KIEi NT POLICIES i 7/21 The following sequence of events and policies are to be followed in amend- ing the Frederick County Zoning Ordinance as adopted November 1 1973. All Rezoning Applications will contain: 1. One (1) copy of application. 2. One (1) copy of plat of land to be rezoned with metes and bounds survey prepared by a licensed surveyor. Plat must show number of acres to be rezoned. 3. One (1) copy of a scaled location map (l" = 2000') that outline the land to be rezoned, prepared by a licensed surveyor. 4. One (1) copy of deed to the land. 5. One (1) copy of Rezoning Fact Sheet (attached). 6. Every application shall include proof that all property taxes due and payable to the County are paid and that no delinquent taxes are outstanding. 7. Every petition or application or reapplication for rezoning shall be accompanied by a fee in the amount of one hundred dollars ($100) plus one dollar ($1) per acre to cover costs of advertising and other expenses connected with the proces- sing of a petition or application or reapplication. 9. At the time of application the applicant shall post on the properties for which rezoning is sought, a sign at least 36" X 48" with full information on the change sought and the date, time and place of the Hearing by the Frederick County Plan- ning Commission. Such sign shall be placed at the property line and be main- tained so as to be legible. After the Planning Commission Hearing, the time and ` date shall be changed on the sign to correspond with the Hearing held by the Frederick County Board of Supervisors. 9. The Planning Commission will hold at least one (1) Public Hearing on such pro- posed amendment. Upon completion of its work, the Commission will present the proposed amendment to the governing body together with its recommendations and appropriate explanatory materials. Before approving and adopting any amendment, the governing body will hold at least one (1) Public Hearing. 0. All N hiENT POLICIES The following sequence of events and policies are to be followed in amend- ing the Frederick County Zoning Ordinance as adopted November 1, 1973. All Rezoning Applications will contain: 1. One (1) copy of application. 2. One (1) copy of plat of land to be rezoned with metes and bounds survey prepared by a licensed surveyor. Plat must show number of acres to be rezoned. 3. One (1) copy of a scaled location map (1" = 2000") that outline the land to be rezoned, prepared by a licensed surveyor. 4. I (WE), THE UNDERSIGNED, DO HEREBY RESPECTFULLY MAKE APPLICATION AND PETITION THE GOVERNING BODY TO AMEND THE ZONING ORDINANCE AND TO CHANGE THE ZONING MAP OF COUNTY OF FREDERICK, VIRGINIA AS HEREINAFTER REQUESTED, AND IN SUPPORT OF THIS APPLICATION, THE FOLLOWING FACTS ARE SHOWN: 1. The property sought to be rezoned is located In Shawnee District, on the northern side of Virginia State Secondary Highway #728. The property consists of two parcels of 5 acres each. 914.51 & It has a frontage of 535.86 feet and a depth of 757.81 feet and consists of 10 acres. The two 5-acre tracts are designated as #1 and #4 on the final plat of the former Edmonson estate prepared for J.I.C. Limited by Richard U. Goode, and dated Oct. 26, 1976. 2. The property sought to be rezoned is owned by J.I.C. Ltd. as evidenced by deed from Spectrum Properties, Inc. recorded in _Book 464 Page 395 Registry of County of Frederick This property is designated as Parcel No. 80 on Tax Map No. 64 (Note: Numbers may be obtained from the Office of Commissioner of Revenue.) 3. It is desired and requested that the foregoing property be rezoned: FROM M-2 TO M-1 The 10 acres under consideration were part of 20 acres which were rezoned from M-1 to M-2 in 197 4-; the other 10 acres (Tracts #2 & 3) were rezoned back tto M.-1 in June, 1977. 4. It is proposed that the property will be put to the following use: (on Tract #4) (1) Tire storage warehouse; (2) Rental warehouse; (3) Office; (4) Mechanical repair building with repair bays; (5) Truck and farm tire repair shop with canopy; (6) Retread shop; (7) Equipment company; (8) Retail tire store.
