Dear Mr. Robinson:
The Frederick County Planning Department administratively approved Site Plan #033-93
of the North Frederick Pike Sheetz Convenience Store on November 9, 1993. The approved
site plan calls for the installation of a new commercial entrance off of Fox Drive, the
construction of an additional concrete parking lot area complete with 36 regular parking
spaces, two disabled parking spaces that are van accessible, van accessible signage and
ramps, outdoor lighting, and perimeter landscaping, additional concrete sidewalks that are
four feet wide, and all appropriate erosion and sedimentation control measures.
I have enclosed two copies of the approved site plan. This will enable you to have a copy
for the job site and keep a copy for your files. Please contact this office to schedule an on -
site inspection once all improvements are complete.

plan application will not be accepted by the planning department.

This is to follow-up on our telephone conversation this morning concerning a proposed property
line revision to the referenced project.
As discussed we have no objection to the change. However, since the proposed commercial
entrance on Fox Drive will now split the property line, a joint use agreement between both
parties will be necessary. Said agreement will be necessary before we can issue a land use
permit to cover construction of the entrance. I am enclosing an example copy of such an
agreement for your use.
The owner of the Russon Property should also be aware our current offset requirements will still
need to be met if a commercial entrance is planned for that property.
In order to issue the land use permit, please provide us with the recorded original of the joint
use agreement and six (6) sets of the revised site plans.

We are in receipt of the referenced project's revised site plans dated October 5, 1993. It
appears all of our earlier recommendations have been satisfactorily addressed.
Please advise the owner of our approval and that a land use permit may now be applied for to
cover the right-of-way improvements. Said permit is issued by this office and will require a
minimal processing fee and surety bond coverage. A permit of this nature normally takes
approximately thirty (30) days to process and issue once satisfactory application has been made.
Also, please remind the owner the right-of-way dedication to Frederick County to accommodate
the roadway improvements will need to be made before we can mark the permit complete. We
would appreciate the opportunity to review the deed of dedication and plat prior to its
recordation.

I am very concerned about the traffic patterns that will be
created by approval of this entrance to an area already quite
congested. The site plan submitted shows the Russon property t
the South as being "undevelcped." This is not entirely accurate
as Mr. Russon's property to the West is developed with townhouses
and the access road to his development runs off of Rt. 739 near
this proposed entrance.
Also not shown on this plan is the entrance from Rt. 739 to
Sunnyside Plaza Shopping Center.
This new entrance will make a total of five (5) entrances
from Rt. 739 in less than two tenths of a mile. lt- is an
er,tremely congested intersection approaching Rt. 522 and there is
no alignment of these entrances across from one another.
My concern is the resulting traffic patterns and confusion
create; is going to sign_ficantly impact Fire and Rescue from the
stand point of accidents create, in this area. The problem is

As requested we have reviewed the referenced project's site plan dated
July 20, 1993. Our recommendations may be found on the enclosed plans marked in
red and as follows:
1. In order to match the store's existing entrance on Route 739, a Standard
CG-10A design will be required.
2. A right-of-way dedication will need to be made to Frederick County to
accommodate the curb & gutter extension and widening. Also, the previous
right-of-way dedication made in 1992 should be incorporated into the plan.
3. The proposed CG-6 curb & gutter on the south side of the entrance will need
to be extended to the property line.
4. The entrance pipe ends should be mitered in lieu of using ES-1 end sections.
5. The entrance radii lengths should be included on the plan.
Please revise and resubmit six (6) copies for final approval. Should any changes
be deemed necessary, please design them to meet or exceed the above
recommendations.

I'm writing this in regard_; to a site plan submitted for the

stand point of accidents created in this area. The problem is
severely compounded in the A.M. when a heavy traffic volume is
present going toward James Wood Ridge Campus, and in the
afternoon when school is dismissed.
Please revisit this plan, considering not only the other
existing entrances but future entrances requested when Mr.
Russon's B-2 property is developed. I feel approving this

Dear John:
The stormwater calculations submitted with the revised site plan
has adequately addressed the increased runoff generated by the
proposed parking. The revised site plan dated July 20, 1993,
indicates that the existing stormwater detention structure will be
regraded to accommodate the additional storm runoff.
Appropriate erosion and sediment control measures should be
included on the proposed site plan. It will not be necessary to
resubmit the site plan with these revisions, however, we would
appreciate a final revised copy for our records.
