Stossel 40,000 square feet to be rezoned from RP (Residential Performance) to B-2 (Business General) LOCATION: Valley Avenue in Kernstown, North of F&M Bank, near the GE Plant on Route 11 South. MAGISTERIAL DISTRICT: Back Creek ADJACENT LAND USE AND ZONING: Business and residential land use and B-2 and RP Zoning. PROPOSED USE AND IMPROVEMENTS: Office, sales, service, and repair for computer business. REVIEW EVALUATIONS: Highway Department - No objection to rezoning; however, a commercial entrance permit must be applied for and approved prior to opening of the business. Health Department - Septic system repaired June 1958. Age and size of system require limiting the water useage. Health Department recommends gallon - flush toilets and new sewer line to tank. Occupancy to be limited to five employees. Sanitation Authority - City will provide water service. City of Winchester - City 24" water main located in front of property and a water service connection is available subject to County approval. City sewer is not available. Inspections Department - Building must be in compliance with the Virginia Uniform Statewide Building Code and American National Standard Specifications for making buildings and facilities accessible to and useable by physically handicapped people, ANSI A117.1-1980. Stephens City Fire Company - No objection. Page 2 Stossel Rezoning Planning & Zoning - This property is adjacent to commercial zoning on the south and east and residential zoning on the west and north. The west side of Route 11 South in this area could be characterized as a transitional area with a mixture of older residential areas and small scale commercial uses. The residential use adjacent on the north also houses a kennel, along with the residence. The staff would anticipate that small scale rezonings for commercial use will continue to be proposed in this area. This is due to its greater relative attractiveness and value for commercial, as opposed to residential use. When and if public sewer facilities are extended to the area, this conversion pressure will probably accelerate. The proposed use of this property, as noted on the application, should have minimal impacts on the residences to the north and west. More intense commercial use, which would be allowed under this zoning would, however, have more impact. These impacts could be mitigated, to some extent, through the site plan process. STAFF RECOMMENDATIONS: Approval; due to the transitional nature of the area and the minimal impacts of this proposal. PLANNING COMMISSION RECOMMENDATIONS: Unanimous approval.
