identified by the above PN and address. You were originally notified of this violation by a hand
delivered letter which I gave to you when you visited our office on .lure 1, 1998.
As you: aiready know, the property identified. by the above PIN was rezoned from A-1 (Agriculture)
to B-2 (Business -General) -District by-Shiriey-Meade in-1982. You- have atwa-acre parcel of land,
as did she back in 1982. Of this two acres, only half an acre (.5) was zoned B-2. The remaining -
part of the- }and' is- still. RA (Rural Areas), which replaced the A-1 Zoning District. This office has
determined that the .5 acres are located along Route 50 from Twine Lane to the western property
line. T.he-depth. of the B&2-starts at the edge of the right;--of-way for Route 50 and ends directly:
behind the original building along Route 50, where the office and the gift shop are currently
located.
Therefore, it is this office's determination that the garage in violation was built in the RA Zoning
District.. Auto repair is only allowed in the RA Zoning District witha conditional use permit. If you
continue to.aliow auto repair- in the -new building, then, you will ba.vidating:the Frederick County
Zoning Ordinance -

April 15, 1982
A revisit was made to the Shirley Meade property on April 149 1982
concerning locating suitable soil to permit the installation of a sewage
system to serve a proposed restaurant. Although a small area has been
located on adjoining property, for which an easement could be obtained,
I have not located enough suitable soil on which to accommodate the res-
taurant. This information was relayed to her father with the stipula-
tion she may want to employ a backhoe to check soils further, as I had
much difficulty in drilling test holes on part of the property because
of sandstone rock in the subsoil.
I have not heard further from Mrs. Meade at this time.

Dear Mr. Horne:
A revisit was made to the Shirley Meade property on the above date
by the undersigned. The property is located on Route 50 West at the
state line.
Several backhoe pits were dug on adjacent property, located in
West Virginia, and soil conditions were found suitable for the in-
stallation of a drainfield-sewage system to serve a proposed twenty-
five (25) seat restaurant facility. Mrs. Meade must obtain a deed
of easement onto adjoining property before a permit can be issued.
I have contacted Mr. Bright, Hampshire County, West Virginia
Sanitarian, and if a permit is issued, will be a joint effort be-
tween both states, as the proposed system installation will cross
the state line.
If I may be of further assistance to you in regard to this
matter, please feel free to contact me at your convenience.

I have reviewed the sewage permit and records for the Shirley Meade
property, located adjacent to the State Line on U. S. Route 50-West.
There is only 900 square feet of drainfield in the present system. We
base sewage disposal system designs for restaurants on a minimum of 50
gallons per seat, therefore, if the present system was used exclusively
for a restaurant, the maximum seating allowed would be eight (8). Also,
a new well to meet Non -Community Waterworks Regulations would be neces-
sary. Based on my previous knowledge of soil conditions on her property,
I would feel that finding enough suitable soil in which to install the
required sewage disposal system would be very difficult. However, she
does have the right to request an up to date evaluation by contacting
the Frederick -Winchester Health Department.

Gentlemen:
Concerning the application of Shirley Meade to be rezoned
from A-1 to B-2. This letter is my attorney and it doesn't cost
as much as a live attorney. Let's go back to the days of yester-
year, namely; a letter of October 15, Y'80, copy of which is enclosed.
Teddy Roosevelt once said, "to speak softly and carry a
big stick". I don't agree 1.rth that because I carry no stick and
I speak loudly. I want to know what Mrs. Shirley I•ieade is up to
because lies have short legs and they don't go far. If this rezoning
from A-1 to B-2 passes it will show in later years as a dereliction
of judicial duty by this Board that I am addressing.
Lest I forget, the date July 2, 1980, is the historical
date that the curse of Gni-Gni was placed upon the Meades. This
curse also applies to those that have degraded my character, that
have humiliated me, have twisted the law to benefit themselves.
Only God has the antidote to obsolete the above curse. Being a mortal
I can't do it. Let no man, Homan or child think or say that I am an
outsider. Everyone reading this letter in this room, and everyone
in these United States is an outsider, except the American Indian.
Going back to the subject at hand, namely; the rezoning
possibility. The one year has passed since Shirley Meade set up
her house trailer camp, without getting a permit. Has she paid the
$75.00 per month fine? Some people read their bank books but they
don't read the good books. With that thought in mind is there
anyone there with any acumen that would know that one of the 5
trailers at the Meade trailer Park is setting on State of Virginia
land, or is it because these trailers are set on the last land before
entering Hell.

I can't understand why at this late date a. change has been
asl;.ed, from Agricultural-1 to Business-2 when in fact, legally or not,
Brady Meade, one of her beloved former husbands has a trailer truck
depot adjoining the Shirley Meade house trailer park and her gift
shop. I again ask the question, do crooked lawyers make crooked
people, or vice versa, and so I, in closing, emphatically oppose
this rezoning approach.

Reference is made to your letter of March 5, 1902 and if
you place before you copy of the letter I mailed dated March 1,
1982 I will make myself known to you.
Mr. Sluder was convinced by the Meades that I was pumping
sewage on two separate occasions, according to your March 5th
letter. Now it can be told. I was using a pump to pump, not sewage
as suspected, but surface water from rain and melting snow. If Mrs.
Meade would listen to her former husband she would know that that
was not sewage. It is a low spot that gathers water, which Mr.
Sluder did not investigate. Before going further I think Mr. Sluder
should be replaced because he has been on the job so long that he
has become part of the landscape.
Now then, again referring to the March 1 letter that you
have before you, if you note on Paragraph 3 you sent me no answer to
the question asked. 0n Paragraph 4 I asked the question which is
in the sentence "I got in touch originally, and I would now want to
know is it legal to have a septic outlet under a road that is using
heavy traffic?" Another question asked in the same Paragraph "When
was the septic tank inspected?"
Lest I forget, I have a letter sent to me by Dr. 14alcolm
Tenney, Jr., And Regional Medical Direct or, Stalwnton, 'Tirginia,
concerning the wash water discharged by Mrs. Shirley Ann Meade. In
the letter they presume that the problem has been corrected. ---he
problem has not been corrected and I do want it corrected, and the
only way it will be corrected is to dig up the pipe that is covered
up that em-oties the .rater into the culvert. Mr. Bradley Pugh of the
State Highway Department knows about it. May I suggest to you that
there is a conspiracy to brea'r the law in this section of Frederick
County. If you will excuse the pun; when I give directions to
anyone that is East of Gore I tell them "we live in the last

building, which is the last stop before hell't, because once you
cross the State Line into West Virginia that's where one is. I do
not want to be repetitious by telling you I was persecuted five
times in West Virginia but I-'ll say this, we had our land surveyed
and is now recorded in Frederick County and in Hampshire County.
We are indeed living and paying taxes in Virginia. I want these
matters taken care of. I had shed the yoke that I was put in by
the West Virginia authorities.
I do have a Virginia lawyer that is to take care of a
couple of other matters concerning the sewage system. As you
knOw it costs money to speak to a lawyer and I try to avoid being
in speaking terms with any lawyer because of the money involved.
A word. to the wise is sufficient. Send someone for an instiection
but don't send Mr. Sluder. Mr. Sluder is persona non grata.

and Shirley A. Meade, of the other part, hereinafter called the
Grantee.
WITNESSETH: That for and in consideration of the sum
of Ten Dollars ($10.00), and other valuable consideration receipt
whereof is hereby acknowledged, the Grantors do grant and convey
unto the Grantee an easement for the construction, use and
maintenance of a sanitary septic and drain field over the land
of the Grantors for a period of Twenty (20) years. Such systems
to be used by the Grantee as a sewer system for the property
adjoining the Grantors on the East and to be approved by the
Frederick County Health Department. Grantee agrees that it will
at all times maintain such sanitary system as required by the
Health Department of Frederick County.

to B-2 (* siness-General).
The Secretary gave the background information.
Mr. Horne read the letter submitted by Mr. Herbert Sluder of
the Health Department.
Mr. Sluder stated that the area referred to in the letter is
that of the adjoining property owner. He stated that after putting
together a soil analysis, he felt there was not enough area for a
suitable drainfield to accomodate a restaurant. Mr. Sluder stated that
as of this time he does not have a drainfield site, but if Mrs. Meade
would get a backhoe in to dig deeper holes there may be a possibility
of finding a suitable site.
Mrs. Meade came forward and stated that she would get a
backhoe in if it was necessary.
In answer to Mr. DeHaven's question, Mr. Sluder stated that
the drainfield would be in West Virginia. He added that he would have
the authority in that area to enforce the correction of any violation.
Mr. Myers stated that the staff feels this rezoning should be
denied for reasons other than Health Department comments.
Chairman Brumback next inquired if there was anyone in the
audience who wished to speak in favor or opposition to this request.
There was no one present wishing to speak.
Mr. Golladay next read from the ordinance a list of
establishments allowed in a B-2 zone.
fir. Golladay felt that the Commission could not act on this
request until it was determined if Mrs. Meade could find adequate

drainfield on the property and a definate comment was received by the
Health Department.
Mr. DeHaven asked Mrs. Meade what type business she had on
the property at the present time. Mrs. Meade replied that it was a
small gift shop.
Mr. DeHaven felt that this was not a spot zoning case since a
business has been in this location for 20 years.
In answer to Mr. Myet.'s question, Mrs. Meade stated that the
four trailers on her property were residences of her children.
Mr. Golladay read the Commission's Spot Zoning Policy adopted
on July 6, 1980, and amended September 3, 1980. He then read the
Commission's policy regarding the completeness of an application being
submitted for review by the Planning Commission, adopted March 18,
1982.
There next ensued a discussion on the suitability of this
area being rezoned to B-2 (Business -General).
Mr. Myers next moved to deny this rezoning request based on
the recommendations given by the staff.
This was seconded by Mr. McDonald.
The vote died due to a tie vote as follows:*
YES: Messrs. McDonald, Myers, Brumback, Kirk
NO: Messrs. Palumbo, Golladay, DeHaven, Romine
*Mr. Stiles was not present at this meeting.
Mr. DeHaven raised the fact that no one had appeared at the
public meeting to voice their opposition to the rezoning.
Mr. Horne stated that he did receive two letters from Rev.
Russo who was in opposition.

Mr. Golladay next moved that the Commission pass this request
to the Board of Supervisors along with a recorded vote and complete set
of minutes for their action.
This was seconded by Mr. DeHaven and the vote was approved by
the following majority vote:

MAGISTERIAL DISTRICT: Gainesboro Magisterial District
ADJACENT LAND USE AND ZONING:
Residential and industrial land use and agricultural zoning.
PROPOSED USE AND IMPROVEMENTS:
To be rezoned to B-2 (Business -General), for a double wide mobile
home to be used as a restaurant.
REVIEW EVALUATIONS:
Virginia Dept. of Highways and Transportation - No objection to
the rezoning. However, a commercial entrance permit must be
applied for and approved before opening.
Health Department - A revisit was made to the Shirley Meade
property on April 14, 1982, concerning locating suitable soil to
permit the installation of a sewage system to serve a proposed
restaurant. Although a small area has been located on adjoining
property, for which an easement could be obtained, I have not
located enough suitable soil on which to accommodate the
restaurant. This information was relayed to her father with the
stipulation she may want to employ a backhoe to check soils
further, as I had much difficulty in drilling test holes on part
of the property because of sandstone rock in the subsoil.
Department of Inspections - This Rezoning request shall conform
to Section 203.0, Use Group "A", Subsection 203.4, Use Group A-3,
Structures of the Boca Basic Building Code, 1978. Additional
comments shall be given at time of plans review.
Planning and Zoning - There is currently a nonconforming
commercial gift shop on this property which is operated by Mrs.
Meade. This proposal is to replace an existing mobile home with
another "double -wide" mobile home and convert that to a
deli -restaurant.
The Comprehensive Plan designates this area as being included in
the Highway Development District which does not preclude the
possibility of commercial development within "planned clusters."
The character of this immediate area, the soil characteristics,
and the size and shape of this parcel will, however, make any
clustering of comparable commercial activities very difficult.

Rezoning of this parcel alone would violate the Commission's
adopted Spot Zoning Policy unless all similarly situated
properties in the area were placed in the same or appropriate
complementary categories. The staff would not recommend a
general commercial rezoning for the area.
STAFF RECOMMENDATION:
Denial, for the following reasons:
1. This individual application would violate the adopted Spot
Zoning Policy.
2. The characteristics of this parcel and the neighborhood
preclude the reasonable possibility of a "planned cluster" of
commercial developments. It would, therefore, not be in
conformance with the Comprehensive Plan.

The Commission transmits to the Board of Supervisors the request

THIS DEED made and dated this day of 1977,
by and between BRADY J. MEADE and SHIRLEY ANN MEADE, his wife,
parties of the first part, hereinafter called the Grantors, and SHIRLEY ANN
MEADE, party of the second part, hereinafter called the Grantee.
WITNESSETH: That for and in consideration of the sum of Ten
Dollars ($10. 00), cash in hand paid, and other good and valuable
consideration, the receipt of which is hereby acknowledged, the Grantors do
hereby grant and convey in fee simple absolute, with general warranty of
title unto the Grantee, as feme sole, to be her equitable separate estate,
the curtesy interest or right of her present or any future husband being
hereby expressly excluded by this instrument as provided in Section 64. 1-21,
Code of Virginia, 1950, as amended, "all of that certain lot or parcel of
land, together with the improvements thereon and all rights, rights of way
and appurtenances thereunto belonging, lying and being situate in Gainesboro
Magisterial District, Frederick County, Virginia, near the West Virginia
Line, known as the "Twin Springs Filling Station", and more particularly
described as beginning at a point two (2) feet east of a Highway stone,
located on the north side of U. S. Route 50; thence along the north line of
U. S. Route 50 in an easterly direction for a distance of Two Hundred and
Sixty -.three (263) Feet; thence at right angle, in a northerly direction, for a
depth of Three Hundred and Thirty-two (332) Feet to an iron stake; thence in
a northwesterly direction, in a line parallel to the northern line of U. S.
Route 50, for a distance of Two Hundred and Sixty-three (263) Feet to the
McKee right of way; thence in a southerly direction, in a straight line, for a
distance of Three Hundred and Thirty (330) Feet to the beginning, " and being
the same land conveyed to Brady J. Meade by deed dated September 3, 1965, ,
from Guy J. Oates, et ux, and recorded in the Clerk's Office of the Circuit

Court for Frederick County, Virginia, in Deed Book 314 at Page 150.
Reference is made to the aforesaid deed for a more particular description
of the property herein conveyed.
This conveyance is made subject to all easements, rights of way
and restrictions of record affecting the subject property.
The Grantors do hereby covenant that they have the right to convey
to the Grantee; that the Grantee shall have quiet and peaceable possession of
the said property, free from all liens and encumbrances; and they will grant
such further assurances of title as may be requisite.
