LOCATION: Route 11 North, just before Stine Lane and just after Lee Avenue
MAGISTERIAL DISTRICT: Stonewall
ADJACENT LAND USE AND ZONING: Industrial, commercial, and open space land use and
M-1 and M-2 zoning
PROPOSED USE AND IMPROVEMENTS: Accessory warehousing for restaurant office.
REVIEW EVALUATIONS:
Virginia Dept. of Highways and Transportation - No objections to rezoning,
however, it is understood that a commercial entrance permit must be applied
for and approved.
Sanitation Authority - No comment.
Inspections Department - All structures to be built in conformance with the
Virginia Uniform Statewide Building Code.
Clearbrook Fire Company - No comment.
Planning and Zoning - It is the understanding of the staff that Mr. Aikens
would like to acquire this property and use it for accessory warehousing for
his existing construction office and restaurant office. Those offices are on
the adjacent property to the north and are nonconforming office uses in an
existing M-2 zone. The applicant has chosen to request the B-2 zoning in
order to avoid the necessity for a 75' setback from Route 11 North and some
setback requirements from adjacent property lines.
While the staff has no particular objection to the B-2 zoning, this property
would be a small area of B-2 commercial zoning surrounded by industrial
zoning and uses. Should the property be rezoned to an industrial category,
the applicant would be able to build approximately 8,000 square feet of
warehouse area on the tract meeting the requirements of the zoning ordinance

for the industrial setbacks. This warehouse would be then required to be
near the northern and western portion of the property. If the property is
rezoned to B-2, a larger area of the tract would be available for coverage by
structures and impervious surfaces and those structures could be within 35'
of the right-of-way of Route 11. If the property is rezoned B-2, the
warehousing to take place on this site would have to be solely warehousing
for the construction and restaurant business located on the adjacent tract
and this tract would have to be combined with that tract in order for that
storage to be termed accessory.
This area of Route 11 North is characterized by a mixture of B-2 and
industrial zoning. Approximately 200' to the south of this tract is a B-2
zone for a gas station and Weber's Nursery and across the street and to the
north of this property are B-2 zones for a restaurant and retail business.
The staff would, therefore, not feel that this B-2 zoning would constitute
spot zoning in this particular situation in that this area of Route 11 North
is already characterized by a mixture of industrial and commercial zoning.
STAFF RECOMMENDATIONS: Approval.

parties of the first part hereinafter referred to as the Grantors; and Robert
