("Bartlett"); and, WHEREAS, Bartlett has rejected the County's bona fide offer of purchase, It was duly moved, seconded and unanimously passed that the following resolution is adopted. BE IT RESOLVED that the County of Frederick, Virginia, recognizes the necessity for the construction of a public road over and through the parcel of land containing 3,459 square feet, together with a right of way along the access lane now existing, as shown on the attached plat, and hereby authorize the acquisition thereof, including the institution of appropriate condemnation proceedings pursuant to Titles 15.1, 25, and 33.1, of the Code of Virginia, 1950, as amended. BE IT FURTHER RESOLVED that the County Attorney is directed to proceed to obtain the appraisal and institute the condemnation proceedings as may be necessary with full authority to associate such other counsel as he shall deem necessary. This type of construction is office/warehouse facilities. The project will also involve installation of sewer, water and utilities. The total developed area is 10 ± acres. Existing Site Conditions - Prior to construction, the site was characterized by rolling terrain, lightly wooded with some undergrowth, all typical of undeveloped areas in the upper Shenandoah Valley. The site is in the Wiekert-Berks-Blairton Soil Association. This area is characterized by gently sloping, shallow to moderately deep, somewhat poorly drained soils that have a medium to fine textured subsoil; formed in material weathered from shale. Adjacent Areas - Most of the areas surrounding the development are industrial in nature. The remainder is of vacant use. There is no RP land in the area. The Airport lies to the south of the property. it - For purposes of design runoff conditions, antecedent moisture condition II (normal consideration for the mid -Atlantic region) is assumed. The soil is considered to have a moderate rate of water transmission, therefore, SCS Soil Class "C" is adopted. Soils are for the most part of the Blairton 3C Series. A copy of the respective soil map is enclosed. Permanent Stabilization - Seeding for permanent stabilization is specified in the V.E.S.C. Handbook. Any area denuded in which work is not proceeding for a period of 30 days or more will be stabilized by a temporary seeding in accordance with State guidelines and procedures. All areas to be seeded will receive seed application by hydroseed methods immediately upon obtaining grades. Storm Water Management Consideration - A copy of the site plan has been attached. Drainage from two thirds of the site is carried by storm sewer to a detention pond located in the northwest corner of the site. The pond limits the ten year runoff from the • 0 west edge of the developed property to the two year predevelopment rate. The increase runoff to the west is carried away by a proposed 27" RCP culvert under VA Rte. 728. We proposed to replace the existing 18 RCP which is inadequate for the predevelopment condition. A predevelopment C factor of .25 was used for all vacant tracts. Maintenance - AII soil erosion control structures shall be checked weekly by the contractor during this construction period and after construction is completed until grass cover is established. Sediment retained by these structures shall be continuously removed and placed in an area of the site specified, damage to soil erosion control structures shall immediately be repaired when identified by the contractor. The contractor shall cooperate with all agents of the County, the Engineer and others who may identify needed facilities or work in order to protect the environment within the subject of this report. The following comments need to be addressed in order to comply with the requirements of the Frederick County Zoning Ordinance: BOUNDARY ADJUSTMENT: The proposed site plan is located on two different parcels. This will violate the setback requirements of the M-1 District. A boundary line adjustment will be necessary to remedy this. The boundary line adjustment will be handled administratively and will not require public hearings. SETBACKS: The building representing DA-H is 73' from the right- of-way, and needs to be 751. PARKING: 1) All parking spaces need to be 180 square feet. The majority of the parking spaces do not meet this requirement. 2) The parking calculations for the warehouse areas are not calculated correctly. The spaces need to be calculated according to the ordinance requirements. 3) Five of the eight handicapped spaces are not 12' in width. 4) Handicapped ramps need to be provided for all handicapped spaces. I believe that it would be a better design if the handicapped spaces were located on the same side of the parking lot that includes sidewalks. ACCESS ISSUES 1. There appears to be an access road along the Eastern boundary. It is not clear whether this is a private easement or public road. The southern entrance onto this access road is very close to the intersection with Rt. 728. If the access road is to receive much traffic, there may be conflicts here. DRAINAGE 1. The drainage computations, drainage divide map and stormwater detention pond design have been provided. 2. It is unlikely that the time of concentration (Tc) for drainage to the on -site storm sewer structures will be 15 minutes. On industrial sites, a 5 minute is more realistic. 3. After review of the flows calculated to the storm structures and pipes, the capacities are very close to the predicted 10-year calculated flows based on the 15 minute Tc. 4. He and I have different points of view on drainage design regarding times of concentration in which we both are standing firm..However, in the interest of compromise so that the project can move forward, I have agreed to look at the basic assumptions made by Mr. Maddox and to limit my concerns to those areas where these assum- ptions could have a negative impact on public safety or adjacent property owners. VDOT has accepted the drainage inlet design for Structure 1 on Route 728. It is my opinion that the spread of 12 feet into the road is too much as it was computed. However, if VDOT accepts the spread then I will pull back from my position. The existing culvert under Route 728 is proposed to be enlarged from 18" to 27" which will give it adequate capa- city to convey drainage under the road. The other storm drainage facilities are on site. If spreads are larger in the parking lots it will not create a hazardous situation, only temporary inconvenience with ponding water during rainfall events. Therefore, for an industrial application this need not be a major concern to the County.
