Box 46 Frederick County Bridgewater, VA 22812 Dear George: This is to acknowledge receipt of the above referenced project's revised site plans dated December 11, 1992. It appears all of our earlier recommendations have been satisfactorily addressed with the exception of the location of the 8" watermain serving the project. This main should tie into the proposed 12" watermain within the Route 645 right-of-way opposite the existing 8" watermain serving the opposite side of the road. This will entail the installation of a 8"xl2" cross as detailed on the water line profile on Plan Sheet 9 of 13. Please advise the owner of our approval and that land use permits may now be applied for to cover construction activities within the right-of-way. Two permits will be required; one to cover the installation and maintenance of the commercial entrance and related work and one to cover installation of the utilities. These permits will require a minimal processing fee, surety bond coverage and the salary and expenses of a State assigned Inspector. They will need to be applied for and issued prior to initiation of work. We have also reviewed the easement plat dated December 11, 1992 and it also appears to be acceptable. A deed should now be prepared which dedicates the drainage easements to the County of Frederick. Once the deed and plat have been put to record, we will require a copy for our file and before the permits are marked complete. As a result of this review, we offer the following comments: 1. Stormwater Management Calculations: The proposed site development indicates the use of an existing pond as a stormwater retention basin. The design drawings do not indicate a crest elevation, spillway size or inverts or relative location of the 12" CMP rise which serves as the primary spillway. Based on the design calculations we anticipate that the outlet invert elevation is 694.79. The actual normal pool level should be indicated on the design drawings. A sketch of the existing orifice/weir transition should also be provided to illustrate the pertinent invert elevations. A review of the "C" values adopted for the existing conditions revealed that a value of 0.3 was adopted for the undisturbed grass covered areas. Based on past experience, we recommend that this value be increased to 0.35 to compensate for the development of the perched water table which is common in the Martinsburg shale. The relative increases in post -development "C" values appear to be acceptable except for the 16.80 acre tract located east of the site. The assumption of a 0.35 "C" value does not make provisions for the allowable development in this area. Considering that the existing pond will be utilized as a regional stormwater retention structure for this portion of the industrial/business park, the maximum potential development should be used in the stormwater analysis. This particular property allows for a minimum of 25 percent open space leaving 75 percent that can be totally developed into parking, roads, and buildings. The remaining open space should utilize a value of 0.35. It is anticipated that adoption of the higher post -development "C" values will yield much higher post -development 10 year storm flows than are currently reflected in the design calculations. In order to adequately evaluate the existing pond's capability to serve as a stormwater retention structure, it will be necessary to establish accurate cross -sections of the dam and detailed sections of the relative spillways. Also, it will be necessary to route the 100 year post -development storm through the emergency spillway'to verify adequacy and stability of the existing embankments. It appears that the undetained post -developed flows have been compared to the pre -developed flows to determine allowable release rates. These calculations should be repeated after re-evaluating the flow rates using the revised "C" values to maintain the pre -developed 10 year flows impacting Buffalo Lick Run. We recommend that the calculations be revised to reflect the above comments and resubmitted for our review. 2. Design Drawings: Sheet 1 of 11 : General note #7 refers to compliance with recommendations of the geotechnical engineer. This note implies that'a geotechnical study has been performed for this site. A copy of this study should be submitted to this office for our records. Sheet 2 of 11: Indicate the normal pool elevation of the existing pond. Also, add the location of the 12" CMP riser and associated piping with pertinent inverts. Sheet 6 of 11: Indicate the relative size of the rip -rap required as outlet protection. Also, design the temporary gravel construction entrance by specifying stone size and length of entrance. Specify relative size of the proposed sediment traps. These traps should be provided at each major storm drainage outlet during the earthwork phase of construction. Dear Mr. Neville: This letter is in response to your correspondence dated November 23, 1992. The purpose of this letter is to inform PHR&A of Frederick County's position regarding the above referenced plan. The revised Master Development Plan for this site was approved by our department on November 16, 1992, and by the County Administrator on November 18, 1992. The approved Master Development Plan specifies that there is 0.5 acres of steep slope (15% slope or greater) north of Route 645 (Airport Road) and 5.1 acres of steep slope south of Route 645. Therefore, the revised Master Development Plan was approved with the understanding that a total of 5.6 acres of steep slope exists on this site, of which 1.4 acres may be disturbed. Section 19-1-480 defines disturbance as "the act of stripping vegetation, disturbing the soil, regrading, or development of the land." With this in mind, the grading and utilities plan needs to include all utility line installation displayed in the red shaded areas as disturbed steep slope. The regional sanitary sewer pump station is required in order to develop this site. The pump station will be included as part of the disturbed steep slope area. Your letter states that Silver Communities will retain the second knoll south of Route 645 (Airport Road). The revised Master Development Plan was approved with this area specified as "future residential development". The Airport Authority strongly recommends that residential units not be built within the Airport Support Area for reasons associated with perceived and real noise and fly -over nuisance. The story is a very old one and has been told for many years at numerous locations throughout the Country. Residential development occurs near an airport, people move in, discover the airport, and immediately begin complaining about aircraft noise. As a result, aeronautical activity and air commerce is restricted. If the proposed Preston Place development becomes a reality, the story will be told again... this time in Winchester. At the time the subject property was rezoned, there was no universal noise policy or "noise savvy", therefore, the issue slipped by all concerned including the Airport Authority, the Virginia Department of Aviation, and consultants. These entities simply had no reason to object to residential development at the site of the proposed Preston Place. Federal Aviation Administration (FAA) guidelines were followed, unfortunately they only addressed noise levels above 65 Ldn' (the property is located at the 50 - 55 Ldn). Since then, a National awareness of residential encroachment on airports and resulting noise problems has been developed and verbalized. The FAA is now aware that aircraft noise does not stop at the 65 Ldn line and airports are pressing the Federal Government for a National Noise Policy that may eliminate future airport residential encroachment. We offer the following recommendations which we believe may reduce the impact of a potentially unfavorable situation. 1• Day -Night Average Noise Levels. • 0 Response to Request for Comments Preston Place Apartments December 10, 1992 Page 2 a. Encourage the developer to present unequivocal notice of probable aircraft noise and fly -over nuisance to be given to all potential apartment tenants. Specifically, the following actions should be taken: (1) Requirement to present a dominant statement of probable aircraft noise and fly -over nuisance in rental agreements/leases. (2) Requirement to post prominent warnings with specific regard to the proximity of the airport and probable aircraft noise and fly -over nuisance on all advertisements, brochures and promotional materials. b. Require acoustical treatment of the apartment building(s), i.e., appropriate noise insulation, baffled vents, air conditioning, etc. We appreciate the difficult position Frederick County officials continuously face concerning zoning hindsight and the extremely difficult position we are suggesting with respect to potential airport noise problems. The airport is a significant public investment and an important economic development tool which, if protected from residential encroachment, will serve our growing community and the region for years to come. Such neighborhoods should be provided with an appropriate balance between residential, service and employment uses. Such a balance will lessen the overall impacts of such planned communities on the County as a whole. The planned community regulations and procedures are intended to allow design flexibility while minimizing impacts on surrounding areas. Performance standards are used to control the intensity of development and to provide for well designed neighborhoods. Appropriate amenities are required including open space, recreation, and pedestrian access. New planned communities must be provided with access to roads and facilities with sufficient capacity to serve the area.. Before planned communities areas are established, new or improved roads and facilities should be provided or planned to. be provided in coordination with the scheduled development. The owners of the new planned community will be expected to contribute a reasonable portion of the costs of new road and facility capacity needed to serve the new urban area. Such contributions can be in the form of cash, dedicated land, or constructed improvements. New planned communities will be established in the Urban Development Area. They should only be allowed if there is currently sufficient capacity in the roads and public facilities to serve the proposed development. Issues: Careful plans for facilities and improvements are needed in association with planned communities. How should the potential impacts of large scale planned developments be handled? Airport Support Area Conflicts between airports and residential development can be significant in growing communities. Residents of areas in the vicinity of the airport tend to oppose airport activities and the expansion of such activities because of concern for noise and fly-overs. The Winchester Regional Airport Authority has recommended that an airport support area be included in the plan. The airport support area is an area in which further resi- dential rezonings will be limited in order to protect fly -over areas and noise sensitive areas. It will also be established to insure the feasibility of continued airport use and future airport expansion. Business and industrial uses should be the primary uses in the airport support area. If new residential areas are allowed in the airport support area, avigation easements or other methods should be used to protect the operations at the airport. For the reasons outlined below, it may be necessary to disturb a small amount of site area more than the 25% of steep sloes allowed under Section 3-6-8 of the Ordinance. It would be greatly appreciated if you could give some indication of whether the areas we propose for grading would be within the discretion of the Zoning Administrator to allow in excess of the 25% guideline. If necessary, PHR&A will request an official administrator's determination either prior to or concurrently with the site plan submission. The enclosed gradio plan illustrates the current layout which proposes several minor changes in building location. These are in response to the Fire Marshall's comments on the master development plan. The 15% or greater slopes (shaded in red) have been calculated by measuring between the ten foot contour intervals. This method provides the best representation of significant slope areas and allows a better evaluation of which areas should be protected. The cross -hatched areas highlight those steep slopes which will be disturbed and altered due to regrading activities. At this time, we are currently proposing to delete the asphalt walk down to the floodplain and have assumed that temporary grading for installation of utility lines does not constitute a disturbance or regrading of existing open meadow conditions. Generally, the side slopes of the Buffalo Lick Run stream valley will remain undisturbed and protected within common open space. The area of greatest impact on 15% slopes is along the tributary which contains the existing pond. We consider that most impacts on the environmental quality of the site through development in this area are offset by the stormwater management capabilities of the pond and the distance away from the main stream valley. C� r �G 92 L� 0 0 Preston Place Apartments November 23, 1992 Page 2 In order to determine conformance with Ordinance Section 3-&8 we have prepared the following tabulation. The total area of steep slopes calculated south of Route 645 has decreased from the Master Development Plan due to better accuracy of the larger scale drawing and the methodology of measuring along the 10 foot contour interval. Total Area South of Route 645 4.4 acres of steep slopes existing 1.1 acres proposed disturbance (25%) Apartment area only (excluding future residential) 3.4 acres of steep slopes existing 1.1 acres proposed disturbance (32%) The current proposal by Silver Communities to retain the second knoll south of Route 645 for future development would push the apartment land out of conformance if considered alone. The amount of disturbed steep slope which exceeds the permitted 25% equals approximately 0.25 acres and is largely due to the grading required for the regional sanitary sewer pump station and access road. If this facility may be considered a public health benefit for the area and would provide justification for up to 32% steep slope disturbance, we would feel comfortable in proceeding with the site as designer I hope that your preliminary review of this plan will help to resolve one critical issue in advance and will assist in streamlining the site plan application. It would be greatly appreciated if you could give some indication of whether the areas we propose for grading would be within the discretion of the Zoning Administrator to allow in excess of the 25% guideline. If necessary, PHR&A will request an official administrator's determination either prior to or concurrently with the site plan submission. The enclosed grading plan illustrates the current layout which proposes several minor changes in building location. These are in response to the Fire Marshall's comments on the master development plan. The 15% or greater slopes (shaded in red) have been calculated by measuring between the ten foot contour intervals. This method provides the best representation of significant slope areas and allows a better evaluation of which areas should be protected. The cross -hatched areas highlight those steep slopes which will be disturbed and altered due to regrading activities. At this time, we are currently proposing to delete the asphalt walk down to the floodplain and have assumed that temporary grading for installation of utility lines does not constitute a disturbance or regrading of existing open meadow conditions. Generally, the side slopes of the Buffalo Lick Run stream valley will remain undisturbed and protected within common open space. The area of greatest impact on 15% slopes is along the tributary which contains the existing pond. We consider that most impacts on the environmental quality of the site through development in this area are offset by the stormwater management capabilities of the pond and the distance away from the main stream valley. The Pond is the same pond described in the Pond Easement Agreement dated October 20, 1989, and recorded in the Clerk's Office in Deed Book 729, at page 792 (the "Pond Easement Agreement"), and the Partnership and Silver hereby confirm that the Partnership Property, the Northern Parcel and the 2 Acre Parcel have the benefit of the Pond Easement Agreement.
