The Planning Commission unanimously recommends approval with the provision-..
that the site plan not be released until an occupancy permit is obtained. The Plann_
Commission once again expressed concern as to why there is a problem in resFOnse
to Mr. Emerson's presentation.
Mr. Douglas Grim appeared before the Board and stated that he was an
adjacent property owner to the subject property and was opposed to the site plan./

chlorination of his well and further development would cause problems with other

Dr. Fish stated that while this is not in his district, he passes this local
quite frequently and he considers this to be an attractive area. He stated that
felt there was a potential for a problem here and he would be watching to see th
the property is kept in good order.
Upon motion made by Dennis T. Cole, and seconded by Dr. Raymond L. Fish,
* BE IT RESOLVED, That the board of Supervisors of the County of Frederick,
Virginia, does herein approve Site Plan #029-77 of Everett G. Emerson to operat�
the Johnny Blue Portable Toilet System and Emerson Wood Company on his property
located in the Gilpin Industrial Park fronting Lenoir Drive in the Stonewall
Magisterial District; the proposed building will be used for an office, storage
chemicals and supplies, and storage of portable units; the fenced area will cont
a toilet storage area, a wood storage area, and an area for vehicle and const-
ruction office storage; the mobile homes and buses to be rented as construction
offices will be remodeled for that purpose on the site, said approval being give
with the stipulations that (1) the entrance will be modified to the Virginia
Department of Highways standards; (2) the entire storage area will be fenced wi
a chain link fence six. feet in height with blue vinyl stripping; and (3) that
the fence may be placed on the property line with the shrubbery planted on state(
property.

At the regular meeting of the Frederick County Planning Commission
on December 7, your request for site plan approval was considered and
recommended to the Board of Supervisors with modifications. The
requested modifications are included in the motion below:
BE IT RESOLVED, That the Planning Commission for the County of
Frederick, Virginia does hereby recommend to the Board of
Supervisors the approval of this site plan subject to the
following: the roadway entrance be modified to meet the
Virginia Department of Highways standards; the entire
storage area be fenced with a six (6) foot high ribboned
fence; the front fence be set back five (5) feet with
evergreen trees four (4) feet in height being planted to
eventually grow above the fence; the businesses conducted
be limited to two -- Johnny Blue and the wood yard -- and
that the outside buses and everything else be removed after
the building is finished.

The purpose of this letter is to confirm our meeting with you
during the latter part of August regarding the completion of your
Site Plan #029-77.
As you know, your Site Plan was approved for a wood and portable
toilet storage facility and office building. All storage of the
previously mentioned items is to be behind the building setback
line and appropriately screened. No inoperable or unlicensed
motor vehicles are permitted.
After exhausting all other methods of advising you to comply
with the Site Plan, this office is formally notifying you that,
if all items are not corrected by October 23, 1980, legal action
will be instituted.
I regret that the sequence of events has regressed to this point.

Dear Ms. Stefen:
In reference to your letter of September 14, 1978, 1 cannot quite under-
stand your interest in this one particular small parcel of land in Frederick
County. It seems very personal and offensive to me. It would look to me that
you on that same inspection tour could have noticed that something had been
done and very much has been accomplished. There is a building, a fence, a
septic system and driveway. Also the well and plumbing installed. The build-
ing itself nearly ready for final inspection.
when I applied for the building permit- after approval by the board of
supervisiors, I ask about a completion date and was advised that there was none
as long as I was under construction, which I am.
The trailer and bus I need, and I know of no abandoned car of whici: you
speak. I do have other equipment that is there for modification -to suit my
needs for service.
As you know we had a very wet spring and late summer. Myself and Mr.
Gilpin had already been in contact with a landscape contractor, but since the
fence could not be put up because of wetness, the shrubbery could not be
planted until conditions changed and then it gas to late to plant the acreen-
ing. As of -this day I cannot give you an exact date of completion.
Certainly, Ms. Stefen you can see progress in my <.rea of responsiblity
and plan completion as soon as possible as well as another building to house
some of the equipment and an office.
It took one of the largest contractors from iiarch till :.;eptember to
complete my driveway entrance. This I can understand for it costs money and
extra time to move into a small project and back. As a contractor, I can
understand this and feel that you should also.
I would like to knog the conditions and agreements for a surface drain-
age area to be changed to an open trench of 2?- feet deep across the front and
side of my property which when properly installed will be 6 inches lower at
my property line with The Crown Cork & Seal property. This has become a pool
and thus floods my working area with back up in very wet weather. Please ad-
vise me of what is planned to drain the excess water from my property across
Crown Cork & Seal to prevent flooding and whom is responsible for granting
approval of the above run off area as I was certainly not consulted at any-
time. Surely you must have all the answers.

There are also other areas of the county in which you could travel and
not see my place and would be easier for you to see. There are only two
locations from which to see my lot. They are Lenoir Drive and Route 37 North
if you look over your right shoulder and to the rear (approx 1000 ft distance).
This is not only a dangerous practice but you might miss some other nice
scenery that is much closer and perhaps even be the cause of an accident on
the overpass within that 500 ft span.
A note of personal interest, I have noticed you still use your maiden
name but I understand you were married. Neither can I understand why you
still live in Hagerstown, Maryland instead of Frederick County, Virginia where
you are paid for assisting me and the rest of my neighbors who help pay your
salary and expenses, other than the cost of $1.40 for the large number of
certified letters you send out.
Surely in the early 1970•s when the then board of supervisors decided on
a planning commission they had no idea of a King and Queen in the program. I
expect that this will be revised soon so that it will be a solely elected body
of people from within the county and adopt and dismiss certain policies which
are now four years old and had sufficient time for modification.
When a community stops growing, it dies out and becomes a ghost town
such as we have heard of in the past for they can no longer support themselves
as a people community.

It has come to my attention that you are presently
occupying a structure constructed, under permit #4743, as a
commercial storage building. Section 119.1 of the Virginia
Uniform Statewide Building Code states, "that a building here-
after erected shall not be used or occupied in whole or in
part until the certificate of use and occupancy has been
issued by the Building Official."
Issuance of a certificate of use and occupancy is
contingent upon satisfying the requirements of various state
and local agencies.
In reviewing the status of the above captioned project
it appears a significant number of problems currently exist,
which could prevent the issuance of a certificate of occupancy.
In an effort to resolve these problems with the min-
imum amount of duplication and inconvenience I have arranged
a meeting, to be held, November 1, 1978, at 9:30 a.m., in the
Inspections Office. Representatives of the Planning Office,
Health Department, Highway Department, Department of Public
Works and the Supervisor from Stonewall District will be present.

I would like to set forth any promises I have made to
Mr. Emerson of "Johnny Blue" concerning planting or other
landscaping on his property in the Lenoir City Company
industrial park adjacent to Crown Cork and Seal.
Early this past spring I secured one thousand pine
seedlings about three to four inches in height, which I
promised to plant around Mr. Emerson's land in two rows.
However, Mr. Emerson did not finish his fence until the
summer was so far advanced that planting in the midsummer
weather would have been foolhardy since few if any of the
seedlings would have survived. I also told him I would plant
multi -colored beans to run up his wire fence if he finished
it in time, but he never did.
Although I did not promise this, I will, next spring
if agreeable, plant these or other similar seedlings around
the property in two rows to form an eventual screen of
evergreens. This to be at our expense.
More than this I have not promised nor do I intend
to do.

SUBJECT: Progress Inspection -- Emerson Property -- Site Plan No. 029-77.
During the progress inspection yesterday of Mr. Emerson's property, the following
items as specified in Site Plan No. 029-77 had not been accomplished:
1. The entrance must be paved for a distance of twenty (20) feet behind the
concrete curb.
2. No parking has been provided -- ten (10) spaces in front of the office
building are required.
3. No compacted stone is in evidence in the driveway and parking areas as
required.
4. No landscaping has occurred (i.e. grass and four foot plantings) as
required.
5. Banks were not stabilized although work appeared to start yesterday.
6. The gate, ribbon screening and barbed wire have not been added to the
six (6) foot chain link fence as required.
7. The contours do not match those of the approved site plan.
In addition, storage is occurring outside of the designated area. Bus and trailer
storage were expressly deleted from the Site Plan prior to approval.
This office suggests that a temporary occupancy permit not be issued until the
following items are accomplished:
1. The bus and trailer are removed.
2. Storage outside of designated areas cease.
3. The gate be installed and ribbon screening be added to the fence.
4. The drainage problem created by improper grading be corrected.
The following items must be accomplished before a final occupancy permit is issued:
1. Compacted stone must be in place.
2. Specified parking areas must be installed.
3. A contract must be signed by Mr. Emerson stating when the entrance paving
and landscaping will be completed.

Minutes of the Meeting with Everett Emerson on November 1, 1978 (9:30 AM) held
in the Board of Supervisors' Meeting Room.
PRESENT: Carroll Brown, Director of Inspections; Dorothea L. Stefen, Zoning

Koontz, Chairman at Large, Board of Supervisors; Kenneth Stiles,

Carroll Brown led the discussion and stated that the purpose of this meeting
was to resolve some of the problems on Mr. Emerson's property. Mr. Brown stated
that Mr. Emerson had occupied the building without an occupancy permit therefore,
he was in violation of the code at the present time. Mr. Brown addressed the
structure and stated the biggest problem was electrical and stated he had a memo
from Kenny Coffelt, Electrical Inspector, that stated all the present wiring
would have to be removed from the building and conduit shall be installed for
switches, lights, and receptables and any other equipment that is required
with fuse protection according to the National Electric Code. Mr. Brown stated
there were also some plumbing problems but they were not of a major nature
and could be easily corrected. Mr. Brown stated he would send Mr. Emerson a
copy of all the code requirements for the structure.
Ms. Stefen read the memo that she had sent to Carroll Brown dated November
1, 1978. She stated that she was suggesting that no temporary occupancy permit
be issued until the following items are accomplished:
1. The bus and trailer are removed.
2. Storage outside of designated areas cease.
3. The gate be installed and ribbon screening be added to the fence.
4. The drainage problem created by improper grading be corrected.
Stan Pangle, Director of Public Works, stated that the problems that needed
attention before a.temporary occupancy permit could be issued should be taken
care of as soon as possible so Mr. Emerson would be operating legally and safely.

Herbert Sluder, Sanitation Superintendent --Health Department, stated
that the distribution box and the tank should be covered because they could
freeze and burst. He also stated the ditch that was along side the property
could have a back up in water and filtrate into the drainfield then this would
be a problem.
Mr. Emerson stated he was going to cover the tank and box.
A discussion was held and it was noted that a man was staying on the
property at night. It was dissussed as to whether this was allowable and it
was decided that thre would be no problem as long as the man was considered a
night-watchman.
A discussion was held on the drainage of the property. Mr. Pangle stated
that he would go to the property and work out some elevations for the drainage.
He maintained that the grading that was shown on the site plan did work on paper.
A discussion was held on the bus and the trailer and Mr. Emerson stated
that he was going to obtain a license for the bus and rent it to construction
sites for an office. He stated he was going to take the top off the trailer and
make it into a flat bed truck to deliver his toilets. Ms. Stefen stated that as
long as the vehicles were licensed and could be moved there was no problem,
however, she would have to check the Board of Supervisors minutes and see if they
had indicated that the bus and trailer would have to be removed from the property.
Ms. Stefen stated that if they had indicated the removal of the bus and trailer
an amended site plan would have to be presented.
A discussion was held on the fence and gate and Mr. Emerson stated that he
had the supplies but due to the weather and his summer being so busy he had not
put it up.
A discussion was held on the storage of the generators. Mr. Emerson stated

that the generators would be moved from place to place on the property. Ms.
Stefen stated they could be placed in between the building and the fence as
long as they were not put in a permanent structure.
After a lengthy discussion, Mr. Brown told Mr. Emerson that the County
would allow him seventy-five (75) days to accomplish the necessary required
improvements in order to obtain a temporary occupancy permit. He stated that
if Mr. Emerson did not comply with the requirements at the end of the seventy-
five (75) days the County would be forced to take legal action.
Mr. Emerson stated that he understood and he felt this was a fair compromise.
Mr. Brown stated that at the end of the seventy-five days there would be
another time table set for the required improvements to be accomplished in order
to obtain a final occupancy permit.
It was noted that Mr. Emerson would be receiving a copy of the minutes and
a letter listing the requirements.

regards to your Site Plan, it is clear that their intention was
to allow proper storage and renovation of trailers and buses which
are to be rented as construction offices.
I hope this clarifies the discussion about the trailer and bus
that occurred during the Site Plan meeting of November 1, 1978. As
Mr. Brown's letter will confirm, it is not necessary to remove the
bus and trailer from your property prior to the issuance of temporary
occupancy permit; however, they must both be located within the

Pursuant to our meeting of November 1, 1978 the following
items must be satisfactorily completed before a certificate of
temporary occupancy can be issued as per section 120.5 of the
Code:
1. All present wiring must be removed from the structure.
2. All wiring must then be installed and inspected under
the provisions of the National Electrical Code. This
would require all wiring be installed in rigid conduit
with adequate fuse protection as per the CODE.
3. Install proper traps on sink and lavatory in bathroom.
4. Install drain on heater valve as per plumbing code.
5. Install gate and ribbon screening on perimeter fence.
6. Correct grading to eliminate drainage problem.
7. Relocate bus and trailer to the designated storage
area behind the fence.
8. Storage of material and equipment outside of areas
designated on the site plan must cease. Relocate
within perimeter fencing.
The above captioned required improvements must be completed
no later than January 14, 1979. Upon issuance of a temporary
certificate of occupancy another mutually agreeable time table will
be established to obtain a final certifcate.

In regard to my visit to the Everett G. Emerson property, located
in the Gilpin Industrial Park on Welltown Pike, no major violation of
the health code was noted. However, the sewage system has not been
given final approval, because final grade work over the drainfield area
has not been completed. Proper grading is important in this instances
in order to avoid surface pooling over the drainfield area.
Additionally, the septic tank and distribution box should be
adequately covered, in order to avoid freezing and damage to same.

Dear Mr. Emerson:
With reference to the elevations that we estab-
lished on your property, we are sending a copy of your
site plan with these existing elevations marked in red.
We'd like to make special mention of the fact that your
building slab is 3.20' below the approved plan. We be-
lieve this to be your main problem pertaining to overlot
drainage. We would recommend a new site plan with an
overlot grading design based on the existing slab ele-
vations. We have contacted Lee Ebert, the site plan
engineer, and explained this to him.
Your drainage along Lenoir Drive seems to be satis-
factory since you revised the pipe elevation. This also
should be reflected on your new site plan.
We would recommend that you have your engineer start
on this as soon as possible so as not to interfere with
your obtaining a temporary use permit.
If we can be of any other assistance in this or

Since our letter, dated January 16, 1979, it appears a sig-
nificant amount of progress has been made in correcting code violations
on your project.
To assure continued progress, Mr. Stan Pangle, Public Works
Director, has recommended the posting of a bond in the amount of
ten (10,000.00) thousand dollars. This amount would cover the re-
maining grading, stone base, bituminous surface treatment, ribbon
screening, stabilization etc.
Should you choose to post the bond,court action would no longer
be necessary.

Pursuant to the staff meeting held in this office on February
2, 1979 the following minimum rec-airements must be satisfied before a
temporary certificate of occupanc;- can be issued:
1. A valid plumbing �;>-- rmit must be obtained from the Frederick
County Inspections Office. All work must conform to the
requirements of the BOCA Basic Plumbing Code.
2. Supply to this office a written request for the temporary
use of a portable toilet to service the facility. Prior
to submitting this request all connection fees must be
paid. Occupancy �.ould be limited to two (2) full time
employees until connection to Sanitation Authority lines,
which is projected to be available by September 1, 1979.
Portable toilets =ust be kept in a sanitary condition,
and should be located in the rear of the building.
3. The following site plan requirements must also be com-
pleted prior to occupancy approval:
a. Remove existing wood pile
b. Remove bus and junk cars from site
c. No outside storage except for vehicles connected
with operation of facility
4. Discontinue spray painting operations within building.
Structure is not designed to support this use.
Significant progress in neeting these minimum requirements
must be accomplished by March 31, 1979.

Subject: Performance of Site Plan,
Emerson Property
With reference to our conversation earlier this month, here is a letter
giving amplifying data on the situation of your temporary occupancy permit_
In order to be issued this permit, allowing you to occupy your building
in a legal manner in compliance with the County codes, you need to complete
your grading, stone base, and some stabilization. At our recent meeting you
stated that you would need maybe two years to complete your site plan. Based
on this, we recommended that you put up $10,000 in either a bond, an escrow ac-
count, or a letter of credit to Frederick County. This would enable us to be
assured of the completion of your site plan. After one year we would reappraise
your site plan's status, and if an acceptable amount of work had been accomplished,
we would reduce your bond accordingly. If a low percentage of additional work
had been accomplished, at the end of one year we would then have the option of
using this money at that time to complete your site plan, or going through liti-
gation.
At present, our only choices are to go to court or to have you put up a
bond or like monies so we can issue your temporary occupancy permit_ The stan-
dard procedure after obtaining a temporary occupancy permit from the Inspections
Department would be to complete site and building plans in full within three to
six months at most. This gives you further indication why we would need a bond
or like monies to cover your remaining work.
Additional information on bonding, escrow accounts, and letters of credit:
(1) Bonding -- $10,000 bond for performance of approved site plan. Bonding com-
pany agrees to complete remaining site plan requirements should the applicant
fail to do so, up to the cost specified in the bond. (2) Escrow accounts --
applicant would pay funds into a bank ($10,000) under an agreement by applicant,
the plan -approving authority, and the bank. If the site plan improvements were
completed, the applicant and the authority would sign a joint letter directing
the bank to repay the money to the applicant. Otherwise, if the site plan improve-
ments were not completed, the money would go to the authority to pay for completing
the unfinished portion of the plan, with excess monies being returned to the appli-
cant. (3) Letters of credit -- A letter of credit is an agreement by a bank to pay
a fixed sum of money ($10,000) upon the occurrence of a contingency. In this case,
if the work were not completed as per the site plan, the bank would pay the plan -
approving authority the amount needed to complete the work up to the designated
amount of credit.
Mr. Emerson, we hope we've been able to make our position clear. If further
