Keeler Rezone 1.041 acres from RA (Rural Areas) to B-2 (Business General) LOCATION: The west side of Route 11, directly across from the entrance to Lord Fairfax Community College, on the southeast corner of Route 634. Approximately .2 miles north of Middletown. MAGISTERIAL DISTRICT: Opequon ADJACENT LAND USE AND ZONING: Vacant land, agricultural land, and a community college zoned RA (Rural Areas) PROPOSED USE AND IMPROVEMENTS: Existing house will be expanded and converted to a convenience store REVIEW EVALUATIONS: Transportation Department - No objection to the rezoning of this property. Prior to the operation of a business, a commercial entrance will have to be constructed to our minimum standards to allow for safe egress and ingress of the property. Health Department - No objection as long as present structure is used. No on - premise consumption of food is proposed and toilet facilities are provided for employees only. Gallon flush toilet(s) to be used and connection made to central sewer when available. Note: Sewage needs to be reduced with conversion of existing structure to a convenience store. (Full bath and automatic washer will be reduced to 1/2 bath.) Frederick County Fire Marshal - In order to comply with the Frederick County Chapter 10, there must be a fire hydrant within 300 feet. If none exists, one will have to be put on the site prior to approval. Inspections Department - Shall comply to Use Group "M" Mercantile, Section 308.0 of the BOCA National Building Code 1987. Planning and Zoning - The following issues should be considered: LOCATION: The site is located on Route 11 south across from the Community College. It is located less than 800 feet north of the intersection of Route 0 • REZONING REQUEST #016-89 Richard A. Keeler 627 and Route 11. The Comprehensive Plan states that business uses may be located in rural locations at major intersections or locations with recent or existing business activity. This site in question is in the vicinity of the substantial existing business activity in Middletown at the Route 627 intersection. SITE SUITABILITY: The site is a level site with an existing dwelling. Public water is available to the site. Fire hydrant and other fire protection requirements will have to be met. The Health Department tells us that the sewage disposal facilities are sufficient for business use as long as food is not consumed on the site. POTENTIAL IMPACTS: Land adjacent to the site is largely vacant. Impacts on surrounding properties would not be expected. The proposed rezoning could result in definite traffic impacts. For a site this size, a worse case may be a 4,000 square feet 24 hour convenience store which could result in over 3,000 trips entering and exiting the site on an average day. The 1987 average daily traffic count on Route 11 in this area with somewhat limited capacity. Concern should be expressed on traffic impacts. CONCLUSIONS: It is the opinion of the staff that business uses at this location will not conflict with the Comprehensive Plan. However, rezonings that extend the business corridor north along Route 11 in this area may not be appropriate because of the limited capacity of Route 11. The applicant proposes a convenience store which could be allowed with a conditional use permit. STAFF RECOMMENDATIONS: Denial.
