There will be an ad hoc Zoning Review Committee meeting on March
1 at 1:00 PM in the conference room of the Old County Courthouse.
We will discuss the proposed Creekside Village rezoning. We are
having the meeting on an ad hoc basis because the application was
begun before the current requirements were adopted. Normally we
will only have Zoning Review meetings on the second Thursday.
Materials on the rezoning are attached. We will go over the
proposal 'and informally discuss. The goal of the meeting is to

Dear Mr. Ambrogi:
Mr. Robert Watkins asked that I provide you with a cover letter
regarding our project in Kernstown and a description of our request,
Proffering Statement, location map and Master Development Plan plat.
The request covers a three phase commercial project on three parcels
of land with a combined area of 4.7 acres.
Phase I of the project was purchased in 1988 and rezoned from RP to
B-2. A site plan was submitted and approved and construction of
approximately 14,000 sq. ft. of retail/office space is presently
underway. In an agreement with the City of Winchester and The
Frederick County Sanitation Authority, city sewer and water lines
have been extended to the property. We have worked with the VDOT and
obtained approval for a relocated commercial entrance which is now
completed and the installation of a revamped traffic signal light at
the entrance intersecting Valley Avenue and Shawnee Drive in
Frederick County. The light will be operational by February 28th
according to VDOT.
Phase II (B-2 zoning) and Phase III (RP zoning) were purchased during
1989. With the inclusion of these two additional parcels, a Master
Development Plan is required since the project size has increased.
Phase III also necessitates the submission of a rezoning application
and proffering statement.
The total project will eventually contain approximately 45,000 square
feet of leasable retail/office space. Phase I should be completed by
late spring in 1990 and complete project buildout should occur in
1991.

I the undersigned, owner and rezoning applicant hereby submit the
required Impact Statement covering those topics applicable to my
rezoning request for Phase III of my property located in Kernstown,
Back Creek Magisterial District, Frederick County, Virginia.
Impacts are as follows:
I. Transportation Impact
o A traffic analysis using the publication "Trip Generation"
published by The Institute of Traffic Engineers and rates
based upon our expected land use and building types were used
to anticipate traffic flows in and out of the subject
property.
The rates are weighted averages from a U.S. Study. General
C� office rates are for suburban office space outside of the
downtown core. Shopping center rates were used for the retail
space as no rates were available for small specialty shops.
Rates are shown as number of round trips (in/out) per 1,000
sq. ft. of leased space. Assuming a complete build out,
Phases I, II, and III would be 43,000 sq. ft. of leased space
and the occupancy mix would be 45% retail and 55% office.

"NOTE: These estimates are thought to be considerably overstated as
the retail space will consist of small specialty shops
rather than typical high volume "shopping center" business.
The "average" column was used for computing both office and
retail calculations even though the "minimum" column would
probably be more applicable. However, we felt it best to
show the highest volume scenario.
o A traffic signal is being installed at the entrance to the
project by VDOT. The signal change is being done at the
owners expense as agreed to with VDOT,
II. Water & Sewer Impact
In accordance with agreements previously reached between the
applicant, The City of Winchester, and The Frederick County
Sanitation Authority for Phase I of the project, the property is
serviced by the City of Winchester to satisfy water and sewer needs.
V o An approved six inch water main extension has been extended onto
the property from the twenty four inch main water line
paralleling Valley Avenue on the eastern side of the subject
project. This line will be extended to Phases II and III and a
second fire hydrant will be installed on Phase III in accordance
with the Fire Marshall Regulations.
s!o An eight inch on -site sewer network has been installed during
Phase I and will be extended to service Phases II and III. The
gravity sewer system ties into The City of Winchester's twelve
inch line on the East side of Valley Avenue. In agreement with
The City of Winchester the tie-in to the city's existing system
is being completed by the applicant and is a cost sharing
project which will enable the city to subsequently extend their
twelve inch line West on Snyder Lane to complete a pending
project for properties lying to the North and West of the
applicant's property.
NOTE: The above mentioned projects are being funded by the
applicant or shared as in the case of a specific section
of the sewer tie-in.

III. Historic -Structures Impact
o There is a large 2 story house on the property that was built in
the 1790's. It has been preserved and remodeled by the owner.
The colonial style of this main building has been retained and
used as an architectural guideline for designing the proposed
additional new structures on the property.
o The existing brick garage has been remodeled and expanded to
create a 2,100 sq. ft. free standing art gallery.
IV. Storm Water Impact
o Phase I of the project has been designed and altered in
accordance with the recommendation of the Fairfax Engineering
Firm that services the Frederick County Planning Department. As
a portion of Phase I lies within the 100 year floodway, two
buildings have been specially engineered to meet new
specifications and two others have been relocated to Phase II
and Phase III properties.
o The Hoge Creek channel which intersects with Phase I has been
dredged, widened and rip rapped to carry water through the
property in high water situations. The area designated as
floodway has been graded as specified by the Fairfax Consulting
Engineer and parking lot elevations have been established to
carry Hoge Creek overflow through the applicants property
without forcing water onto adjoining properties.
V. Screening and Landscaping Impact
o All existing trees and vegetation in Phase I has been preserved
except in building and parking area construction. Unsightly
vegetation has been removed and is being replaced with fencing
and new plantings as part of the overall landscape plan.
VI. Surrounding Properties Impact
The subject property is bordered by the below listed properties:
o North - Residential rental property zoned B-2
o South - Undeveloped land - zoned R-P and a single family
home zoned B-2
o East - applicant/owner's property - Phase II of this project

VII. Incremental Revenues - Frederick County
o The completed project will include approximately 43,000 sq. ft
of leased space (19,500 retail and 23,500 office) Frederick
County will receive incremental, tax revenues from inventories,
furniture/fixtures, equipment, improved real estate and retail
sales.
These, to the best of my knowledge are the impacts applicable to the
rezoning of the Phase III section of my property.

MASTER DEVELOPMENT PLAN AND REZONING - PROFFERS
APPLICANT #
We the undersigned, sole owners of land to be rezoned under
rezoning request number referred to as the
rezoning, and the applicant for said rezoning,
hereby voluntarily proffer the following conditions. The
conditions proffered shall be binding upon the heirs, executors,
administrators, assigns and successors in interest of both the
applicant and owners. In the event the Frederick County Board of
Supervisors grants said rezoning and accepts these conditions, the
following proffered conditions shall apply to the land rezoned in
addition to other requirements set forth in the Frederick County
code:
Transportation:
A. The sole entrance/exit on the subject property will be the
commercial entrance onto Route 11 at the front of the
property. Traffic will be controlled by the traffic signal
installed at the owners expense at the intersection of Route
(16 11 and Shawnee Drive (Route 652).
B. The only entrance/exit to Route 706 on the southern boundary
of the property will be an emergency vehicle entrance.
Water & Sewer
A. The water service to Phases II and III will be extended from
Phase I by the owner and a second fire hydrant will be
installed in accordance with the Fire Marshall Regulation.
B. The sewer line to Phase II and III will be extended form Phase
I by the owner.
Aesthetics: The project will be designed to create a village type
shopping and office complex unlike the typical "strip
mall" look that is prevalent in most new commercial
projects either recently completed or presently under
construction in the Winchester/Frederick County area.

o All new buildings that will be constructed during the three

An underground irrigation system will be installed to assure
all plantings are properly maintained.

o All signage will be in accordance with established standards
set by the architect and the owner and must be approved prior
to installation. No business sign shall exceed 100 sq. ft. in
size.
o All outside lighting will be of Colonial or Victorian design
and perimeter lighting will be directed on site and will be
non -glare so as to minimize the impact of adjoining
properties.
o Curb and guttering will be used in•wmsA_ paved areas for
aesthetic appeal and water run-off control. All traffic areas
will be asphalt covered.
o The property line between the applicants project and the
7-Eleven Store on the Southeast of applicant's property will
be fenced with open fencing. The southern property line
bordering VA Route 9706 will be a combination of parking and
landscaped islands on the applicant's property. The parking
area within the Winchester City limits will be landscaped as
previously agreed to with the Winchester Planning Director for
Phase I site plan approval.
Storm Water Manaqement:
A underground storm water collection and drainage system will be
installed as a part of Phase II and Phase III site work to
facilitate rainwater run-off and drainage from the project property
to Hoge Creek.
Underground Utilities:
All electrical, telephone and cable lines on the property will be
installed underground for aesthetics and anticipated new county
regulations.
Master Development Plan:
The owner is proffering the Master Development Plan covering
proposed uses of property and applicable drawings as submitted to
the Frederick County Planning Commission for Phases I, II and III
of the subject project.

Continuity:
It is the intent of the owner/applicant to maintain the property
under individual ownership and to maintain the standards outlined
in these proffers.
If the property is sold at a future date, deed covenants, where
possible, will apply to future ownership to protect the original

These proffers shall be binding upon the heirs, executors,
administrators, assigns and successors in interest of the applicant
and property owner.
This document shall set forth the total obligation of the applicant
and property owner to The County of Frederick in connection with

As requested we have reviewed the above referenced plans dated
April 11, 1989. Our recommendations may be found on the attached b/w print
and as follows:
1. A 12' wide turn lane 50' long and 100' taper will be required on the south
bound lane of Route 11.
2. The entrance must be shifted south for better intersection alignment.
3. Cc-6 curb and gutter is required.
4. Estimated cost for traffic signal modification to accommodate existing
traffic is $9,000. The developer will be responsible for this cost which
can be handled on an accounts receivable basis. This work can be
coordinated with the Route 11 and Route 652 inprovement project. A letter
of agreement for the traffic signal modification and cost must accompany
the land use permit assembly. To expedite planning and design of the
signal modification, the agreement letter should be sent to my office as
soon as possible.
Please revise and resubmit for review. My office will require four (4) copies
of the revised plans to process a land use permit.

Enclosed is a revised Gravity Flow Agreement for your
consideration. All added language is underlined.
Most of the situations requiring this type of agree-
ment will be resolved when the new Hogue Run interceptor
is constructed. The City needs to know when you anticipate
having this line available.
Several developers working in Frederick County have
indicated a desire to extend City utilities for their pro-
jects. They have previously been approved by the City sub-
ject to an allocation from the Frederick County Sanitation
Authority at the Opequon Regional Wastewater Treatment
Plant. The allocation has been denied.
The City proposes that these and other properties be
approved by the City and the County under the following
circumstances:
A. As an interim measure, the hook-ups would
be to the City system as it presently exists.
All associated costs would be borne by the
developer.
B. When the gravity flow agreement is approved,
all areas eligible under the agreement pro-
visions would be transferred from the City
to the County and master meters installed
in compliance with the agreement.

C. When the Hogue Run interceptor is constructed
properties in Frederick County would be trans-
ferred from the City to the County.
Mr. Stiles indicated his willingness to negotiate the whole-
sale water rate to the level of the City's cost, including capital
improvements. The City and the County could then consider the trans
of utility customers in the County that are served by the City to
the County. Most of these customers are in the Senseny Road area.
Please evaluate the feasibility of extending all County residents
in the area. This would free capacity in the City's line to serve
the new customers in the Kernstown area.
The Fay Springs water system is not available for transfers
to the County. It is used as part of the City system.

HOGE RUN 100 YEAR FLOOD EVALUATION
at Creek Side Village

The firm of Gilbert W. Clifford and Associates, Inc. has been commissioned
by the Mr. Al Graber to evaluate the effect of his development at Kernstown on
the Hoge Run one hundred year flood elevation. The scope of the study was to
include:
- A determination of the existing flood elevations and quantities.
- Determination of the elevations resulting from development, and the ef-
fect of the increase on surrounding properties.
- Suggest design variations as appropriate.
The Engineer has employed topographic mapping provided by Mr. Bruce
Edens of Greenway Engineering, USGS topography, and site visits to determine
existing conditions. The computation of flow quantities, and pipe capacities are
in accordance with methods promulgated by the Virginia Department of
Transportation.
The Hoge Creek drainage area to the development consists of approximately
1.6 square miles, situated generally south of The City of Winchester, and west
of Valley Avenue (US Route 11). The 100 year flood was computed using the
Snyder, Anderson, USGS, and Rational Methods. Analysis of the results provid-
ed a flow of 1150 cfs. This flow was used in both the pre development and post
development conditions.
The Hoge Run profile, and the proposed site plan were studied to determine
the critical section. The finished floors of homes believed to be affected by the
flood plain were also considered. A section approximately 250 ft upstream of
the Valley Ave. Bridge was selected. The section is Section B on the plan.

This selection was based on the following factors:
- the Valley Ave bridge was determined to be capable of passing the 100 year storm
without creating a headwater condition.
- the culvert crossing under Snyder Lane would be inundated, and the flow would
crest the roadway. As the centerline elevations of the road are close to the existing
stream elevation, this area was not consider as a restriction to flow.
- the section containing the three 48" concrete culverts is a significant restriction.
This is Section A on the site plan. The parking lot to the north of the stream has been
graded to allow passage of any flow outside the capabilities of the culverts. The headwa-
ter created would therefore be minimal as compared to the resulting 100 year flood ele-
vation.
Routing of the 100 year flood flow of 1150 cfs through the Section B at the pre development
contours resulted in a flood elevation of 747.0 ft. Routing of the flow though the developed section
utilizing the proposed grading shown on the plan resulted in a flood height increase of over one
foot, and a potential impact on the dwelling to the north of the stream. It was recommended to the
developer that the buildings as established along the Hoge Run bank be constructed with crawl
spaces, leaving the existing grades beneath these buildings undisturbed. This cross section was
evaluated and provided an elevation of 747.5 ft, or an increase of 1/2 ft. It was also determined
that flow though this section would not violate the generally accepted one foot rule for storm
channel modifications, and the effect on adjacent properties should be minimal.
A copy of the recommended cross section, the flood quantity calculations, and a site plan,
marked to show the sections of concern, have been attached.
The developer has been advised of our recommendation concerning the construction of the two
buildings affected. He has no objection to this requirement. The foundation wall will need to meet
BOCA Code specifications for structures in the floodway (Article 21).

Storm Water Management Analysis
Dear Al,
We have completed our assessment of storm related impacts at your project. We
have performed this work per your request and as directly required by the County in their
review of your site development plan. We will attach numerous items of supporting data and
information to this letter which will be a benefit to the County and the County's consultant in
final review of the work.
The scope of our work involves simply the assessment of impacts as they may be
created by the construction of your facility within the flood plain and recommendations as to
how to minimize these impacts. These recommendations include specific design changes
which you and your engineer, if you elect, will implement in your planning. Our concerns
cover several areas:
1. Effects on adjacent properties and buildings.
2. Effects on upstream properties and buildings.
3. Effects on the proposed structures made as a part of this site plan.
4. Effects on all of the above with present and with future conditions in
upstream drainage considered.
5. Effect on safety and health.
To estimate future as well as existing flood elevations we have have employed a
method frequently used for this type of work involving Mannings flow equation and storm
water quantities estimated from a variety of methods which are described in the attached
information. We have also consulted the City of Winchester and the County flood mapping
and those associated calculations. Significant agreement was observed in flow quantity
prediction.
This site is predominately within the 100 year flood plain as described in the
Frederick County Flood Insurance maps. The flood insurance maps show no floodway on
the property. The County zoning ordinance for flood plain districts allows the type of
construction proposed on this project, in our opinion. It requires the owner to meet all
BOCA code requirements for structures and we recommend that you closely review your
structural requirements with this document in mind. The scope of our services will not
include evaluation of structural elements of the buildings, this is not something that we
routinely do as a part of our service. We recommend a qualified engineer specializing in
this work, perhaps Foundation Engineering of Virginia, evaluate structures in that
regard.
Our findings indicate that there are impacts associated with the plan as proposed.
We believe you will able to mitigate most impacts, however you must understand that
any construction within a flood plain area such as you propose will cause a proportionate
increase in the flood height passing that point and therefore will have impacts. You also
have the issue of acceptable losses in a flood event on buildings and property within your
site. There will undoubtedly be damage resulting from a flood occurrence and although
certain of our recommendations speak to elimination of certain risks such as building
foundations; maintenance and associated costs will be required after major storm events.
The mitigating factors which we recommend are as follows:
1. Revise the grading to allow for a split floodway area flowing on either
side of the major culvert installation in the western part of your site.
This area is shown on the attached mapping as section A.
2. Relocate certain buildings to the locations shown. This will eliminate
the buildings from causing increased flood height and perhaps eliminate
unnecessary damage to the structure during flood events. Blocking a
floodway can have problems other than flood height, namely certain items
can float down stream and lodge on structures creating increased stress
and damage. By eliminating the structures as shown we believe the
chances of such happening will be much reduced.
3. Elevate the floor of the northern structures above the flood plain,
leaving the flood plain at its natural location and providing a structural
support slab with columns to adequately sized footings. The underneath of
the building would be equipped with breakaway walls which would allow
the flood flow to cross underneath the buildings and not be impeded by the
structure. This alternative also eliminates fill within the floodway and
the zone of maximum velocity of the stream during flood stage, which
should additionally eliminate damage.
4. During the passage of a design storm, the increased flood height for the
water shed as it exists should be less than 0.6 feet. With the increased
flood potential of future development runoff upstream, which is likely to
occur and, if such development is allowed without storm water detention,
then the flood height could be significantly higher. Our calculations show
that with a 50% impervious area upstream the difference in flood height
between the existing and proposed would be .61 feet but more importantly
the stage height of flow would be the 748.64 elevation which could cause
inundation of your existing buildings.
As best as we can determine the flood elevations which are pertinent to the County flood
ordinances are to be determined from existing flood flows. So the future flood height
estimates based on 50% impervious area upstream is not an issue for regulatory agency
concern, but should be noticed by you in setting the finished floor elevations of your
building.
We recommend that a storm evacuation plan be prepared so that people and property can
be protected during extreme events.
Finally, in closing, we trust that we have given you the information you required and
needed in order to obtain necessary approval in the County. Building and construction
can and has occurred throughout flood plains in Frederick County and can be performed
for commercial and industrial uses with good result so long as impact are accessed and
the risks known. We trust you understand that there are risks and that we cannot by any
means insulate you and your project from damage potential. We believe the attached
analysis has given an accurate portrayal of the impacts and if we can be of any additional
service please call.

I have conducted a review for the site plan for the above
project. With the project being located within the flood plain
limits as indicated in the Flood Plain Study prepared by C.H.2M.
Hill, drainage is a critical consideration for this site. Also
important is the impact this plan would have on the flood plain
and adjacent properties.
Drainage calculations were not submitted with the review
package. In order to review this plan, we will need drainage
calculations. These calculations must include the 10 and 100
years storm event. Also, a flood plain evaluation will need to
be conducted by a registered engineer to determine the effects of
this development on the flood plain.
Also, Frederick County Sanitation Authority comments were
not included in the review package. It is my opinion that
additional input from the Sanitation Authority would be required
regarding the pump station, and profile of the sewer lines prior
to County approval. This information may be on sheet 2 of 2
which we did not receive a copy of.
Other comments are:
* A more detailed erosion control plan must be submitted.
* Outlet protection such as rip -rap must be included at the
curb opening.

Following our meeting of last Monday night regarding the
above flood plain study, I wanted to firm up what we agreed you
would look into. I appreciate your efforts to keep the study
simple on behalf of your client, however, I must receive
verification of the effects of this development on the upstream
and adjacent properties. It is my opinion that the proposed
culverts and stream crossing will raise the headwater and
subsequently raise the flood level on the upstream property by
more than one (1) foot. This needs to be confirmed. After a
site visit, I feel that something could be done in the proposed
remote parking lot to channel the storm water through it to
eleviate the impacts both on site and off.
In addition, I feel that your client needs to be made aware
that his buildings that are in the flood plain may very well be
flooded during the 100 year storm. His floor elevations could
perhaps be set to reduce this probability by careful study and
evaluation of the impacts on the flood plain. Now is the time to
accomplish this.
You indicated that you would provide cross sections upstream
to verify the flood elevation. This can be done with the
parameters you have already selected. I suggest when it comes
time to evaluate the impacts of the flood waters on the proposed
floor elevations, that consideration be given to runoff
coefficients or impervious ratios that represent reasonable
future developed conditions. This would allow your client some
factor of saftey should future development upstream not provide
onsite storm water management just as not being provided on this
site.

Dear Evan,
We received and reviewed the information provided by Gilbert
Clifford. I feel that the concepts that they are expressing have
merit. The applicant now needs to reflect those concepts and the
proposed cross sections for diverting the stream flood waters.
Once the grading plan incorporates and indicates these
items as suggested by Gilbert Clifford then I feel the plan can
be approved.

As requested, I have reviewed the site plan submission dated
October 2, 1989. My comments are directed only at that portion
identified as Phase I consisting of the area previously
submitted. The other phase will be reviewed separately when the
submission drawings and drainage calculations are complete.
My comments are as follows:
Drainage/Grading
1. Gilbert Clifford and Associates prepared a report with
recommendations for this site. The report indicates
that special grading and building foundation plans are
needed for those buildings adjacent to the creek which
would allow for water to flow under portions of the
buildings. In other words, the buildings should be
designed on special piers to allow for fairly
unobstructed flow. The 100 year flow elevation for
developed conditions upstream is projected by Gilbert
Clifford and Associates to be approximately 748.60.
a) The plans as submitted do not clearly indicate
that the buildings and grading will accommodate
"flow through" potential under the northern
buildings.
b) The northern buildings are subject to flooding
under the projected 100 year storm. A note to
clearly indicate this should be added to the plans
to warn future building owners and/or tenants.

c) It does appear that the northern parking lot will
allow for water to overflow to relieve some of the
flooding in the areas of the buildings. This
parking lot could be lowered further in the center
of the western edge and northeast corner to allow
greater relief. These parking areas should be
marked as "subject to flooding" with signage at
the time of construction.
2. The slope from the 2' curb opening near "MH-1" to the
ditch at Route 11 is very flat. Positive drainage is
unlikely.
3. It is unclear where the drainage is proposed to go at
the main entrance from Route 11.
4. It appears that the existing dwellings to the north
will not be negatively impacted based on the finish
floor elevations as provided by Greenway Engineering.
Therefore, this is no longer a concern.
5. Since this property is immediately in the flood plain
area, it is my opinion that it would be best to get
drainage away from this site undetained. Therefore,
I concur that an on site stormwater retention facility
is not appropriate for this project.
Erosion and Sedimentation Control
1. The proposed straw bail barrier is not adequate for the
drainage acres flowing to it. A combination of silt
fences, diversion berms and silt/sediment traps would
be preferred.
2. A construction entrance is required.
3. Erosion control measures and specifications need to be
adequately included on the plan.
Miscellaneous
1. Please verify if this use does not require any buffers
from the adjacent residential uses.
This concludes the comments for the Phase I portion of this
plan.
I have a few suggestions for the proposed Phase II. On site
storm water management is recommended to mitigate the effects of
runoff on the downstream properties.
The stormwater discharge should be located further downstream.
Erosion and sedimentation plans need to be outlined and indicated
on the plans. Profiles and drainage calculations need to be
submitted with the plans. This includes drainage area
calculations. These items need to be incorporated with the
construction plans and design review documents in order to review
the plans.
I would be happy to meet with the owner and his design
representative to discuss the planning of this phase.
Also, if there are any questions pertaining to my comments
for Phase I, I will also make myself available. Please let me
