In reference to your letter to us on June 28, 1977, regarding the proposed
Cerro Metals Products Site Plan, the following represents our understanding of
the current requirements of the owner.
1) The daily demand for water will be approximately 3,000 gallons
per day.
2) The daily discharge to sanitary sewer will be approximately
2,500 gallons per day.
3) Content of waste discharged to sanitary sewer will be primarily
domestic in nature.
4) There is no fire protection system being planned.

This letter shall represent a formal petition for the amendment of
the Frederick County Zoning Ordinance, Article XII (Industrial,
Limited District, M-1) , Section 12-1-9. It is proposed that
Section 12-1-9 be amended to read as one or the other of the
following alternative amendments:
(1) "Light industrial manufacturing, assembling, processing and
compounding of glass (but only as a component part of the
manufacturing, assembling, processing and compounding thereof) ,
metal and plastic products from prepared and raw materials,
together with associated operations, including machining,
stamping, treating and plating, provided, however, that
plastic or metal compounding and processing shall only involve
previously prepared plastic or metal material and that no
compounding or processing will be done using coke and coals
as fuel." [ Deleting the language in lines 4 and 5, "excluding
punch presses and drop hammers exceeding forty (40) ton rated
capacity."]
(2) "Light industrial manufacturing, assembling, processing and
compounding of glass (but only as a component part of the
manufacturing, assembling, processing and compounding thereof),

metal and plastic products from prepared and raw materials,
together with associated operations including machining,
stamping, treating and plating, excluding punch presses, drop
hammers, or other machinery with a decibel level exceeding
80 db on an impact fast meter response when measured at the
property line; such punch presses, drop hammers, or other
machinery shall produce no vibration which is transmitted through
the ground and is discernible without the aid of instruments at
any point beyond the property line, nor shall any vibration
produce particle velocity of 2.0 inches per second measured at
or beyond the property line. Provided, however, that plastic or
metal compounding and processing shall only involve previously
prepared plastic or metal material and that no compounding or
processing will be done using coke and coals as fuel. [Amending
the language in lines 5 and 6 regarding weight rated capacity,
and substituting therefore decibel and vibration standards.]"
This petition for amendment is presented in order to expedite approval
for the construction of an industrial facility in the Fort Collier
Industrial Estates, all of which is zoned M-1, and to provide Section
12-1-9 of Article XII (M-1) with a more realistic and viable standard
with which to assess punch presses, drop hammers and other related
machinery from a general zoning viewpoint, if the county wishes to
have a standard. If, however, the county feels any standard is too
sophisticated and unenforceable under existing machinery, the county
may decide to omit such standard entirely.
This petition is offered based upon information obtained by the under-
signed from engineers that the current weight -based standard has no
meaning regarding measures of noise and vibration and therefore there
is really no standard at all.

aired this month by the Environ-
mental Protection Agency which
is seeking comments from the
general public and governmental
officials.
The regulations will be dis-
cussed in public meetings on

Wheel and crawler tractors
were identified as major noise
sources on May 28, 1975, with
the publication of an identification
report in the Federal Register.
Within the past year, EPA set
noise standards for portable air
compressors and medium and
heavy trucks. Other construction
equipment, including other mobile
earthmoving equipment and pave-
ment breakers and rock drills are
being considered for regulation
within the next two years.
The standards: EPA categor-
ized wheel and crawler tractors
into various groups which are ar-
ranged by their noise emission
potential. Not -to -exceed noise
emission levels were then set for
each group. Machines that are
manufactured for mining, logging
and agricultural operations, as
well as skid steer loaders and
tractors with integral backhoes
are exempted from this proposed
regulation. The machine noise
level is determined by a stan-
dardized test procedure which re-
quires noise measurements at the
front, sides and rear of a ma-
chine under operating conditions.
