5.409 acres to be rezoned from
B-2 (Business General) to B-3 (Industrial Transition)
LOCATION: Route 11 South, between Kernstown and Route 37.
MAGISTERIAL DISTRICT: Back Creek
ADJACENT LAND USE AND ZONING: Commercial, residential, and
industrial land use and commercial, residential, and industrial
zoning.
PROPOSED USE AND IMPROVEMENTS: Modular and Mobile Home Sales and
Parts. Construction of a 40' X 50' building for parts and repairs.
REVIEW EVALUATIONS:
Virginia Dept. of Highways & Transportation - No objections.
Health Department - No objections; owner has stated that there
will be no additional employees.
Department of Inspections - No objection to the rezoning. Any
buildings erected on this site must conform to the Virginia
Uniform Statewide Building Code.
Roundhill Fire Company - No comment.
Planning and Zoning - The property on which this rezoning is
proposed is currently zoned B-2 (Business General), but is
currently being used for mobile home and modular home sales.
That use is a nonconforming use under the Frederick County
Zoning Ordinance and would be allowed to continue in the
future. The current zoning does, however, limit the amount of
expansion of the existing structures on the site and therefore,
Mr. Fowler is requesting this rezoning to allow him to expand
on this site in the future.

Don Fowler Rezoning
The zoning and land use on the east side of Route 11 South is a
diverse mixture of commercial and industrial zoning in this
area. There are very few residences on the east side of Route
11. The proposed B-3 zoning on the east side would be
compatible with surrounding uses in that it would act as a
transition zone between existing industrial and existing
commercial zoning on this side of the road. The west side of
Route 11 South does have a number of existing residential uses
and residential zones. Immediately across the street from this
proposed use is the entrance to Plainfield Heights which is an
existing residential zone and residential use. The frontage
lots in Plainfield Heights, however, are used for retail -
commercial business and those lots would be the lots
immediately effected by any proposed zoning change. There are
a few other existing residential structures along Route 11
which would front against this use.
Due to the fact that this use is now a nonconforming use and
would be allowed to continue under the existing zoning, the
rezoning to B-3 would not have an additional significant impact
on the neighborhood. The B-3 zoning is, at any rate,
compatible with the surrounding properties and can stand on its
own merits.
STAFF RECOMMENDATIONS: Approval.

the Grantors and THOMAS J. CHASLER, of Winchester, Virginia,

years from date, in the principal sum of One Hundred Thousand

balance, until paid, made by the Grantors and by Fowler's
