their meeting of October 11, 1989:
Approval of Rezoning Request #010-89 of Wilkins Development Corporation to rezone
2.388 acres from RP (Residential Performance) to B-1 (Neighborhood Business) for
commercial uses. This property is located on the south side of Route 7,
approximately 1/4 mile east of the intersection of Route 656 South, in the
Shawnee Magisterial District.

LOCATION: South side of Route 7, approximately 1/4 mile east of
the intersection of Route 656 South.
MAGISTERIAL DISTRICT: Shawnee
ADJACENT LAND USE AND ZONING: Vacant land zoned RP, Residential
Performance and residences and businesses zoned RA, R ral Areas

PROPOSED USE AND IMPROVEMENTS: Commercial uses.
REVIEW EVALUATIONS:
Virginia Dept. of Transportation - No objections to
rezoning. Before development, VDOT will require a complete
set of construction plans for review. An entrance will
have to be constructed to allow for safe egress and ingress
of the property. Any work performed on the state's right-
of-way will be covered under a land use permit.
Sanitation Authority - Water line is on Route 7, same side
as site. There is also proposed development south of the
site. At this time, the closest sewer is about 2,000 feet
away in Shenandoah Heights. There is proposed construction
behind the site which could make sewer available. (see
attached drawings.) Water and sewer capacity is available
at this time.
Health Department - No objection; project to be served by
central water and sewer service.
Frederick County Fire Marshal - Fire protection plan
(hydrant location, fire lanes, etc.) will have to be
submitted for approval on the site plan and/or construction
drawings.
Inspections Department - Use group to be determined at time
of plans review. Will have to comply with the BOCA

Planning and Zoning - The following issues should be
considered:
Location: The site is located in the urban development
area along a major highway outside of an interchange
business area. No business zoning is in the vicinity of
the site. Some existing businesses are located in the
vicinity along Route 7 on land zoned RA, Rural Areas. The
intent of the B-1, Neighborhood Business District is to
establish a business area to serve surrounding residential
areas. Such an area at this location could provide for
convenience shopping for the developments east of Greenwood
Road. However, the site may not be highly accessible to
those developments.
Site Suitability: Much of the site contains either steep
slopes or floodplain. The floodplain portions can be
developed following the flood proofing and other
requirements of the floodplain zoning district. This site
has direct motor vehicle access only to the east bound lane
of Route 7.
Potential Impacts: Adverse impacts on surrounding
properties would not be expected because of the terrain and
the requirments of the zoning ordinance. Full development
of the site could result in increased average daily trip
generation of over 1500 trips. However, the site has
access to a major divided highway with capacity to carry
such traffic. Great care would be needed in the design of
ingress and egress to the site.
Conclusions: It is the opinion of the staff that it is
appropriate to locate a neighborhood business site on a
major collector or arterial road in a location surrounded
by residential development. This site provides certain
physical and access difficulties.

THIS DEED —de and dated this 24th day of June, 1964, by and between
W. E. Edwards, Executor of George W. Stump, Deceased, party of the first part,
and Wilkins Development Corporation, party of the second part.
WHEREAS, the party of the first part acting pursuant to the
authority contained in the will of the late George W. Stump duly probated
and of record in the Clerk's Office of the Circuit Court of Frederick County,
Virginia, in Will Book No. 65, page 388, offered the hereinafter described
parcel of land for sale at public auction in front of the Frederick County
Court House at Winchester, Virginia, on the 4th day of April, 1964, after
due advertisement of the time, terms and place of said sale, at which said
sale the said parcel was knocked down to the party of the second part at the
bid of $18,050.00, that being the highest offer received; and
WHEREAS, the party of the second part has paid to the party of the
first part the full purchase price for said parcel of land.
NO:T THEREFORE, in consideration of the premises, and the sum of
Eighteen Thousand and Fifty Dollars ($18,050.00) cash in hand paid, the
receipt of which is hereby acknowledged, the said party of the first part,
acting pursuant to, and in conformity with, the authbrity contained in the
aforesaid will of said George W. Stump, does hereby grant, sell, and convey,
with special warranty of title, unto the party of the second part, all of that
certain tract or parcel of land containing 106.74 acres, more or less, togethe:
with all rights, privileges and appurtenances thereto belonging, lying and
being situate about one bile East of Winchester, in Shawnee District,
Frederick County, Virginia, and comprising the major portion of that certain

by M. M. Lynch, Executor of Elizabeth A. Horsey by deed dated May 7, 1932, and
of record in the aforesaid Clerk's Office in Deed Book No. 164, page 19, and
which was subsequently devised by said Jessie G. Stump to her husband, George
W. Stump, by her last will and testament duly probated and of record in
said Clerk's Office in Will Book No. 61, page 416. A plat and metes and
bounds description of the within conveyed land made by Richard U. Goode,
Surveyor, is attached to, and by this reference incorporated in, this deed.
