Brown 1.489 Acres zoned A-2 (Agricultural -General) to be rezoned to B-2 (Business -General) LOCATION: Southwest corner of U.S. 11 North and Route 672. MAGISTERIAL DISTRICT: Stonewall Magisterial District ADJACENT LAND USE AND ZONING: Residential, commercial, industrial, and agricultural land use and commercial, industrial, and agricultural zoning. PROPOSED USE AND IMPROVEMENTS: To be rezoned to B-2 (Business -General), expansion of existing commercial use. REVIEW EVALUATIONS: Virginia Dept. of Highways and Transportation - No objection to rezoning. If the owner wants to add a service station it is the opinion of this office that the nature of this business is changing; therefore a commercial entrance permit should be applied for and approved. Health Department - Present drainfield inspected 4-14-82 and appears to be functioning in a satisfactory manner. Owner is of opinion if gas pumps are installed, most of the business will be local. Health department has no objection. Owner indicated intention to install water saver plumbing devices. Department of Inspections - No objection to this rezoning of this property from A-2 to B-2. The buildings and facilities would be Use Group "B" Business, Section 204 of the Uniform Statewide Building Code. The buildings and underground fuel tanks storage and pumps would have to meet these regulations. Planning and Zoning - This property is presently being used for a commercial use as a restaurant and small grocery store. This use is allowed under the nonconforming clause under the zoning ordinance and has been in existence for quite some time. In the past, prior to the enacting of the zoning ordinance of 1973, their had been pump islands for the pumping of gasoline at this location. There is no other reasonably possible use of this property except for commercial purposes and therefore, regardless of any rezoning action the property will most likely continue to be used as a commercial property. Brown Page Two Adjacent zoning to the west of the property is currently B-2 and immediately across the corner of Route 11 to the northeast is M-1 zoned property and immediately to the north of this property across Route 672 is an existing commercial use which is also applying for B-2 zoning. Given the existing commercial and industrial land use in the area and the role that Clearbrook is playing as a commercial center for this area of Frederick County, there would seem to be no conflict between existing policies on zoning and the granting of a B-2 zoning for this property. The location of other commercial uses allowed in a B-2 zoning district on this property would be acceptable if all improvements are made to the property to handle these other commercial uses. The staff sees no additional impacts on the neighborhood from the rezoning of this property as the established pattern in the area is for a commercial and industrial center. Any activity which distracts from these objectives should be limited to the minimum consistent with effective performance of administrative functions which are secondary obligations of the Commission and its staff. Proposals for minor zoning amendments fall within this secondary category. An inordinate number of these involve spot zoning, which has the following characteristics: 1. Individuals seek to have property rezoned for their own private uses. 2. Usually the amount of land involved is small and limited to one or two ownerships. 3. The proposed rezoning would give privileges not generally extended to property similarly located in the area. 4. Applications usually show little or no evidence of, or interest in, the effect on surrounding property, whether all uses permitted in the classification sought are appropriate in the location proposed, or conformity to a comprehensive plan or to comprehensive planning principles. The following policy is, therefore, adopted by the Planning Commission. No proposed zoning amendment will receive favorable recommendation unless: 1. The proposal will place all property similarly situated in the area in the same category, or in appropriate complementary categories. 2. There is convincing demonstration that all uses permitted under the proposed district classification would be in the general public interest and not merely in the interest of an individual or small group. 3. There is a convincing demonstration that all uses permitted under the proposed district classification would be appropriate in the area included in the proposed change. (When a new district designation is assigned, any use permitted in the district is allowable, so long as it meets district requirements, and not merely uses which applicants state they intend to make of the property involved.) 4. There is convincing demonstration that the character of the neighborhood will not be materially and adversely affected by any use permitted in the proposed change. S. The proposed change is in accord with the comprehensive plan and sound planning principles. This policy shall be called to the attention of persons applying for what appear to be spot zoning changes in order to alert them to the tests which will be applied, and to minimize time spent by the Commission in consideration of applications which cannot meet these tests.
