Approval of Rezoning Request #005-89 of Bowman Trucking Company, Inc. rezone
135.974 acres from A-2 (Agricultural General) to RP (Residential Performance) for
single-family and,multi-family residences. This property is located north of the
intersection of Route 642 and Route 636 in the Opequon Magisterial District.

ADJACENT LAND USE AND ZONING: Residential, vacant and
agricultural land zoned A-2 (Agricultural General) and RP
(Residential Performance)
PROPOSED USE AND IMPROVEMENTS: Single and multi -family
residences
REVIEW EVALUATIONS:
Transportation Department - No objection to rezoning.
Before development, an adequate entrance will have to be
constructed to allow for safe ingress and egress. Any work
to be performed on the State's right-of-way will be covered
under a land use permit.
Sanitation Authority - The 15 inch Parkins Mill sewer
interceptor is approximately 500 feet to the north of this
property. An 8 inch water line is located over 4,000 feet
to the west at Wakeland Manor.
Frederick County Fire Marshall - Fire protection comments
will be made on the site plan or construction drawings.
Stephens City Fire Company - Shall comply with Chapter 10
of the Frederick County Code as a minimum. No water
available at this time for fire protection. We have
requested career personnel to supplement our day time help.
If our request is denied, then fire protection during the
day time may not be adequate.
Inspections Department - Shall comply to Use Group "R"
Residential Section 309.0 of the BOCA National Building
Code 1987.

Planning and Zoning - The following issues should be
considered:
Location: This site is located in the Urban Development
Area as designated by the Comprehensive Plan. Land
currently zoned RP is adjacent to the west.
Site Suitability: The site is relatively level. The Soil
Conservation Service describes much of this site as having
seasonally high water tables. Special methods for dealing
with drainage may be needed on this site. The site does
not contain prime agricultural soils.
The site has direct access to Routes 522 and 642. The site
would drain naturally to the Parkins Mill sewer interceptor
approximately 500 feet to the north. Development of this
site would require a significant extension of water lines
from the west.
Impacts: No adverse environmental impacts would be
anticipated. When fully developed, at an average density
of three units per acre, the site could generate traffic
amounting to over 3,000 average daily trip ends.
A complete reconstruction of Route 642 is included in the
Six Year Secondary Road Improvement Plan. It is the
staff's understanding that local funds have been allocated
to use VDOT's revenue sharing program to improve Route 642
from Route 522 to west of the intersection with Route 647.
This funding should move the improvement of Route 642 to a
time roughly concurrent with the likely development
schedule for this land. It will substantially improve
access to the site. In addition, the site will potentially
have direct access to Route 522 South.
Conclusions: The site is in the Urban Development area and
is adjacent to existing RP zoning. Road improvement plans
are underway that should deal with road impacts.

Special Commissioners as hereinafter mentioned, of the one part,
hereinafter called the Grantors, and JAMES L. BOWMAN, of the
other part, hereinafter called the Grantee.
WHEREAS, by Decree of the Circuit Court of Frederick
County, Virginia, entered January 6, 1983, in a certain partit
suit then pending styled Anna S. Craig, et als, Complainants, v.
Gladys S. Carpenter, et als, Defendants, the Grantors herein
were appointed Bonded Special Commissioners for the purpose of
selling at public auction for cash all that certain tract or
parcel of land, containing 146.75 Acres, more or less, in
Opequon Magisterial District, Frederick County, Virginia, more
particularly described hereinafter, after first having advertis
the time and place of such sale in The Winchester Star, a news-
paper of general circulation in Frederick County for four times
as required by said Decree of the Circuit Court of Frederick
County, Virginia; and,
WHEREAS, the said Special Commissioners did, pursuant
to said Decree, on March 2, 1983, on the steps of the Frederick
County"Courthobse in Winchester, Virginia, offer for sale at
public auction the said tract of land after having advertised
the time and place of the same in the said newspaper in the
runner aforesaid as will appear from the certificate of adver-
tisement filed with the papers in the said cause, at which said
auction the said land was knocked down and sold to James L.
Bowman for the sum of Seventy -Three Thousand Dollars ($73,000.00)
that being the highest bid received after spirited bidding; and,
WHEREAS, the said sale wds ratified and confirmed -by
Decree of the said Court entered March 2.3, 1983, and the said
