In response to your request for a modification to
Section 1701.1 paragraph 5 of the Virginia Uniform State-
wide Building Code with respect to the frame structure
adjacent to the Hoak and Lawyer Arco Service Station, I
am pleased to grant the modification subject to the con-
ditions referenced in the affidavit submitted by your
office, dated November 7, 1977, and signed by Roy R. Hoak
and J. D. Lawyer.

As per our conversation of September 13, 1977, please find enclosed
a copy of the site plan requirements from The Code of the County of
Frederick, Virginia of 1976, Chapter 21 (Zoning). Although your office -
storage building was erected without County approval, it will be necessary
for you to complete the site plan requirements in order to obtain a building
permit and thus maintain the building.
As I mentioned, zoning approval is required for all development in a
B-2 district. Please contact me by September 30, 1977 so that we can make
the necessary arrangements to bring your office -storage building into
conformance with the Code.

Dear Ms. Stefen:
My clients, Mr. Roy Hoak and Mr. J. D. Lawyer, have
employed Mr. Thomas A. Shockey to prepare a site plan as
required by your office for the frame structure adjacent
to the Hoak and Lawyer Service Station.
I spoke with Mr. Shockey on Friday, November 18, 1977,
and he agreed to meet with you in the next few days to
determine what is to be included in the site plan. Mr.
Shockey expects to do the survey on December 1, 1977,
weather permitting.

Re: REQUEST FOR BUILDING CODE MODIFICATION
A F F I D A V I T
This day in the County of Frederick, State of Virginia,
personally appeared Roy R. Hoak and J. D. Lawyer, who manage
and operate Hoak and Lawyer Arco Service Station, and after
being duly sworn, made oath as follows:
That they operate an Arco Service Station at the junction
of U. S. Route 522 and Route 753 (Fox Drive); that the parcel
of land on which the station is situated is approximately
1.663 acres; that adjacent to the service station building
there is a small frame structure; that the frame structure
is approximately 12 feet wide and 20 feet long; that the
frame structure is to be used as a business office; that the
frame structure will have a limited occupancy load and will
not be used for sleeping; that the men's and women's rest
rooms at the service station (each has one (1) water closet
and (1) lavatory) are within 120 feet of the frame structure
and are available to anyone coming to the frame structure;
that the frame structure if used as a sales office for used
cars would have cars parked nearby on the service station
asphalt parking area and the number of cars would average
six (6) and never exceed ten (10). that if the used car
business should be expanded beyond the scope as provided
herein and as provided in the site plan to be filed for
this frame structure, then the affiants hereby agree to
obtain prior approval from the County building inspector
and the County planning director and to upgrade the sanitary 1{
