Denial of Rezoning Request #014-89 of Mrs. Bruce E. Downing to rezone 1.791
acres from RA (rural area) to B-1 (neighborhood business). Property was intended
to be sold for business use. The property is located on the east side of Blossom
Drive (route 185) and the south side of route 7 east, in the Stonewall
Magisterial District.

LOCATION: The frontage begins at the corner of the east side of
Blossom Drive (Route 185) and the south side of Route 7 East.
MAGISTERIAL DISTRICT: Stonewall
ADJACENT LAND USE AND ZONING: Residences zoned RP, Residential
Performance
PROPOSED USE AND IMPROVEMENTS: Property to be resold for
business use.
REVIEW EVALUATIONS:
Virginia Dept. of Transportation - No objections to
rezoning. Before development, VDOT will require a complete
set of construction plans for review. Any work performed
on the State's right-of-way will be covered under a land
use permit. The permit is issued by VDOT's office and
requires a fee and surety bond coverage.
Sanitation Authority - Water is available along the
frontage of the property. Sewer is available along
Cardinal Drive, located to the rear of the property. There
is water and sewer capacity available.
Health Department - No objection; property served by
central utilities.
Winchester Regional Airport - Regardless of the zoning of
this property, it falls within the Airport Zoning District,
which restricts the construction of structures into
protected airspace within 12,000 feet of the airport
reference point. Recommend that the Airport Zoning
District be addressed in any rezoning documents.
Frederick County Fire Marshal - Fire protection plans for
this site will be made on site plans and/or construction
drawings.

Downing Rezoning
Inspections Department - This request for rezoning shall
comply to Use Group B (Business), Section 303.0 of the BOCA
National Building Code, 1987. The use group will be
determined at the time of plans review.
Planning and Zoning - The following issues should be
considered:
Location: The site is located in the vicinity of an
interchange area along the Route 7 business corridor. It
is the opinion of the staff that the proposed rezoning does
not conflict with the Comprehensive Plan. Existing B-2
zoning is located across Blossom Drive and Route 7 from the
site. Residences zoned RP in the Shenandoah Hills
development are immediately adjacent to the rear.
Site Suitability: The request is to rezone a long and
narrow lot for Business General use. The lot has over 600
feet of frontage on Route 7 but is not deeper than 140
feet. To develop the lot under B-1 zoning, a minimum 50
foot buffer will be required along the rear of the lot and
a 35 foot front setback will be required. Over most of the
lot, less than 50 feet of buildable depth will remain.
However, parking will be allowed in the front setback yard
and so B-1 development is possible. Some steep embankments
and other difficult terrain on the site will provide some
engineering challenges for development.
Projected Impacts: It can be projected that the development
of the site could result in an increase in traffic
generated from the site by more than 1,000 average daily
trips. However, the site is located on a major four lane
divided highway with sufficient capacity to handle the
additional traffic. Great care will be needed in designing
entrances. The crossover on Route 7 is at Blossom Drive
and the plat of the lot shows an entrance easement. to
Blossom Drive from the site. This entrance will. be
necessary to provide adequate ingress and egress.
Additional entrance improvements may be needed at Blossom
Drive and at any additional entrance directly onto Route 7.
Requirements for buffers and screens in relation to the
lots in Shenandoah Hills will reduce potential impacts on
adjoining residential properties.
Conclusions: The shape and terrain of the lot in question
will provide certain design difficulties. Proper entrance
design will be critical. However, the site is located in
the immediate vicinity of other similar tracts zoned for
business use.
