This letter regards the above referenced site inspection. The
following items need to be complete prior to the issuance of a
Final Certificate of Occupancy Permit:
✓1) Stripe entire parking lot on east side of building.
2) Stripe all disabled parking spaces and provide required
sne_for all disabled spaces on east side of building.
3) Complete disabled ramp from parking lot to east side of
building.
4) Stripe pedestrian crossing areas from parking lot to east side
of building.

of building.

9) Provide all outdoor lighting fixtures.
10) Pave entire maneuvering area around building.
11) Provide rip -rap around all RCP, CMP, and drainage ditch areas.

As you are aware, I conducted an inspection of this site
today for a temporary occupancy of Zone #2. At this time I can
not sign off on temporary C.O. for the following:
1. Sprinkler heads in area are still taped up and covered with
aluminum foil from painting operations.
2. Flammable liquids (paint) is stored in the area being
discussed in 55 gallon drums. These must be removed.
3. Locks must be placed on all active P.I.V. valves.
4. Ceilings are required in the temporary office, truck drivers'
lounge, and restrooms. I would agree to sing off on a
temporary on this item provided the contractor agrees to
install by July 1, 1993.
5. Fire extinguishers must be hung by each exit.
Since the building is now occupied and production is
beginning with or without a temporary C.O., Green Bay Packaging
will be expected to adhere to all applicable sections of the
State Fire Prevention Code. This includes maintaining access to
all hydrants and siamese connections at all times.
If you have further questions on this matter please let me
know.

Most all of the items addressed prior to today have been
addressed however the following items are outstanding:
1. Fire lanes at the hydrants and Fire Department Connection
must be posted with signage reading "No Parking - Fire
Lane".
2. Numerical street address must be posted on the front of the
building using 8" numerals on a contrasting colored
background.
3. Sprinkler risers in the manufacturing areas must have design
density placards in place.
4. All spare sprinkler head cabinets must be fully supplied
with spare sprinkler heads.
5. 10# ABC fire extinguishers are needed at each exit from the
office area. (Exits to outdoors)
6. Light fixtures must be in place and all ceiling tiles in
place in meeting room and rest rooms.
I realize that many of these items are already being
addressed and as soon as everything is completed, please let me
know.

The Frederick County Planning Department administratively approved Site Plan #005-93
of Green Bay Packaging on March 5, 1993. The approved site plan calls for the
construction a 96,196 square foot manufacturing and office facility, two (2) parking lots
complete with asphalt paving, 175 regular parking spaces, seven (7) disabled parking spaces,
curb and gutter, raised islands, and perimeter and interior landscaping, a concrete loading
area complete with 24 spaces and concrete curb blocks, pedestrian sidewalks, 11 outdoor
lighting fixtures, stormwater management facilities, a rail spur addition, and all appropriate
erosion and sediment control measures. Enclosed is a copy of the approved site plan for
your records.
Please contact our department to schedule an inspection of this site once all improvements
are complete. All improvements specified on the approved site plan must be finished prior
to the issuance of a Final Certificate of Occupancy Permit.

RE: Land Disturbance Permit For Green Bay Packaging Site.
Dear Mr. Green:
Mr. H. Edward Strawsnyder, Director of Engineering Services, has provided our department
with approval of the grading plan and erosion and sediment control plan for the above
referenced project. Our department will issue a land disturbance permit for this project
once application is made and the fee is paid. This fee includes a $200.00 base fee plus
$25.00 per acre of disturbed area.
I had an opportunity to meet with Mr. Bruce Edens of Greenway Engineering, to conduct
a preliminary site plan review for this project. It is my understanding that Mr. Edens is
submitting the site plan to all review agencies for comment. Once all review agencies have
responded, Mr. Edens should proceed with the site plan application. When this is
accomplished, our department will include this project on our Planning Commission's
Bimonthly report.

Dear Bruce:
This letter regards our telephone conversation on Thursday, November 5, 1992. During that
conversation, we discussed requirements regarding land disturbance at the Green Bay
Packaging site.
It is my understanding that Green Bay Packaging would like to begin rough grading, fill, and
compaction on a portion of this site as soon as possible. In order to accomplish this, the
Frederick County Engineer will need to approve a grading plan and an erosion and
sedimentation control plan. The plans need to specify all required information and should
indicate phasing if the site is to be graded in this fashion.
I will be happy to issue a land disturbance permit for the Green Bay Packaging project once
the County Engineer has approved the grading plan and all appropriate fees are submitted.

This letter is in response to your request for information. In particular, you requested a listing
of potential fees related to manufacturing development. Enclosed is a booklet describing the
various fees associated with commercial and industrial development for your benefit. I wanted
to specifically address your request as well, in the event that certain items are not adequately
addressed by the booklet.
1) Site plans require a submittal fee. This fee includes all reviews, advertisement for
agendas, and site inspections.
2) Stormwater management is addressed as part of the site plan review. This plan is
reviewed by the County Engineer who provides our department with a comment sheet.
If the engineer's review is approved, our department will issue a land disturbance permit
to allow for grading work to commence. There is a fee for the land disturbance permit
if grading work begins prior to final site plan approval.
3) Zoning certificates are issued by the Frederick County Building Official (Mr. John
Trenary). A Temporary Certificate of Occupancy Permit will be issued to allow for the
setup of office and manufacturing equipment. There is a one time fee associated with a
Temporary C.O. A Final Certificate of Occupancy Permit will be issued once all
structural codes, fire protection codes, and required site work is complete.
4) Zoning amendments are considered as revisions to the site plan. As stated in number 1,
the fee for site plan submittal covers all reviews.
5) Plat fees are considered part of the subdivision review process. All required subdivision
plans and plats are reviewed by our department. There is a minimal fee

associated with the recordation of all plats.
6) Our department does not have an improvement plan fee. Once the site plan is approved,
you may improve the site to reflect the plan.
7) Building permits are required prior to construction. Frederick County will grant footer
foundation permits prior to final site plan approval, provided that the footer plans are
reviewed and approved. Electrical, plumbing, mechanical, and structural permits require
review by the Building Inspections Department. The fee for the building permit covers
plans review, permitting, and inspections.
8) There are no administrative and overhead fees associated with reviews of permits. The
fees are based solely on the site plan submittal and the building permit fees.
9) There are no administrative and overhead fees associated with inspections. The Building
Inspections Department will charge for a reinspection if a scheduled inspection that is not
ready is not cancelled.
10) Water and sewer connections are very difficult to explain. Each user potentially falls into
a different category. This is based on the location of the property and the type of service
desired. I would suggest that the Frederick County Sanitation Authority provide you with
as much information as possible based on your site.
I hope this letter addresses your concerns regarding fee schedules. Please refer to the enclosed
booklet for specific questions. I will be happy to assist you with any questions regarding the
Local Development Fees booklet, Frederick County, or this letter.

We are pleased to provide in information you requested in order to
complete your assessment of our community as an expansion site for
Green Bay Packaging.
The first enclosure "Local Development Fees" summarizes local
development costs. A glance at the index will show that it includes
construction, building permits, water and sewer as well as taxes.
Evan Wyatt has provided a thorough transmittal letter to accompany
the data.
The second enclosure, "Virginia: A Guide to Establishing a
Business" comes from Rick McGeorge and provides an excellent
summary of State taxes. It is our understanding that an S
corporation does not affect the rates.
We've also enclosed a tax matrix which will indicates at what level
the taxes are levied which can guide you through the above data.
The State Department of Economic Development can prepare for you a
sample tax bill combining both State and Frederick County levies if
you can provide those values to Rick.
The fourth enclosure deals with business incentives in Virginia,
also provided by Rick McGeorge.
I have the site data on Ft. Collier ready for Gene Green. It and
the environmental data on the site for Brian will be forwarded
tomorrow. I will get to you copies of the transmittal letters.

As requested we have reviewed the above referenced site plan dated September 24, 1992. Our
recommendations may be found on the enclosed plans marked in red and as follows:
1. The two (2) northern entrances should be extended the full 50' width back 60' from
the edge of pavement as noted. This is to avoid truck entering/exiting conflicts.
2. The paved entrance tapers should terminate at the front edge of the gutter pan.
3. The northern entrance pipe needs to be moved back from the edge of pavement and
ditch flared back to the pipe ends.
4. All pipe ends should be mitered.
5. The proposed entrance pavement design should be revised as noted.
6. Drainage easements should be provided to enclose the entrance pipes. The easements
should extend 10' behind the pipes and 10' past the last one.
7. The right-of-way of Park Center Drive (present and future) should be clearly shop..:l.
If it is intended the road be extended later curving to the left as implied by the ra�'al
property line, there may be a conflict with the diversion berm shown.
8. It is unclear whether the detention basin is permanent or temporary. If permanent a
note is to be placed on the plans that the basin will be maintained by the property
owner and that the Virginia Department of Transportation will not be responsible for
any future maintenance or liability responsibilities due to its existence.
9. It appears the ditch along the east side of Park Center Drive is being lowered 2'±.
A typical section should be shown describing shoulder/ditch widths and slopes.

10. The enclosed Xerox copy of the Park Center Drive typical section should be
incorporated into the plan. The lot developer should be made aware any damages to
the Park Center Drive right-of-way during construction of this project will need to be
corrected in accordance with the Park Center Drive typical section.
Once revised please resubmit four (4) copies for final approval. Should any changes be deemed
necessary, please design them to meet or exceed the above recommendations.

Our final review of the site plan documents revealed that the
plans are basically complete i:nd satisfactory except for the
following comments:
1) Sheet 1: The pavement _section specified for the site road
network appears to be too light for the anticipated truck
traffic. It is suggested that the appropriate traffic
loading and intensity be obtained from Green Bay Packaging,
Inc. so that a pavement analysis can be performed to
accommodate the underlying soft clay soils.
2) sheet 1 and 3: Provide design calculations, hydrological as
well as structural, for the proposed triple box culvert.
The above comments will not deter our site plan approval.
However, these issues should be addressed before reaching that
particular phase of construction.

1700 feet of Red Bud Run and the creation of a meandering low
flow channel with an associated flood channel near the Town of
Winchester in Frederick County, Virginia, pursuant to the
Virginia Water Protection Permit Regulations (VR 680-15-02) and
Section 401 of the Clean Water Act Amendments of 1977, Public Law
95-217.
The provisions and conditions contained therein according to
Section 401(a)(1) of the Clean Water Act requires that:

CONDITIONS

1. All construction of the relocated channel shall occur in
the dry, prior to conducting any activity in Red Bud Run.
2. The low water stream channel shall be no less than one
foot wide (bottom width) and no greater than two feet
deep, with side slopes of 1.5:1 and shall meander through
the constructed flood channel.
3. The flood channel shall be approximately forty feet wide,
and five feet deep, with side slopes of 3:1.
4. The low water and flood channels shall have a natural
bottom, the flood channel shall be stabilized with a seed
mix of Japanese millet, annual rye (Lolium temulentum)
and redtop (Aarostis alba). No less than eighty percent
of the area should be vegetated within the first growing
season.
5. To provide shade and riparian zone protection, trees
shall be planted on twenty foot centers, in two rows on
each side of the low flow channel (four rows total), for
a total of 340 trees. The channel -most row of trees
shall be planted approximately ten feet from channel
edge. A survival rate of no less than eighty percent of
the trees within the first three years is acceptable.
6. Riprap shall be -used at the upstream confluence to armour
areas of fill to prevent erosion.
B. General Conditions
1. That all work shall be done in such a manner as to
minimize sedimentation/siltation of State waters in
accordance with Virginia Erosion and Sedimentation
Regulations (VR 625-02-00).
2. That the applicant shall employ measures to prevent
spills of fuels or lubricants into State waters. The
State Water Control Board (SWCB) must be notified if
spills do occur (804/527-5200).
3. That appropriate erosion and sedimentation controls and
practices shall be utilized during construction and until
all disturbed areas have been stabilized.

4. That the conditions and limitations as specified in the
application shall be adhered to during the life of this
proj-ect .
5. That all construction and installation associated with
the project shall be accomplished in such a manner that
construction material or waste material is not to be
discharged into State waters.
6. That the State Water Control Board's VWPP Program staff
shall be notified in writing 10 days prior to operations
authorized under this Permit are to begin so that staff
inspections of the project can be planned if deemed
necessary.
7. The permittee shall advise the Executive Director in
writing when unusual or potentially complex conditions
are encountered which require debris removal or involve
potentially toxic substances, and shall not take measures
to remove the obstruction, material, or toxic substance,
or change the location of the structure until written
approval by the Executive Director or his authorized
representative is received.

MITIGATION, MONITORING AND REPORTING
A. Mitigation Requirement
1. The permittee shall take all reasonable steps to
a) avoid all adverse environmental impact which could
result from the activity,
b) where avoidance is impractical, minimize the adverse
environmental impact, and
c) where impacts cannot be avoided, provide mitigation of
the adverse impact on an in kind basis.
2. The conditions set out in Part I, Section A, 1-5
constitute mitigation for the conversion of stream
channel and riparian habitat to other uses.
B. Monitoring Method
1. Ten photographs shall be taken during the growing season
at representative points along the new channel.
2. Estimates of tree mortality at each photo station shall
be measured by counting the number of dead and live trees
within sixty feet of the photo station.
3. During the first growing season, visual estimates of the
extent of ground cover should be made within a thirty
foot radius of the"photo station.
C. Reporting of Results
1. A post-grading/planting report shall be submitted with
ten photos taken at representative points along the new
channel, along with photocopies of invoices for grass
seed and trees.
2. Brief reports concerning the success of the plantings
shall be submitted on an annual basis for the first three
growing seasons following planting.

MANAGEMENT REQUIREMENTS
A. Duty to Comply
The permittee shall comply with all conditions of the permit.
Nothing in these regulations shall be construed to relieve
the VWPP holder of the duty of comply with all applicable
Federal and State statutes, regulations and toxic standards
and prohibitions. Any permit non-compliance is a violation
of the Act and law, and is grounds for enforcement action,
permit termination, revocation, modification, or denial of a
permit renewal application.
B. Change in Management of Pollutants
All discharges and other activities authorized by this permit
shall be made in accordance with the terms and conditions of
this permit. The permittee shall submit to the Board a new
application 180 days prior to all expansions or process
modifications that would result the discharge of any
pollutant at a level greater than that authorized by this
permit.
C. Duty to Halt or to Reduce Activity
1. It shall not be a defense for a permittee in an
enforcement action that it would have been necessary to
halt or reduce the permitted activity in order to
maintain compliance with the conditions of this permit.
2. The permittee shall take all reasonable steps to
minimize, correct or prevent any discharge in violation
of this permit which has a reasonable likelihood of
adversely affecting human health or the environment.
D. Compliance with State and Federal Law
Nothing in this permit shall be construed to preclude the
institution of any legal action under or relieve the
permittee from any responsibilities, liabilities, or other
penalties established pursuant to any other State law or
regulation or under the authority preserved by Section 510 of
the Clean Water Act.
E. Property Rights
The issuance of this permit does not convey any property
rights in either real or personal property, or any exclusive
privileges, nor does it authorize any injury to private

property or any invasion of personal property rights, nor any
infringement of Federal, State or Local Laws or regulations.
Severability
The provisions of this permit are severable.
Right of Entry
The permittee shall allow authorized State and Federal
representatives, upon the presentation of credentials;
1. To enter the permittee's premises on which the
establishment, outfalls and impacts are to be located or
in which any records are required to be kept under the
terms and conditions of this permit;
2. To have access to and to inspect at reasonable times any
records required to be kept under the terms and
conditions of this permit;
3. To inspect at reasonable times any monitoring equipment
or monitoring method required in this permit. For the
purpose of this section, the time for inspection shall be
deemed reasonable during regular business hours. Nothing
contained herein shall make an inspection time
unreasonable during an emergency.
H. Transferability of Permits
This permit may be transferred to another person by a
permittee if:
1. The current owner notifies the Board 30 days prior to the
proposed transfer of the title to the facility or
property;
2. The notice to the Board of the proposed transfer includes
a written agreement between the existing and proposed new
owner containing a specific date of transfer of the
permit responsibility, coverage and liability between
them; and
3. The Board does not within the 30 day time period notify
the existing owner of its intent to modify or revoke and
reissue the permit. Such a transferred permit shall, as
of the date of the transfer, be as fully effective as if
it had been issued directly to the new permittee.

I. Permit Modification
The applicant shall notify the Board of any modification of
this project and shall demonstrate in a written statement to
the Board that said modification will not violate any
conditions of this permit. If such demonstration cannot be
made, the applicant shall apply to the Board for a
modification of this permit. This permit may be modified
when any of the following developments occur:
1. When additions or alterations have been made to the
affected facility or activity which require the
application of permit conditions that differ from those
of the existing permit or are absent from it.
2. When new information becomes available about the
operation or discharge covered by the permit which was
not available at permit issuance and would have justified
the application of different permit conditions at the
time of permit issuance.
3. When a change is made in the promulgated standards or
regulations on which the permit was based.
4. When changes occur which are subject to "reopener
clauses" in the permit.
5. When the permittee begins or expects to begin to cause
the discharge of any toxic pollutant not reported in the
application.
J. Permit Termination
This permit, after proper hearing, is subject to revocation
for failure to comply with the conditions herein. It is
issued in accordance with the plans for the project and
certifies that the applicant and project contractor shall not
violate Water Quality Standards to accomplish the project.
Any violation of Water Quality Standards will be subject to
abatement and control under State Water Control Law. A
permit can be terminated on any of the following grounds:
1. Noncompliance by the permittee with any condition of the
permit;
2. The permittee's failure in the application or during the
permit issuance process to disclose fully all relevant
facts or the permittee's misrepresentation of any
relevant facts at any time;

3. The permittee's violation of a special or judicial order;
4. A determination that the permitted activity endangers
human health or the environment and can be regulated to
acceptable levels by permit modification or termination;
5. A change in any condition that requires either a
temporary or permanent reduction or elimination of any
discharge of dredged and fill material controlled by the
permit.
K. Civil and Criminal Liability
Nothing in this permit shall be construed to relieve the
permittee from civil and criminal penalties for
noncompliance.
L. Oil and Hazardous Substance Liability
Nothing in this permit shall be construed to preclude the
institution of legal action or relieve the permittee from any
responsibilities, liabilities, or penalties to which the
permittee is or may be subject under Section 311 of the Clean
Water Act or Sections 62.1-44.34(1) through 62.1-44.34(7) of
the law.
M. Unauthorized Discharge of Pollutants
Except in compliance with this permit, it shall be unlawful
for -the permittee to:
1. Discharge into state waters sewage, industrial wastes,
other wastes, or any noxious or deleterious substances,
or,
2. Otherwise alter the physical, chemical, or biological
properties of such state surface waters and make them
detrimental to the public health, or to animal or aquatic
life, or to the uses of such waters for domestic or
industrial consumption, or for recreation, or for other
uses.
