Dear Mr. Negley:
The Frederick County Planning Department administratively approved Site Plan #006-92
for Negleyland on June 18, 1992. The approved site plan calls for the construction of a
10,000 square foot office building and shop, a 7,200 square foot office building, a 4,500
square foot shop, two paved parking lots complete with 41 regular parking spaces, 3
handicapped parking spaces, handicapped ramps, curb and gutter, and parking lot
landscaping, a storm water detention pond, and all appropriate erosion and sedimentation
control devices. Enclosed is a copy of the approved site plan for your records.
It is my understanding that permits from the Winchester -Frederick Health Department and
the City of Winchester Public Utilities Department have been acquired for your well and
septic meter. Any questions you may have regarding these improvements should be
addressed to Mr. Doug Daily or Mr. Jesse Moffett.

I have completed my review of the Negleyland site plan. The conceptual design of this site
is fine; however, there are some minor revisions that need to be incorporated into this plan
prior to final approval. I offer the following comments:
1) The parking area serving building #2 requires the installation of concrete or rolled
asphalt curbing and gutters around the perimeter of the parking lot. (Section 3-3-2.3
of the Frederick Co. Zoning Ordinance)
2) The landscaped island in front of building #1 that separates the parking area from
the access drive needs to be bordered by concrete or rolled asphalt curb. (Section 3-
3-2.4 of the Frederick Co. Zoning Ordinance)
3) Requirements of the American Disability Act need to be incorporated. The State
of Virginia has incorporated these into the Building Code. The comment sheet from
John Trenary, Frederick County Building Official, dated February 18, 1992, specifies
this. My discussion with Mr. Trenary indicates that certain items such as the
handicapped parking spaces, ramps, and accessibility connections between the
proposed building are inadequate. Please check with Mr. Trenary regarding these
requirements.

location. The plans appear satisfactory and are approved. Please advise the developer

I offer the following comments:
• A preconstruction conference be held by the engineer and/or developer with the attendance
of the contractor, various County agencies and VDOT shall be conducted prior to initiation
of work.
• Materials used and method of construction shall apply to current observed VDOT Road
& Bridge Specifications applicable during construction of this development.
• Our review and comments are general in nature. Should conditions in the field exist such
that additional measures are warranted, such measures shall be completed to the
satisfaction of the Department prior to inclusion into the Secondary Road System.
• Attached is a copy of the minimum requirements and information needed prior to
acceptance of subdivision streets into the Secondary System. This is the responsibility of
the developer.
• All drainage is to be carried within the right-of-way in ditch lines or gutters along the
street to a pipe or drainage easement.
• The contractor shall notify VDOT when work is to begin or cease for any undetermined
length of time. VDOT will also require 48 hours notice for inspections.
• The appropriate land use permits shall be obtained before any work is performed on the
State's right-of-way.

• If mailboxes are to be placed along the roadway fronting lots, a minimum of four (4') feet
shall be between the edge of pavement and the front of mailbox as shown on the enclosed
sketch.
• Any entrances constructed from the referenced street(s) shall meet VDOT minimum
standards. This is the developer's responsibility.
• Any signs to be installed will be in accordance with attachments.
• I suggest any utilities and/or storm sewer placed within the proposed right-of-way be
backfilled completely with C.R. Type 21-A Stone. This will greatly reduce the possibility
of any pavement settlement.
• An agreement between VDOT and Frederick County to absolve the Department of any
maintenance or liability of the detention basin will be required. This is the developer's
responsibility. The executed agreement is needed before the street is eligible for
acceptance into the State's Secondary Road System.

This is to follow-up on the preconstruction conference held April 15, 1993 for the referenced
project wherein we reviewed the attached VDOT requirements. If you are not in complete
agreement with or need clarification on any of this listed items, please let me know.
Please be reminded we will require forty-eight (48) hours notice for any inspections. As
discussed we are particularly concerned with the proper placement and compaction of
embankment fill, shaped subgrade, base aggregate and asphalt placement, and the installation
of the 24" R.C.P. culvert under the access road. To ensure compaction requirements are being
met, we would appreciate you providing us with copies of all testing reports.
Enclosed you will find Land Use Permit Application No. 27231 [Form CE-7(A)] and copies of
our standard bonding forms (Surety Form MP-220 & Irrevocable Letter of Credit
Form MP-231). You will need to complete the information noted on the permit application and
return it along with a bond in the amount of $10,000.00, check made payable to Virginia
Department of Transportation in the amount of $70.00 and four (4) sets of the approved site
plans. Once we are in receipt of this information, please allow approximately thirty (30) days
for processing of your application.

feel it has not only opened a line of communication between all concerned but may have also

please find our recommendations on the enclosed plans marked in red and as
follows:
1. The locations of the required 20' drainage easement and right-of-way
dedication along Route 661 are to be revised as noted.
2. Since the proposed 24" R.C.P. culvert under the access drive has not
been raised as previously recommended, the inverts of the existing
2111x15" culvert under the Econo Lodge entrance downgrade are to be
shown.
3. Standard ES-1 flared end sections and EC-1 erosion control stone
will be required on the ends of the 24" R.C.P. culvert and so noted.
4. A drainage easement will be required to enclose the proposed
detention basin as well as an agreement between VDOT and Frederick
County to absolve this Department from any maintenance or liability
responsibilities due to the existence of the facility. This
agreement is the developer's responsibility and will be required
prior to addition of the street into the State's Secondary System.
Once the above recommendations have been addressed, please resubmit four (4)
copies of the plan for final approval. We would suggest all items marked in red
be incorporated into the plans.

As requested we have reviewed the above referenced site plan dated January, 1992.
You have indicated the developer may wish to dedicate the proposed access roadway
for public use sometime in the near future. However, in order to do so we would
have to provide inspection services during construction of the facility to ensure
compliance with VDOT requirements. Therefore, we have based our review on such
and offer recommendations as noted on the enclosed plans marked in red and as
follows:
1. The street should be redesigned to provide a cul-de-sac. We have
noted on Plan Sheet No. 2 the size and type of cul-de-sac required
and a suggested location,
2. A minimum 50' right-of-way would be required for the street with
additional width for the turn around and intersection with
Route 661. We also suggest a 20' utility, slope and drainage
easement be provided outside the right-of-way limits to accommodate
any future concerns.
3. The right turn lane on Route 661 is to be lengthened to 100' with
12' width and a 100' taper. The intersection radii are also to be
increased to 50'.
4. The 24" outfall pipe from the detention basin will require a
drainage ditch along Route 661 with a drainage easement provided as
noted. The inlet of the pipe needs to be extended and the basin
adjusted so the inlet end of the pipe and basin are outside of the
proposed right-of-way.
5. Culvert No. 2 should be increased to an IS" pipe based on a ten year
design.
6. The typical section should be revised to show 6' shoulder widths
with the base stone aggregate (Type 21-8) extended 1' beyond the
edge of pavement.

7. The limited access fence along the I-81 off ramp should be shown
along with a note which prohibits encroachment onto the
right-of-way.
Please revise the plans and resubmit four (4) copies for further review. Should
any changes be deemed necessary please design them to meet or exceed the above
recommendations.

narrative below describes the manner in which each comment was
addressed.
1.
The access road has been redesigned to

offset bulb configuration was used to

Pepco right-of-way.

A 50' ROW has been shown around the
access road and will be
dedicated to the state if and when the
property is subdivided.
3.

the need for additional ROW dedication
along Route 661.

is the method used to
generate the peak flow. I believe that
this method is extremely

Additional Comments: It is my understanding that the nearest public water
main located at Rt. 11 N and Rt. 661 is a Winchester owned line and the
owner would not be permitted to extend water to his project. This is
unfortunate because if this site is approved, the lack: of a nearby hydrant
will hamper fire fighting efforts. It would also be cast prohibitive to
run a water main to Rt. 11 N. I recommend the owner be required to install
a hydrant at the point in time that a water main is run along Wel ltown
Pike. This will afford protection to the proposed buildings as well as
any future buildings added to the site.

This office has reviewed the Negleyland site plan you forwarded. Based on our
review, we have the following comments:
1. The City of Winchester has sufficient sewer capacity available to
serve the proposed development.
2. Projected usage indicates that the development has the potential
for becoming a public waterworks; however, until such time as
population criteria establishes Negleyland as a public waterworks,
surveillance and permitting of the proposed development would be
the responsibility of the Frederick County Health Department.
3. It is our recommendation that the water source be at least a Class
II-B well and the well located such that the minimum well lot size
required by the Watez-woz-ks Regulations is provided.

Well Approval
Dear Mr, Lewis,
Approval of the proposed well is pending submittal of a complete
application with required fee, site visit by the health depart-
ment, and issuance of a permit. Private well permits are issued
by the local health department and public wells are issued by the
Division Of Water Supply Engineering. Determination of the
permitting authority and the applicable regulations depends upon
the use of the well (public or private), the number of connec-
tions, or the average number of individuals to be served by such
water supply. Initial review of plans shows a well twenty (20')
feet from a structure which may or may not be termite treated and
twenty five (25') feet from a trash receipt area where contami-
nants may be disposed of.
The Office Of Water Programs in Lexington handles review of site
plans which involve proposals for use of public sewerage systems.
In order to refer your request to that office, I need to know the
proposed design flow and the receiving wastewater treatment works
(probably Opequon Plant).
Please supply the necessary information outlined above so that I
may process your request. I may be reached at 722-3480 or. 459-
2989 if you have any questions.
