Dear Mr. Morrissey: COUNTY of FREDERICK Department of Planning and Development 703/665-5651 FAX 703/678-0682 This letter concerns my latest conversation with Mr. Jerry Fout of Weber's Nursery, as well as my telephone conversation with you. Hopefully, this letter will bring everybody up to date regarding the improvements to the above mentioned project. As you recall, the approved site plan called for the a solid board fence to be placed along the rear property line of this site. Frederick County was asked if an alternative buffer would be acceptable, provided that the buffer adequately screened the bank from the adjoining residential property. We agreed to review proposals and provide you with our decision. Mr. Fout met with me on March 10, 1992 to discuss revisions to the required buffering and landscaping requirements. Mr. Fout proposed the placement of twelve (12) white pines six to eight (6-8) feet in height planted on eight (8) foot centers. Mr. Fout also proposed the placement of four (4) bradford pear trees and three (3) kwanzan cherry trees along the parking/maneuvering area. These fruit trees are also proposed to be six to eight (6-8) feet at time of planting. This proposal is acceptable to Frederick County, provided that the twelve (12) white pines are planted along the rear property line, the large shrubs are relocated to "fill-in" gaps that will be left by the white pines until they reach maturity, the two (2) existing mature pines are left intact, and the fruit trees are planted as shown on the proposed plan. Frederick County will also need a copy of a maintenance agreement that specifies the party responsible for maintaining this landscaped area. The other issue at hand regards the need for additional employee parking associated with this project. You requested that I provide you with information regarding the feasibility of utilizing an abutting lot in the College Park subdivision to achieve this need. April 2, 1992 Section 3-3-1.2 of the Frederick County Zoning Ordinance provides for shared parking that may be located on an abutting lot provided that the zoning of the abutting lot is the same as the lot that the use exists on, pedestrian access is provided along the shared parking areas, and a lease, easement, or other form of agreement assuring proper maintenance of the parking areas is submitted to the Zoning Administrator for review and approval. Parcel 64A-2-6, located on Princeton Drive in the College Park subdivision, is zoned RP (Residential Performance), and is a part of that platted subdivision. In order to utilize this lot for parking, a rezoning would be required, followed by a site plan that would address items such as buffering, landscaping, stormwater management, pedestrian access, and other potential items. Because this lot is located within the boundaries of a platted residential subdivision, the granting of a rezoning request may be difficult to obtain. The parcel abutting your western property line (occupied by the Minute Wok Restaurant) may be worth your consideration. The zoning of that parcel is B-2 (Business, General), which is the same zoning as your parcel, and it appears that the items specified under section 3-3-1.2 of the Frederick County Zoning Ordinance could be achieved. The vacant area behind the Minute Wok Restaurant could be utilized as employee parking for both businesses. This option would also require the submittal of a site plan for the same reasons listed previously, as well as all requirements listed under section 3-3-1.2. The purpose of our conversation was to consider alternatives that will effectively screen your proposed site improvements from the existing residential use. The approved site plan calls for the relocation of shrubs and fruit trees, as well as the placement of a six (6) foot high board fence. It is my understanding that the resident adjoining your.property does not want the fence constructed, as it would make her feel "boxed in'. The Frederick County Zoning Ordinance allows for different screening types that will accomplish a separation of uses. Lantz Construction Company has already relocated the shrubs per the approved site plan. I would be willing to review a revised site plan that provides a landscaped easement within the existing green space. If this landscaping plan will effectively screen the property over time, I will recommend approval of the landscaping plan in lieu of the six (6) foot high board fence. The following comments need to be addressed prior to approval of this plan: 1) The proposed site plan calls for approximately 8,800 square feet of .additional pavement. This will increase the overall impervious surface to 80% of the 30,000 square foot site. With this in mind, I feel that this plan needs to go to our engineer. Please check with Paul Bernard (703) 385-3566 to insure that all drainage information that will be required is submitted. 2) The proposed site plan will encroach on the residential lots (located behind the bank) another 68 feet. When this bank was first constructed, there were no buffer and screening requirements; however, the bank will now be required to provide full screening along the entire northern boundary as described in Article 3-12-2.2 of the Zoning Ordinance. 3 ) There will be grading on this site in order to bring the green space to the same elevation as the existing parking lot. With this in mind, there needs to be silt fencing placed along the disturbed areas. 4) The plan indicates that all trees and shrubs will be relocated. Access Issues 1. Since this is an existing site, it is assumed that adequate horizontal and vertical sight distance exists. 2. The proposed parking spaces at the southwest entrance are very close to the intersection of Route 50 and the entrance. With this there is a good possibility that there may be conflicts with cars backing out of the spaces and vehicles pulling in the parking lot. I would suggest that only the one handicap space be planned for at this location. 3. A typical pavement section needs to be provided on the plan. Drainage Issues 1. Adequate spot elevations at property corners and curb returns were shown. Contouring or spot elevations within the pavement improvements are not provided, which would ensure the proposed drainage divides. 2. From the drainage computations the existing 15" RCP with a slope of S = 0.0035 is not quite adequate to handle the discharge of 4 cfs. I would also like to point out that a storm sewer system needs to be designed for the 10 year storm, which would be 5.1 cfs.
