WHEREAS, Rezoning application #013-89 of Capitol Properties, Inc. to rezone 22.23 acres from RA (Rural Areas) to B-2 (Business General), located south and adjacent to State Route 277, and east of State Route 641 approximately 1.5 miles east of Stephens City, tax map 86, parcel 80, in the Opequon District was referred to the Planning Commission on August 2, 1989; and WHEREAS, the Planning Commission held a public hearing on this application on September 6, 1989; and WHEREAS, the Planning Commission received a draft statement of conditions proffered prior to the public hearing; and WHEREAS, the Board of Supervisors held a public hearing on this application on October 11,1989; and WHEREAS, the Board of Supervisors received a signed statement of conditions proffered prior to the public hearing; and WHEREAS, the Frederick County Board of Supervisors finds this rezoning to be in the best interest of the public health, safety, welfare, convenience and good zoning practice; THEREFORE, RESOLVED by the Frederick County Board of Supervisors as follows: That Chapter 21 of the Frederick County Code, Zoning Ordinance, is amended to revise the Zoning District Map to change 22.23 acres from RA (Rural Areas) to B-2 (Business General) located south and adjacent to State Route 277 and east of State Route 641, approximately 1.5 miles east of Stephens City, tax map 86, parcel 80, in the Opequon District as described by the application and plat submitted, subject to the following conditions voluntarily proffered in writing by the applicant and property owner as follows: • 0 REZONING PROFFERS APPLICATION #013-89 We the undersigned, sole owners and the rezoning applicant for the Subject Property, hereby voluntarily proffer that in the event the Subject Property is rezoned by the Board of Supervisors of Frederick County, Virginia to the B-2 zoning district, the development of the property shall be in substantial conformance with the following conditions: (A) Transportation (1) The applicant supports the proposed Golladay Expressway in concept and the proposed route as conceptually shown on the Preliminary Alignment plat prepared by Gilbert W. Clifford & Associates, Inc., hereafter referred to and attached hereto as Exhibit #1. (2) Access to the property shall be provided via Virginia Route 277. There shall be a maximum of three (3) curb cuts or access points onto Route 277. Applicant shall reserve one (1) of these access points for connection to the Golladay Expressway. Internal access shall be provided to all uses and lots on the subject property so that all uses can be mutually accessed without entering onto Route 277. 0 E D F,FSEP 81989 I1 (3) Applicant shall dedicate necessary right-of-way for right and left turn lanes and bond for construction of said right and left turn lanes for each access point, in accordance with VDOT standards, at site plan approval. All work required for up to three adequate road connection including improvements within the VDOT right of way of Route 277 shall be constructed or funded by applicant less and except a traffic light system which, if necessary, shall be provided by others. (B) Screening and Buffering (1) Existing trees with a trunk diameter greater than six (6) inches shall be preserved if possible. Buffer strips along the southern and western property line shall be preserved at a minimum of twenty (20) feet in width. Trees six inches (611) and above in diameter shall be catalogued. If more than 25% of these trees must be removed to effectively develop this site, then a deciduous sapling not less than six feet (61) in height shall be placed in another location on site, for each tree displaced. (2) A minimum of five percent (5%) of the interior of the parking lot shall be landscaped planting islands. Existing vegetation may be retained where practical. Vegetation for the planting islands may include a mixture of trees, shrubs, flowers, and grass. r i -_ N SEP i 81989 u R (3) All exterior lighting shall be directed on -site and shall be non -glare so as to minimize the impact on the adjoining properties. (4) A minimum spacing of 50 feet shall be provided between all freestanding business signs. No business sign shall exceed 100 square feet in size. (5) Deed restrictions, covenants, dedications, or development -related documents shall be submitted to and reviewed by the Zoning Administrator prior to their recordation to insure that provisions have been made for coordination of uses, architectural styles, signs, and landscaping. (C) Sewer The applicant shall secure sewer access from the north. Sewer will be brought to the site at no expense to Frederick County. (D) Storm Water Management A storm water management system, including silt fences and run-off ponds, shall be in place prior to the commencement of any grading work. (E) Phasing It is expected that full development of this site will require several years. Permits for individual uses in accordance with B-2 zoning may be requested at any time prior to full build -out. Construction of the SEP 8 w I 1,, development on the site in phases is likely and such phases shall be specified on the Master Development Plan, when submitted. These proffers shall be binding upon the heirs, executors, administrators, assigns,and successors in interest of both the applicant and property owners. This document shall set forth the total obligation of the applicant and property owners to the County of Frederick in connection with the rezoning of the site. Consequently, the applicant's and property owners' obligation shall not be subject to future modification or enlargement without the express written concurrence or consent of the current property owner(s), applicant, or their successors and assigns. MAGISTERIAL DISTRICT: Opequon ADJACENT LAND USE AND ZONING: Residential uses and vacant land zoned RA, Rural Areas and RP, Residential Performance PROPOSED USE AND IMPROVEMENTS: One-story structures as allowed by the ordinance for a shopping center. REVIEW EVALUATIONS: Vir inia Dept. of Transportation - No objections to rezoning. Before development, VDOT will require a complete set of construction plans for review. Any work performed on the State's right-of-way will be covered under a land use permit. Sanitation Authority - Sewer is available at the intersection of VA. Rt. 277 and State Rt. 641 (approx. 1,7001). Water is available along the property frontage. There is sufficient water capacity. Sewer capacity will be available by September, 1989. Health _Department - No objection as long as the project is served by central water and sewer service. Winchester Regional Airport - Owner/Developer must review Airport Zoning District restrictions and comply. Frederick County Fire Marshal - I see no problems with this rezoning due to other business uses in the area. Fire protection will be reviewed on site plan or construction drawings. Page 2 Capitol Properties Rezoninf6 Inspections Department - This request for rezoning shall comply to Use Group M (Mercantile), Section 308.0 of the BOCA National Building Code, 1987. Planning and Zoning - The following issues should be considered: Location: The site is located adjacent to the urban development area on Route 277 (Route 277 is the urban development area boundary). The site is located beyond the current interchange business area. In terms of location, the site raises the question of whether the County wishes to extend the Route 277 business corridor beyond the existing areas. The Comprehensive Plan does not rule this possibility out. At some point along Route 277, the business corridor should end. The Urban Development Area extends east to Route 636 on the north side of Route 277. Perhaps the business corridor could be allowed to extend along the south side of the Route 277 to Route 636. However, such extension should only occur if Route 277 can accommodate the resulting traffic impacts. Site Suitability: The site is generally suitable for the proposed development. Additional information is needed concerning how sewer service will be extended to the site. Potential Impacts: Existing residences are located immediately across Route 277 from this site. If the site is rezoned to B-2 care will need to be taken in relation to those residences. Buffers and screens will be required along the front of the site in relation to those residences. An impact analysis has been provided by the applicant and the staff generally concurs with that analysis. The staff projects that between 12,000 and 15,000 average daily trips would result from the proposed rezoning. According to information from VDOT's 1989 Statewide transportation plan, the daily acceptable traffic volume for Route 277 is between 3,000 and 4,000 average daily trips. The latest traffic counts for Route 277 in this area are close to 5,000 vehicles per day. The current design of Route 277 may not be sufficient to carry substantially increased traffic. Conclusions: The proposed rezoning would probably be an appropriate extension of the Route 277 business corridor. However, great concern should be expressed over the ability of Route 277 to carry the traffic generated by the rezoning. The County has requested that improvements to Route 277 be added to the VDOT Primary Allocation Program but such improvements have not been added by VDOT. Additional information is needed concerning the capacity of Page 3 Capitol Properties Rezoning #013-89 0 to Route 277 and the types of road improvements that might be proposed to alleviate such concerns. June 1989 Introduction DF , JUN 3 0 1989 I The firm of Gilbert W. Clifford & Associates, Inc. has been commissioned to evaluate the above referenced project in light of several major planning issues, as outlined and required by the Frederick County Board of Supervisors. This document is prepared in support of and in preparation to rezone the property from present Agricultural, General District(A-2) to Business, General District (B-2). 1 ) Traffic Imp The estimated 300,000 square feet of retail floor space created by this project will result in approximately 12100 trips per weekday of traffic primarily from the residences in the Fred ericktowne/Stephens Run area. The project must improve Route 277 along its frontage to handle the increased traffic volume generated. 2. Sewage Conveyance and Treatment Impacts: Sewer service to this site must be extended in one of three methods all involving a need for pumps: 1) Route 277 to intersection with Route 277 and Route 641. 2) East on Route 277 to 4 force main connections from the Sherando Park. 3) North across Route 277 to a connection with the extended Wrights Run sewer system through the Jefferson Village/Georgetown Court projects. This project will generate approximately 40,000 gallons per day of waste flow with a peak rate of 70 gpm. All flows will be treated at the Parkins Mill ATW or the Stephens Run ATW. This project would connect to the existing 12" water supply system located on the south side of Rte 277. This line is part of the new transmission main supplying the eastern portion of the county with water from the Frederick County Sanitation Authority system. There are no known limitations in the water system which would preclude the use of the property as shown. The project will utilize the same amount of water as projected in sewage flow or 40,000 gallons per day. This project will generate no school children and therefore have no effect on educational cost in Frederick County. It will generate tax revenues with a net worth of approximately $60.00 per square foot and a tax base of $18,000,000 which totals at a tax rate of $.60 approximately $180,000 per year of tax revenue. This would be without the need for expenditures other than Sheriff protection. Also, not estimated is sales tax return. 5. Parks and Recreation Cost: This project would result in no impact on Parks and Recreation budget. The development of commercial in lieu of agricultural will increase run off in larger amounts over that which would be created in potential residential use. It is recommended that storm water detention calculations be presented with final design which would show no adverse impacts created by the imposition of this increase storm water. Sheriff protection will be required by this facility. Routine patrols of the Stephens Run area should suffice for the majority of time and materials necessary to cover this facility also. Special patrols and activities may include a total of 2 hour per week. Special coverage at $50.00 per hour would involve approximately $5200.00 per year. There should be no other impacts on emergency services. Solid waste will be exported by contract hauler at no cost to the County. 9. Environmental Impacts: There will be certain minor negative impacts due to the construction activity including run off sediment, noise and traffic movements. These are to be minimized by proper compliance with local and state laws for environmental protection. An increase in run off quantity and a decrease in quality is probable from this development. The effects on the downstream impoundment and stream are minimal and in accordance with local and state regulations. There is no known loss of irretrievable resources involved with this project. There are no known endangered species of fauna, flora or wildlife which will be effected by this project. Ground water and air quality should be unaffected. A minor impact of a negative nature is associated with lighting for security and business use. These should be closely controlled during planning stage to minimize the adverse impacts on adjacent residential structures and impacts on the traveling public. 10. Other Fiscal Impacts: Mentioned above is the positive impact on the County financial picture. No other impacts were noted. 11. June 1989 Introduction JUN 3 0 1989 I �Vl The firm of Gilbert W. Clifford & Associates, Inc. has been commissioned to evaluate the above referenced project in light of several major planning issues, as outlined and required by the Frederick County Board of Supervisors. This document is prepared in support of and in preparation to rezone the property from present Agricultural, General District(A-2) to Business, General District (B-2). 1 ) Traffic Imp The estimated 300,000 square feet of retail floor space created by this project will result in approximately 12100 trips per weekday of traffic primarily from the residences in the Fredericktowne/Stephens Run area. The project must improve Route 277 along its frontage to handle the increased traffic volume generated. 2. Sewage Conveyance and Treatment Imp: Sewer service to this site must be extended in one of three methods all involving a need for pumps: 1) Route 277 to intersection with Route 277 and Route 641. 2) East on Route 277 to 4 force main connections from the Sherando Park. 3) North across Route 277 to a connection with the extended Wrights Run sewer system through the Jefferson Village/Georgetown Court projects. This project will generate approximately 40,000 gallons per day of waste flow with a peak rate of 70 gpm. All flows will be treated at the Parkins Mill AT"f or the Stephens Run ATW. 46 0 3. Water Supply Impacts: This project would connect to the existing 12" water supply system located on the south side of Rte 277. This line is part of the new transmission main supplying the eastern portion of the county with water from the Frederick County Sanitation Authority system. There are no known limitations in the water system which would preclude the use of the property as shown. The project will utilize the same amount of water as projected in sewage flow or 40,000 gallons per day. This project will generate no school children and therefore have no effect on educational cost in Frederick County. It will generate tax revenues with a net worth of approximately $60.00 per square foot and a tax base of $18,000,000 which totals at a tax rate of $.60 approximately $180,000 per year of tax revenue. This would be without the need for expenditures other than Sheriff protection. Also, not estimated is sales tax return. 5. Parks and Recreation Cost: This project would result in no impact on Parks and Recreation budget. The development of commercial in lieu of agricultural will increase run off in larger amounts over that which would be created in potential residential use. It is recommended that storm water detention calculations be presented with final design which would show no adverse impacts created by the imposition of this increase storm water. 7. Emergency Services Cost: Sheriff protection will be required by this facility. Routine patrols of the Stephens Run area should suffice for the majority of time and materials necessary to cover this facility also. Special patrols and activities may include a total of 2 hour per week. Special coverage at $50.00 per hour would involve approximately $5200.00 per year. There should be no other impacts on emergency services. �� • • Solid waste will be exported by contract hauler at no cost to the County. 9. Environmental Imp: There will be certain minor negative impact,--jue1lto the construction activity including run off sediment, noise and traffic movements. These are to be minimized by proper compliance with local and state laws for environmental protection. An increase in run off quantity and a decrease in quality is probable from this development. The effects on the downstream impoundment and stream are minimal and in accordance with local and state regulations. There is no known loss of irretrievable resources involved with this project. There are no known endangered species of fauna, flora or wildlife which will be effected by this project. Ground water and air quality should be unaffected. A minor impact of a negative nature is associated with lighting for security and business use. These should be closely controlled during planning stage to minimize the adverse impacts on adjacent residential structures and impacts on the traveling public. 10. Other Fiscal Impacts: Mentioned above is the positive impact on the County financial picture. No other impacts were noted. 11.
