Location: East side of Lenoir Drive (See attached map).
Adjoining Land Use: M-I, largely vacant industrial land.
Proposed Use: Retail Sand and Asphalt Paving business.
Improvements: Proposed 40' x 60' building for office and equipment storage.
Entrance, driveway and parking.
Review Evaluation:
Frederick -Winchester Health Department: Septic tank system site approval for
a maximum of six employees.
Virginia Department of Highways and Transportation: (See attached portion of
plat with notations). Minimum 25 foot radius to be used. Base
should be a minimum of 12" of crushed aggregate to support turning
movement of heavy sand trucks. A permit by them must be granted
before any work is started on State right-of-way.
Department of Public Works: Land disturbing permit required. Wants to know what
the plans are for the remainder of the parcel.
Zoning: Soil erosion - sedimentation control plan should be shown on plat re-
gardless of whether a permit for sam has been issued. Suggest proposed
future use of remainder of tract shown. Notation that future use has
not been determined but a revised site plan will be submitted at such
time as development occurs would be acceptable.
Staff Recommendation:
The Staff recommends approval, all requirements have been met.
Planning Commission Recommendation:
The Planning Commission recommends this site plan be unanimous vote.

Dear Mr. Newlin:
As per our discussion of April 12, 1978, 1 am enclosing a copy of your plat
as submitted. Have your surveyor add the following additions and/or corrections
that were submitted by the various reviewing agencies:
1. Note that there will be a maximum of six (6) employees.
2. Correct access to show a twenty-five (25) foot radius and a base
minimum of twelve (12) inches of crushed aggregate to support
turning movement of ::eavy sand trucks.
3. Show soil erosion -sedimentation control plan on plat.
4. Note that future use of remainder of tract has not been determined
but a revised site plan will be submitted at such time as development
occurs.
5. The driveway should be paved.
6. Show where the sand and gravel will be located.
7. Landscaping proposal along Lenoir Drive should be shown.
8. Explain why the driveway narrows so much from entrance to parking area.
It will be necessary for the revised site plan to be in my office by April 24,
1973, so that we can be sure that your proposal is presented to the Planning
Commission on May 3 and then t.ae Board of Supervisors on May 10.
As I explained, should you feel that you cannot comply with any of the above -
mentioned changes do not show that portion on the revised site plan and you can
discuss it with the Planning Commission at their meeting. Since the Planning
Commission can make recommendations to the Board with suggested conditions for
approval,this will not delay t=:e processing of your site plan.

Also, a permit must be granted by the Virginia Department of Highways and
Transportation before any work is started on the State right-of-way, and a land
disturbing permit must be obtained from the County Department of Public Works
before any soil is moved.

approved for the entrance you recently constructed on the above route.
It will be necessary for you to contact me, secure an entrance permit,
and construct to our minimum commercial entrance standards.
Last summer, Mr. R. C. King and I met with you at the site and advised
you that a commercial entrance permit would be required.
It is necessary that we have your prompt attention in the matter.

It has come to my attenticn that you are presently occupying a
structure constructed, under permit -4728, as a commercial storage building.
Section 119.1 of the Virginia Unifcrm Statewide Building Code states, "that
a building hereafter erected shall not be used or occupied in whole or in
part until the certificate of use and occupancy has been issued by the
Building Official."
Issuance of a certificate of use and occupancy is contingent upon
satisfying the requirements of various state and local agencies.
In an effort to determine the status of the above captioned project
I have arranged a site inspection =o be held, thursday, January 11, 1979,
at 10:00 p.m. Representatives of the Planning office, Health Department
and Department of Public Works will be present.

On, thursday, January 11, 1979, Frederick County personnel,
representing the departments of Public Works, Zoning and Building In-
spections, conducted a site inspection on the above referenced project.
The purpose of this visit was to determine the status of the
project relevant to the issuance of a temporary certificate of occupancy.
Issuance of a certificate is contingent upon satisfying the requirements
of various state and local agencies.
In reviewing the results of our visit it appears a significant
number of problems currently exist which could prevent the issuance of
a certificate.
In an effort to resolve these problems with the minimum amount of
duplication and inconvenience I have arranged a meeting, to be held,
February 2, 1979, at 2:30 p.m., in the Frederick County Inspections
Office. Representatives of the various agencies involved will be present
to offer assistance in the resolution of these problems. Please plan
to attend.
Should this date conflict with your schedule, please contact this
office so a suitable time can be scheduled.
Your assistance in this matter is greatly appreciated.

The following should be accomplished on Mr. Newlin's property prior to
issuance of a temporary occupancy permit:
1. The pile of wood must be removed.
2. The bus and junked car must be removed.
3. No outside storage except for vehicles.
The following must be accomplished prior to issuance of a final occupancy
permit?
1. Sand dump storage in rear installed as shown on site plan.
2. Landscaping as shown on site plan.
3. Virginia Department of Highways and Transportation entrance and
asphalt paving as shown on site plan.
4. Right side of property stabilized to meet approval of Director of
Public Works.
5. Site plan submitted for revision and approval showing grade and
drainage changes and such minor items as the five foot (5') grass
strip in front of the building being changed to gravel.

Dear Mr. Newlin:
Pursuant to the staff meeting held in

1. A valid plumbing permit must be obtained from the Frederick
County Inspections Office. All work must conform to the
requirements of the BOCA Basic Plumbing Code.
2. Supply to this office a written request for the temporary
use of a portable toilet to service the facility. Prior
to submitting this request all connection fees must be
paid. Occupancy would be limited to two (2) full time
employees until connection to Sanitation Authority lines,
which is projected to be available by September 1, 1979.
Portable toilets must be kept in a sanitary condition,
and should be located in the rear of the building.
3. The following site plan requirements must also be com-
pleted prior to occupancy approval:
a. Remove existing wood pile
b. Remove bus and junk cars from site
c. No outside storage except for vehicles connected
with operation of facility
4. Discontinue spray painting operations within building.
Structure is not designed to support this use.
Significant progress in meeting these minimum requirements
must be accomplished by March 31, 1979.
