar-b-que
restaurant on the premises.

CUP 4012-78 - RONALD SMITH ET UX - GAINESBORO DISTRICT_- APPROVED
Mr. Ronald Smith appeared before the Board in support of his request for
conditional use permit for a dog kennel and stated that at the present time
he has six dog runs and plans to construct approximately nine additional runs.
He described the proposed expansion of the kennel building and spetic system.
He advised that this would be a family business. The noise factor of such an
operation was discussed and Mr. Smith stated that the dogs would be brought
inside at night. Mr. Smith advised that his neighbors do not object to the
proposed business.
Mr. Koontz advised Mr. Smith that should the Board approve the permit on
a yearly basis, and subsequently receives complaints regarding the operation
of the business, they are not obligated to renew the permit and Mr. Smith

Location: Left hand side of Route 522 North -- Gainesboro District

Proposed Use and
Improvements: Service station and garage for general automobile and truck
repairs. Addition to existing garage, 40' x 70'.
Review Evaluation:
Frederick -Winchester Health Department -- Satisfactory.
Va. Dept. of Highways and Transportation -- Satisfactory --
existing entrances meet minimum standards.
Zoning -- This application was made because the Omp's business
(which is a lawful nonconforming use) cannot be expanded more
than fifty percent (50%) unless they obtain a rezoning and
become a conforming use. The proposed expansion will be greater
than that allowed under the current zoning.
Planning -- This is an existing business so there can be little
impact, but more business may mean more inoperable cars and a
more unsightly situation.
Staff Recommendation:
The staff recommends approval because this is an existing business and it is
very similar to the County School Bus Shop which is nearby. It is further
recommended that the rezoning be passed with the understanding that the site
plan will require screening of inoperable vehicles.
Planning Commission Recommendation: �V4

The dealer hereby agrees to furnish the above described materials and services. All work to be completed in a workmanlike manner according to standard
practices. Any alternation or diversion from above specifications involving extra costs, will be executed only upon written orders, and will become an extra charge.
Dealer shall not be liable for loss, damage, delay or failure of delivery. resulting from fire, strike, or civil commotion, casualties, delays in transportation, or any
cause beyond his control.
Purchaser -owner to carry fire, tornado and other necessary insurance.
In event of default in payment under the terms of this agreement, the purchaser -owner agrees to pay interest from completion date at the rate of 1'/z% per
month plus legal statutory attorney fees. Transfer of ownership occurs when full payment occurs.
This document embodies the entire agreement between the parties hereto.

This proposal is not a contract until accepted by an executive officer of L&L
Builders (Seller), and when accepted, it together with the general conditions of
contract on the reverse side hereof, constitutes the entire contract between
Buyer and L&L Builders (Seller). This proposal valid for 15 days from the
above date.
ITEMS AND CONDITIONS
1. When prices are for sturctures erected on concrete poured by others, Seller reserves the right to inspect and reject anchor
bolt settings. Additional charge will be made for any and all work required to correct improper anchor bolt setting.
2. By the acceptance of, and as part of the consideration for this contract, and in addition to the liens granted Seller by law,
Purchaser hereby irrevocable grants unto Seller the right of removal from the premises or property, with or without legal process,
any materials or buildings not paid for in accordance with the terms hereof, it being agreed that said building and materials,
regardless of the manner attached to real estate or property, shall remain personal property until paid for in full, and until full
payment purchaser hereby grants hereinafter referred to as L&L BUILDERS, its employees,
agents and assigns, license to enter upon the property where said materials or buildings are situated for the purpose of so removing
the same.
3. This proposal covers only items specifically set out. In the event of conflict between drawings and our bill or material,
only our listed material will be furnished. All other material furnished to be at extra charge.
4. Delivery and/or completion by L&L BUILDERS is contingent upon factory supplier, labor disputes, strikes, acts of God,
and other conditions beyond its control. L&L BUILDERS will not assume any liability or extra costs due to delays beyond
anticipated delivery and/or completion dates. No return of merchandise will be accepted without L&L BUILDERS prior approval.
5. When erection is part of contract,L&L BUILDERS agrees to see that erectors carry Workmen's Compensation insurance as
required by laws of the state where work is done. L&L BUILDERS agrees to carry Workmen's Compensation insurance and
comprehensive general liability, including property damage, and automobile liability covering work done by it. Certificates of
insurance coverage will be furnished on request. All other forms of insurance will be carried by purchaser, unless otherwise agreed
in writing.
6. After acceptance and approval of this contract by L&L BUILDERS the same cannot be cancelled without mutual
agreement of the parties and payment to L&L BUILDERS of all costs and expenses incurred by it in preparation under said
contract form date of acceptance through date of cancellation.
7. Stenographic or clerical errors are subject to correction.
8. This proposal is made for acceptance within thirty days from date on heading; after this time has elapsed Seller reserves
the right to revise price, if deemed necessary.
9. There exists no agreements or proposals, written or verbal, outside of this instrument and all changes or additions to this
contract shall be in writing.
10. Seller reserves the right to change design or make structural substitutions which do not materially affect the strength of
buildings covered under this proposal.
11. Seller assumes no responsibility for buildings which are loaded beyond the design for live and wind loads by unusual
conditions such as crane loads, bulk storage loads, etc., unless specifically mentioned in our proposal. Seller shall not be liable for
any defective conditions or failures in buildings caused by work done by other crafts, and Purchaser agrees to pay Seller for any
service calls Seller makes in connection therewith. Seller assumes no responsibility for damage to contents of building during or
after construction. Seller's liability extends only to the corrections of defects found in construction.
12. Purchaser assumes full responsiblity for furnishing seller (A) Adequate roadways to construction site, (B) Convenient and
suitable area for storing of materials within 150 feet of construction site, and (C) If this proposal includes erection, free and
unobstructed access within the building lines for efficient erection of steel. In default of Purchaser to so furnish the same, Seller
may, in its discretion, do so and the expense thereof shall be added to and become a part of the total price of this contract.
13. Reasonable doubt on the part of Seller of Purchaser's financial responsibility shall entitle Seller to stop operations,
decline shipment, or stop any material in transit, without liability, until Purchaser shall have paid for all material referred to in
this proposal, or satisfied Seller of his financial responsibility. It is further agreed that Purchaser will pay all costs of collecting, or
securing or attempting to collect or secure any indebtedness which may be due hereunder, including a reasonable attorney's fee,
whether the same be collected or secured by suit or otherwise. Should Purchaser fail to make payment upon the terms designated
by Seller, interest at the legal rate will be charged from maturity.
14. Purchaser warrants and represents that he owns the fee simple title to the premises where the building is to be
constructed, and if Purchaser owns a lesser interest, Purchaser hereby agrees to (A) Advise Seller in writing as to the extent of his
Interest in said premises and (B) Secure the approval, in writing, of the owner or other parties interested in said premises, for the
improvements to be made under this proposal, all prior to the execution hereof. Purchaser agrees to save Seller harmless from any
damages sustained because of title defects.
15. It is specifically understood and agreed that L&L BUILDERS shall have no liability whatever under any contract between
Purchaser and other parties, unless L&L BUILDERS agrees thereto, in writing at the time of acceptance of proposal.
16. It is specifically agreed that claims for errors, shortages, imperections, deficiencies, etc., will not be entertained by Seller
unless made within thirty days after receipt of goods, and Seller shall not in any event be liable for labor charges or consequential
damages arising from the use of defective material. In no event shall Seller's liability exceed the purchase price of the material. In
case any material furnished by Seller is not in accordance with this contract, it is understood that the Purchaser will immediately
discontinue its use and advise the Seller in writing of the facts in order that the Seller may have the opportunity of deciding what
shall be done in the circumstances so that possible loss or damage to either party shall be prevented or minimized. It is agreed that
no back charges will be accepted by Seller unless agreed upon in writing.
17. Purchaser agrees that it will be his responsibility to see that any buildings ordered from L&L BUILDERS meets local
codes or regulation. L&L BUILDERS guarantees that building meet the specific loads for models outlined in L&L BUILDERS
manuals and/or specified loads outlined on the face of this proposal.
18. Beneficial use and/or occupancy constitute acceptance as regards payment of the contract price.
