This letter is to confirm action taken by the Frederick County
Planning Commission at their meeting of June 20, 1990.
Approval was given for Site Plan #028-90 for Reading Landscapes,
Inc. This property, zoned B-2 (Business General) and consisting
of 2.001 acres, is located on U.S. 522 North at Albin in the
Gainesboro Magisterial District, and is identified as parcel 76 on
tax map 42.
Approval was granted with the stipulation that the owner will
improve the entire southern boundary (4661) and western boundary
(2001) of the parcel with a single row of white pine along the
exterior boundary, and provide a single row of burkwood directly
behind the white pine. All landscaped screening will be four feet
at the time of planting.

The undersigned, sole owner of land to be rezoned under
rezoning Request No. 003-90, referred to as the Reading
Landscapes, Inc. rezoning, and the applicant for said rezoning,
hereby voluntarily proffers the following condition. The
condition proffered shall be binding upon the assigns and
successors in interest of both the applicant and owner. In the
event the Frederick County Board of Supervisors grants said
rezoning and accepts this condition, the following proffered
condition shall apply to the land rezoned in addition to other
requirements set forth in the Frederick County Code:
1. The following shall not be permitted uses under the
proposed B-2 (Business General) zoning, to -wit: Auto Dealers
and Gasoline Service Stations and Car Washes.
2. The Applicant will file a site plan of the subject
property to be approved by the County of Frederick, Virginia.
3. The Applicant will comply with the landscaping
requirements of Section 21-3-11 of the Zoning Ordinance of
Frederick County, Virginia.
4. The Applicant will comply with the landscape screening
requirements of Section 21-3-12-2.1 of the Zoning Ordinance of

Planning and Zoning: The proposed site plan was proffered

This is to acknowledge receipt of your letter of transmittal and request for
site plan corments concerning the above referenced business.
Upon review we have no objections to any on site improvements to the property
at this tir:-Ie. However, we have monitored the site on several occasions over
the past several weeks and have found the existing gravel entrance into the
property is still being used by customers. For your information we previously
conmented on this entrance in January, 1990. Attached is a copy of said
comments. As you can see from our earlier review if access to the business
were to continue then it would be necessary- for the substandard entrance to be
either blocked or removed.
Therefore, at this time we request the substandard private entrance be removed
and the right-of-way restored. Quite frankly we see no reason for the
entrance to remain since the owner just recently installed a standard
commercial entrance to serve his business.
Should you have any questions or would like to discuss this matter further, do
not hesitate to call.

Now that the Board of Supervisors has approved the rezoning
request of Reading Landscapes, Inc., the remaining matter to be
