AMENDMENT POLICIES O
The following sequence of events and policies are to be followed in amend-
ing the Frederick County Zoning Ordinance as adopted November 1, 1973.
All Rezoning Applications will contain:
1. One (1) copy of application.
2. One (1) copy of plat of land to be rezoned with metes and bounds survey prepared
by a licensed surveyor. Plat must shoe,,7 number of acres to be rezoned.
3. One (1) copy of a scaled location map (1" = 2000°) that outline the land to be
rezoned, prepared by a licensed surveyor.
4. One (1) copy of deed to the land.
5. One (1) copy of Rezoning Fact Sheet (attached).
6. Every application shall include proof that all property taxes due and payable to
the County are paid and that no delinquent taxes are outstanding.
7. Every petition or application or reapplication for rezoning shall be accompanied
by a fee in the amount of one hundred dollars ($100) plus one dollar ($1) per
acre to cover costs of advertising and other expenses connected with the proces-
sing of a petition or application or reapplication.
8. ,At the time of application the applicant shall post on the properties for which
rezoning is sought, a sign at least 36" X 48" with full information on the change
sought and the date, time and place of the Hearing by the Frederick County Plan-
ning Commission. Such sign shall be placed at the property line and be main-
tained so as to be legible. After the Planning Commission Hearing, the time and
date shall be changed on the sign to correspond with the Hearing held by the
Frederick County Board of Supervisors.
9. The Planning Commission will hold at least one (1) Public Hearing on such pro-
posed amendment. Upon completion of its work, the Commission will present the
proposed amendment to the governing body together with its recommendations and
appropriate explanatory materials. Before approving and adopting any amendment,
the governing body will hold at least one (1) Public Hearing.
10. Every application for rezoning shall show the names and 14AILING ADDRESSES of all
individuals, firms, or corporations owning property adjacent to both sides and
rear and the property in front of (across street from) the property sought to be
rezoned. (See Item 4 on application form.)

Adjoining
Land Use: Adjoining land is open, the lot to the West is zoned B-2 by
WB Properties, Inc.
Natural Environment
Geology: Shale and Sandstone
Soil: Dekalb - Weikert
These have severe limitations for septic tank usage, as this
developer has discussed.
Water: The bank building site is not in the identified flood hazard area.
Public Facilities
Highway: Adequate right-of-way, the entrance is Highway Department approved.
Utilities: Septic tank and well are Health Department approved.
Yard
Regulations: All requirements may be met.
Previous Zoning
Actions: The lot to the West was zoned B-2 in July, 1974.
Land Use Plan: Agricultural/Forestry/Open space District
Gore is not a community center due to the flood hazard problem.
Staff Comment:
This application should be approved so that the lot already zoned -- which will not
pass health inspection - can be used for the bank.

tract known as the Dr. S. J. Smith Home Farm and also sometimes
known as the M. C, Garvin Farm which was devised under the j

probated and of 'record in the Office of the Clerk of the Circuit

11,'to Ivon T. Anderson (same as Ivan Anders and Ivan Anderson
as referred to therein), with remainder in fee simple to his

This conveyance is made subject to all legally enforceable

VHEREAS, the above described property, is Subject
certain deed of trust to Joseph B. Newlin, Trustee, securing
the party of Lhe fourth part, and of record in the aforesaid
Clerk's Office in Deed Book 288, at Page 740; and,
WHEREAS, the said Trustee, Joseph B. Newlin,'is deceased;
and,
WHEREAS, the party of the fourth part, being the sole
beneficiary under the said deed of trust, has constituted and
appointed Dabney W. Watts as Substitute Trustee of the said

11, to Ivon T. Anderson (same as Ivan Anders and Ivan Anderson
