Supervisors' action at their meeting of November 14, 1984.
The Frederick County Board of Supervisors has approved Rezoning
Application #009-84 of Richard G. Hardison and Ralph S. Gregory
to rezone 63.551 acres from A-^c (Agricultural General) to M-1
(Industrial Limited), B-2 (Business General), and B-3 (Industrial
Transition) fronting on ROL(t,e 11, 1/4 mile south of Route 37 and
west of I-81 in the Back Creek. Magisterial District.

63.551 acres to be rezoned from A-2 (Agricultural General) to
M-1 (Industrial Limited), B-2 (Business General), and B-3 (Industrial Transition)
LOCATION: Fronts on Route 11, 1/4 mile south of Route 37 and west of I-81.
MAGISTERIAL DISTRICT: Back Creek
ADJACENT LAND USE AND ZONING: Agricultural, residential, commercial, and
institutional land use and commercial and agricultural zoning.
PROPOSED USE AND IMPROVEMENTS: Air Freight Trucking Terminal
REVIEW EVALUATIONS:
Highway Department - No objection to rezoning; however, a commercial entrance
permit must be applied for and approved if a business is proposed.
Health Department - Do not recommend rezoning without central sewage disposal
provisions due to the amount of limestone rock outcrops and clay soil in the
area.
Sanitation Authority - Water is readily available to the site. Sewerage
service is available from the Lakeside Treatment Plant. Capacity is limited
due to the infiltration and inflow problem. This problem is projected to be
resolved in eighteen months. This site requires pumping of wastewater into
the gravity service area of the Lakeside Plant and thus is subject to
approval by the Board.
Inspections Department - No objections to rezoning.
Stephens City Fire Company - No objection to the rezoning, but respectfully
request that a study be conducted now to determine how adequate water, for
fire protection, will be provided for the future occupant fire loads for the
various proposed sites.

Planning and Zoning - Based on the Health Department and Sanitation Authority
comments, the staff would like to express the following concerns. It is the
understanding of the staff that the initial and only definite proposal for
use of this property would be for the location of Air Freight Delivery
Service on a portion of the property to be rezoned to M-1. It does not
appear that the Health Department would be in favor of this rezoning without
central sewage disposal at that site. It also does not appear that the
Sanitation Authority will be prepared to provide central sewage disposal
facilities to this property until its infiltration and inflow problems are
solved at the Lakeside Treatment Plant. A packaged treatment plant for the
use of the Air Freight Delivery Service would not be economically feasible in
the opinion of the staff. Based on these above facts, it would appear that
there in fact is no feasible proposal for the use of this property at this
time. In the opinion of the staff, a rezoning of this property at this time
would be speculative.
It would appear that the provision of central sewage disposal facilities to
this site will be feasible in the future and if these facilities would be
provided to this site with sufficient excess capacity to serve remaining land
in the Kernstown interchange area, it would be of significant economic
benefit to Frederick County. It would appear to the staff that the central
issue in this rezoning is whether the Commission feels that rezoning of the
property at this time is premature due to the fact that there does not appear
to be any actual feasible method of developing the property at this time. If
the Commission feels that it is premature, then in the staff's opinion, the
Commission should deny the rezoning,. If the Commission feels that the
rezoning is not premature, then it would appear that within eighteen months
to two years that development of this property would become feasible. At
that time, there would be a significant economic benefit to the development
of this property in conjunction with other properties in the Kernstown area
and therefore, the Commission, in the opinion of the staff, should approve
the rezoning.
STAFF RECOMMENDATIONS: Denial, due to the fact that, in the staff's opinion,
rezoning is premature.
PLANNING COMMISSION RECOMMENDATIONS: Approval by the following majority vote:
YES: Messrs. Stiles, Kirk, DeHaven, Golladay, Brumback and Mrs. Copenhaver

THIS DEED made and dated this J/sr day of
1961, by and between S. L. Shackelford, widower, S. Herbert Shackelford
and Madge H. Shackelford, his wife, and Earl W. Shackelford and Kathleen
A. Shackelford, his wife, parties of the first part, and Virginia M. Shackel-
ford, single, party of the second part.
WHEREAS, by deed dated December 2, 1936, of record in the
Frederick County Circuit Clerk's Office in Deed Book 172, at page 575, S. L.
Shackelford, who is the same person as Stanley L. Shackelford, and Inez
Shackelford, his wife, each acquired from Bessie C. Pitman and J. E. Pitman,
her husband, a one-half undivided interest in the property described in said
deed as containing 213-1/2 Acres on the East side of U. S. Route 11 in Frederii
County, Virginia, near Kernstown; and
WHEREAS, the State Highway Commission of Virginia subsequently
acquired for Interstate Route 81 a strip of land through said property, more
particularly described and shown on State Highway Plat Book 2, at pages 388
and 389, in the aforesaid Cleic's Office, leaving approximately 64 Acres on
the West side of the said Interstate Route 81 and 113 Acres on the East side
thereof; and
WHEREAS, Inez Shackelford subsequently died intestate, a resi
of Frederick County, Virginia, on the 17th day of July, 1961, survived by
her husband, S. L. Shackelford, one daughter, Virginia M. Shackelford and
two sons, S. Herbert Shackelford and Earl W. Shackelford; and
WHEREAS, S. L. Shackelford desires to give his one-half undivide
interest in the hereinafter described property as well as his life estate in the
remaining one-half interest in said property to the Grantee, and the remainin
Grantors desire to convey unto tho Grantec all of their interest.in said pr..opq
in exchange for other property from the Grantee;
NOW THEREFORE THIS DEED WITNESSETH: That in consideratii
of the love and affection which S. L. Shackelford bears to the Grantee and the

sum of One Dollar ($1.00), the receipt of which is hereby acknowledged, and
in consideration of the sum of Ten Dollars ($10. 00) and other good and
valuable consideration paid to the other Grantors, the receipt of all of
which is hereby acknowledged, the parties of the first part do hereby grant,
bargain, sell and convey, with general warranty of title, unto the party of
the second part, the following described property:
All that certain tract of land containing approximately 64 Acres
remaining from the aforesaid conveyance on the West side of Interstate
Route 81, together with all personal property contained thereon.
Reference is here made to the aforesaid deeds and plats and the
reference therein contained for a further and more particular description
of the property hereby conveyed.
This conveyance is made subject to all duly recorded and enforce-
able restrictions, easements and rights of way.

Frederick County Planning Commission.
Dear Sir:
I understand that a rezoning request will be comming
before the Planning Commission for the Shackelford land on
Rt. 11 south of Kernstown. The area along Rt.11 from Barton-
sville to Rt. 37 has a lot of potential and is one of the few
areas that is left to be developed along Valley Pike. This
particular area has already been blemished with the Horton
enterprise and I feel that the commission could have donea
better job in planning this property.
The D.r:.V. is a nice locking office building and a very
expensive building,and I understand that a church is being pla-
nned on the adjoining property. I would hope that the Planning
Commission will give a lot of thought in planning the develop-
ment of this land which is visible from both Rt.11 and I 81 also
the fact that sewer is not available at this time should be
taken into consideration.
We should not trade beauty for tax base this has been
done many times in the past.
