Cutshaw 3.58 acres zoned B-2 (Business General) to be rezoned to M-1 (Industrial Limited) LOCATION: Route 11 North at Allied Wood Products MAGISTERIAL DISTRICT: Stonewall ADJACENT LAND USE AND ZONING: Residential, Institutional, and Industrial Land Use and A-2 Zoning. PROPOSED USE AND IMPROVEMENTS: A 50' X 130' addition to the existing facility for lumber processing. REVIEW EVALUATIONS: Highway Department - No objections to rezoning, however, a Commercial Entrance Permit will be required as the existing entrance is sub -standard. Health Department - The present system is adequate for proposed use. -- The Health Department has no objection to proposed rezoning. Inspections Department - Proposed building to be built in accordance with current edition of the Virginia Uniform Statewide Building Code. Clearbrook Fire Company - No comment. Planning and Zoning - This property is located in an area designated for rural development under the Frederick County Comprehensive Plan. That designation was placed in this area primarily due to the fact that both public water and sewer were not both available. There is public water available along Route 11, however. There has been in the past and continues to be considerable development taking place along Route 11 North. Route 11, which is classified as a minor arterial highway under the Highway Department's Functional Classification System, is characterized by a very diverse mix of residential, commercial, industrial, and agricultural uses. The Board of Supervisors has in the past rezoned a number of properties along this highway for industrial use. As the 1 Page 2 Cutshaw Rezoning enclosed zoning map will show, there is industrial zoning on the west side of Route 11 to the south of this property and both sides of Route 11, to the north of this property. There is also retail commercial zoning on the east side of Route 11, north of this property. The applicant proposes to use this property in conjunction with an existing, nonconforming sawmill and lumber operation which is located immediately to the north of the property. That use has grown into an extensive industrial use employing a number of people. While this property was zoned for retail commercial use in the past, it is the staff's understanding from the applicant that his retail use of the property now is very limited and would be eliminated should the property be rezoned. At that time, the use of the property would be for manufacturing processes in conjunction with his lumber operation and offices for this use. The existing post office would become a nonconforming use should the property be rezoned and would be allowed to continue. STAFF RECOMMENDATIONS: Approval. This recommendation is based on the fact that this property is currently being used in conjunction with an extensive industrial operation adjacent to the north; would not set a precedent for urban -type zoning in an area that had not previously seen such zoning and therefore, would not constitute spot zoning; and would not increase the physical impacts appreciably on surrounding properties in that the existing use of the property to the north would continue at any rate. NOTE: The staff would propose that the Rural Community Center for the Stephenson/ Clearbrook area take into account the extensive amount of urban -type commercial and industrial zoning located in this area.
