Smith Rezone 7 acres from B-2 (Business General) to B-3 (Industrial Transition) LOCATION: On Route 661 (Welltown Pike) about two miles north of Winchester MAGISTERIAL DISTRICT: Stonewall ADJACENT LAND USE AND ZONING: Residential uses zoned RP (Residential Performance) and RA (Rural Areas), and business uses and vacant land zoned M-1 (Light Industiial) PROPOSED USE AND IMPROVEMENTS: Majority of the property will be used by Shenandoah Foods, Inc. for its wholesale business and offices. An office and warehouse will be built. REVIEW EVALUATIONS: Transportation Department - No objection to the rezoning of this property. Before development, my office will require a complete set of construction plans for review. An entrance will have to be constructed to allow for safe egress and ingress of the property. Any work performed on the State's right- of-way will be covered -under a land use permit. Health Department - No objection given that public water and sewer services available. Per H. K. Benham III of Harrison and Johnson, Attorneys At Law, such facilties are available. Sanitation Authority - Water and sewer are available. Closest water about 1000 feet. Closest sewer about 2000 feet. See attached maps. Water and sewer capacity available. Frederick County Fire Marshal - No problem. Hydrant location will be addressed on site plan to meet Chapter 10 of Frederick County Code. Inspections Department - Shall comply to Use Group of the BOCA National Building Code 1987. Comments shall be given at time of plans review to determine the use group. Planning and Zoning - The following issues should be considered: Location: The site is located in the urban development area adjacent to the Stonewall Industrial Park. Site Suitability: The site is generally level. It is adjacent to Interstate 81. It has over 800 feet of frontage on Route 661. The site is generally suitable for development. Potential Impacts: The site is adjacent to existing dwellings. Buffer and screening requirements will have to be met in relation to the adjacent residential properties. The B-3, Industrial Transition District allows warehouses and wholesaling and other heavy commercial uses. Development under B-3 zoning will generate less traffic than development under the current B-2 zoning. The types of retail uses allowed under B-2 zoning are major generators of traffic. B-3 zoning will generate more heavy truck traffic than B-2 zoning. However, heavy truck traffic is common on this part of Route 661 because of the Stonewall Industrial Park. Conclusions: The site is an appropriate B-3, Industrial Transition location, adjacent to an existing industrial park. Potential impacts will not be increased or will be reduced by the rezoning. STAFF RECOMMENDATION: Approval (For ll/l/89) PLANNING COMMISSION RECOMMENDATIONS OF 11/01/89: Unanimous approval. BOARD OF SUPERVISORS ACTION OF 12/13/89: At their meeting of December 13, 1989, the Board tabled this item and returned it to the Planning Commission for further consideration. Concerns expressed by the Board included the following: 1. Traffic problems on Welltown Pike associated with industrial truck traffic. Concerns were expressed on truck turning movements and the need for turning lanes. 2. Inadequate water pressure for appropriate fire protection. Regarding the Planning Commission's review of the matter, I would appreciate your having the matter heard the week of January 17, 1990, rather than the week of January 3, 1990, as I will be out of town the first week of January. Regarding the Board of Supervisors comments, I note the following: A. The question of water run off is handled by the plans prepared by Howard Shockey and Sons, a copy of which I would be glad to deliver to your office if you so desire. A holding pond will be constructed at the West end of the property. This should improve the adjacent landowners present water problem. B. As to the usage of water, the use of the property for a warehouse and office will result in no more usage of water than most any B-2 usage (probably less). 9 • Mr. Robert W. Regarding water pressure, the plans for the office building and warehouse do not call for a sprinkler system and can be operated from well water only, if this were the situation. Con- sequently, I do not believe the property will require any more water pressure if zoned B-3, than if zoned B-2. D. Regarding the construction of water and sewer lines to the property and adjacent properties, I am contacting the adjacent parties in an effort to secure an agreement regarding the payment of the construction of that line. I will be in touch with you as soon as I secure more information. E. Regarding increased number of trucks on the road, please note that Shenandoah Foods owns eight 19 to 24 foot long trucks which generally leave in the morning and return in the evening each working day. In addition, the company owns two pickup trucks. An average of ten tractor trailers bring supplies to the office a week. This would not appear to be any significantly greater truck usage from the property than that of any B-2 usage. As to entrances on the highway, the landowner is willing to restrict the number of entrances along the 900 foot frontage to two entrances.
