Dear Forrest: The Frederick County Planning Department administratively approved site plan #015-91 of Signal Station on July 12, 1991. The approved site plan calls for the construction of three (3) buildings to be used for retail and office space, a parking lot complete with an asphalt surface, twenty-two (22) regular parking spaces, two (2) handicapped parking spaces with ramps, curb and gutter, concrete sidewalks, all required landscaping, a stormwater detention pond, and all appropriate erosion and sedimentation control measures. Enclosed is a copy of the approved site plan for your records. This site plan is to be developed in two (2) phases. Please remember that all bonding requirements need to be worked out with Mr. Wayne Miller, Zoning Administrator, or all of phase one will be expected to be complete in order to obtain an occupancy permit. During our conversation, we discussed different ideas to remedy the time problems Mr. Brown is having with his site plan. I believe these suggestions would be beneficial to all involved: 1) The first problem involves adding this site plan to the bimonthly report. Due to the amount of time that it will take VDOT to comment on this plan, it will be July 17, 1991 before this site plan will be listed on the Planning Commission Agenda. We have suggested that Mr. Brown appear at the June 19, 1991 Planning Commission meeting. This will give him the opportunity to present his case to all that may have concerns. 2) The second problem is meeting the linear footage distance required for the buffer. Wayne Miller has already stated that he will recommend denial of a variance due to lack of hardship. I suggest that the four parking spaces be relocated behind the phase II retail building or added along the parking in the front portion of the lot. 3) The final problem regards the type of screening required. Due to the short distance between the property line and the retail stores, full screening is required. There are provisions for the reduction of screening requirements if natural features are adequate. This is very similar to George Whitacre's problem at the post office. I suggest that you submit the site plan showing the required fence, and we take the site plan to the July 17, 1991 Planning Commission meeting to reduce this requirement. I have talked with Forest and Tracy and suggest that a row of white pine be planted along the rear property line to take care of concerns regarding adequate screening during the winter months.
