REVIEW EVALUATIONS: Virainia Dept. of Transportation - No objection to rezoning of this property. Before development, VDOT will require a complete set of construction plans detailing entrance designs, drainage features, and traffic flow data from the ITE Trip Generation Manual, Fourth Edition for review. Any work performed on the State's right-of-way will be covered under a land use permit. This permit is issued by VDOT's office and requires an inspection fee and surety bond coverage. Sanitation Authority - There is water & sewer at intersection of Rte. 50 and S.R. 728 approximately 2 1/4 miles away. There is sewer also at the Parkins Mill Waste Water Treatment Plant, approximately 2 1/4 miles away. There are no plans to extend water and sewer to this area. Health Department - Upon evaluation of the 68 acres on Rte. 50E an acceptable septic system was found for a 20 person business. Winchester Regional Airport - Comments Attached. Frederick County Fire Marshall - Must meet requirements under Chapter 10 of County Code. Inspections Department - This request for rezoning approval, shall comply to Use Group B,(Business), Section 303.0 of the BOCA National Building Code, 1987. Planning and Zoning - The following issues should be considered. Location: The site is located in a rural area outside of the Urban Development Area. The site is not located in an interchange area or existing business corridor. There are no existing business uses in the vicinity of the site. No business zoning is present in this area. The Comprehensive Plan states that certain business and industrial uses may be located at scattered rural locations if safe access is available and if adverse impacts on surrounding uses and the rural environment can be avoided. The Plan states that such business locations will primarily include major intersections or locations with existing business activity. Route 644 is a road that connects Route 50 to Route 522. It is the opinion of the staff that this road functions as a minor collector road. From that standpoint, the intersection in question might be considered to be a major intersection. Site Suitability: The site contains rolling terrain with relatively level ridge tops and a drainage way through portions of the site. According to the Soil Conservation Service, much of the site contains prime agricultural soils. The site is located at an intersection with a cross over on Route 50. The site has substantial frontage on Routes 644 and 50. Primary access to the site needs to be via Route 644 to take advantage of the intersection. Public sewer and water is not available. The Health Department has located an acceptable drainfield site to support the proposed business. Potential Impacts: The staff concurs with the impact analysis submitted by the applicant. The applicant has proffered that the use of the site would be limited to offices and other uses associated with the acquisition, development, construction and sales of real estate. The intention is to only carry out a particular group of business activities centered around construction and real estate sales. The proffer, if adopted, would not allow general retail or office uses. This proffer will limit traffic and other impacts. In addition, the applicant has provided a proffer that would guarantee access via Route 644 and that would allow only one entrance on Route 50. The applicant owns 42 undeveloped adjacent acres to the south which will provide separation from uses to the west. A residential property is located on a large lot to the south. Buffers will be required in relation to any adjacent residential properties. Conclusions: It is the opinion of the staff that, with the limitations proffered, the proposed rezoning meets the intention of the Comprehensive Plan for scattered business locations with limited impacts. This area is beyond the existing business corridor and should not be used for intensive business development. It is the opinion of the staff that the impacts of this proposal will be minimal. Staff Recommendation: Approval (1216189) PLANNING COMMISSION RECOMMENDATIONS:POR 12/6/89: Approval, with proffers. This vote was unanimous with Mr. Golladay abstaining. The following issues were discussed: 1. The architectural facade will substantially conform to the drawing submitted by the applicant. 2. Clifford & Associates, Inc. has been commissioned to evaluate the above referenced project in light of several major planning issues, as outlined and required by the Frederick County Board of Supervisors. This document is prepared in support of and in preparation to rezone the property from ,resent Rural Areas District to B-2 (General Business District). 1 ) Traffic Imp The site is being developed for the sole purpose of providing a location for the headquarters of Oakcrest Builders, Inc. The proposed building will consist of approximately 10,000 sq. ft. Using an ITE trip generation rate of 11.4 trips per day per 1000 sq. ft. 00 yields approximately 114 trips per day. Oakcrest employees approximately 20 individuals, assuming two and a half trips per day per employee results in 50 trips per day. It is our estimate that 100 trips per day can be expected. This traffic will access the site from the main entrance on Va. Route 644. The developer will dedicate additional right- of-way along Route 644 from the entrance to US Route 50 if improvement of this section is deemed necessary by the Virginia Department of Transportation. The estimated traffic volumes would not justify an improvement of the existing VA Route 644-US Route 50 intersection. 2) Sewage Conveyance and Treatment Imp: The sewage from this project will be handled by an onsite drainfield. Sufficient area has been located and approved by the Frederick County Health Department on which to place the field. The well and water will meet all the requirements of the State Health Department. Water supply to the site will be at no cost to Frederick County. 4 ) Education Cost: This project will generate no school children and therefore have no effect on educational cost in Frederick County. It will generate tax revenues with a net worth of approximately $60.00 per square foot plus real estate or a tax base of $1,200,000.00 which totals at a tax rate of $.60 approximately $5000.00 per year of tax revenue. This would be without the need for expenditures other than Sheriff protection. 5 ) Parks and Recreation Cost: This project would result in no impact on Parks and Recreation budget. 6 ) Drainage Facility Imp: • An overall storm water management plan for the site will be provided at site planning. The development of commercial in lieu of agricultural will increase run off. It is recommended that either suitable green space be allowed to reduce run off amounts or that the increased run off from that if agricultural would be reduced prior to discharge from the site. In lieu of the above, additional storm water calculations will be presented with final design which would show no adverse impacts created by the imposition of this increase storm water on the down stream channel. 7) Emergency Services Cost: Sheriff protection will be required by this facility. Routine patrols in conjunction with that being conducted in the Deer Park Estates area should suffice for the majority of time and materials necessary to cover this facility also. Special patrols and activities may include a total of 1 hour per week. Special coverage at $50.00 per hour would involve approximately $2600.00 per year. There should be no other impacts on emergency services. i4667 �� 19gg E/V � ���zzztizoti� 0 Q RN Solid waste will be exported by contract hauler at no cost to the County. 9 ) Environmental Impacts: There will be certain minor negative impacts due to the construction activity including run off sediment, noise and traffic movements. These are to be minimized by proper compliance with local and state laws for environmental protection. A minor increase in run off quantity and a decrease in quality is probable from this development. The effects on the down stream areas are minimal and in accordance with local and state regulations. There is no known loss of irretrievable resources involved with this project. There are no known endangered species of fauna, flora or wildlife which will be effected by this project. Ground water and air quality should be unaffected. A minor impact of a negative nature is associated with lighting for security and business use. These should be closely controlled during planning stage to minimize the adverse impacts on adjacent residential structures and impacts on the traveling public. 1 0) Other Fiscal Imp: • Mentioned above is the positive impact on the County financial picture. No other impacts were noted. 1 1 ) Historic Impacts: This project will not involve the loss of any historic sites or artifacts that are known.
